Terms & Conditions
By providing signature associated with this form, the CLIENT (undersigned) agrees to the following Terms and Conditions of MONARCH CLEANING, LLC:
Section I: Parking & Job Site Access
A) CLIENT agrees to provide reasonable parking accomodations for loading in supplies and parking during the cleaning appointment, itself, and to communicate those details before the clean begins.
B) CLIENT agrees to provide their service professional(s) entry into the building within 5-minutes of their arrival, with the following understandings:
i) If the service professional(s) cannot gain entry 5-minutes after the booking time begins, they will return to their vehicle.
ii) If service professional(s) cannot gain entry into the building 15-minutes after the booking time begins, they will leave the property and a same-day cancellation fee may incur.
C) CLIENT agrees to be physically present at the first booking to allow service professional(s) and to specificy to service professional(s) which spaces are to receive service.
D) CLIENT agree to allow service professional(s) full access to the spaces meant to be serviced at the start time of the appointment, with the following understandings:
i) If service professional(s) cannot gain access to some of the agreed upon spaces within 15-minutes of the start time of the appointment, then that space may be refused for service.
ii) If service professional(s) cannot gain access to all of the agreed upon spaces 15-minutes after the booking time begins, they will leave the property and a same day cancellation fee may incur.
Section II: Respect & Autonomy
A) CLIENT agrees to be courteous and respectful to service professional(s) as well as all other persons and animals on premises for the duration of the appointment, with the following understandings:
i) Failure to provide service professional(s), any persons, or any animals on premises with kindness and respect will result in immediate termination of the appointment and a fee may incur.
ii) Kindness and respect is expected for all animals on premises regardless of species, age, gender, ability, or any other perceived or hidden differences of any kind.
B) CLIENT agrees to allow service professional(s) to provide your requested service utilizing the methods and techniques deemed most appropriate by their expertise, with the following understandings:
i) Any suggestion or request to control service professional(s) body/bodies in any way will result in immediate termination of the appointment, future booking refusal, and a fee may incur.
ii) Suggestions or requests to control service professional(s) body/bodies include, but are not limited to: dictating which techniques, tools, methods, and/or order-of-operations are used to complete the job requested.
C) CLIENT agrees to respect and observe the physical autonomy of service professional(s) during the entirety of their visit with the following understandings:
i) CLIENT will not physically touch service professional(s) body/bodies under any condition without the explicit and expressed consent of that person.
ii) CLIENT will not make comments on the body, physical apperance, or perceived physical abilities of service professional(s) with the following understandings:
a) This includes, but is not limited to, any and all comments about body appearance, body capabilities, and any and all unsolicited medical advice.
b) Any and all comments on body, physical appearance, or percevied physical abilites is unwarranted, whether or not the client themselves considers their comments harmless or harmful.
iii) CLIENT agrees to not inquire or comment on service professional(s) medical history/histories in any way, shape, or form, with the following understandings:
a) This includes, but is not limited to, casual inquiries as well as more specific and direct questioning.
b) This includes any and all unsolicited medical advice.
iv) CLIENT agrees to not disclose any personal or medical information about any other persons besides themselves without the explicit and expressed permission of those persons with the following understandings:
a) This includes, but is not limited to, any second-hand reporting on anyone's medical information.
b) Exceptions can be made in emergency situations only if the act of disclosing a person's medical information would or could help treat an emergent issue or prevent further complications and that person is not able to self-disclose due to pain, trauma, or other incapacitation and the disclosing individual is not otherwise bound by medical laws and guidelines.
Section III: Safety
A) CLIENT understands that service professional(s) have the right to refuse bookings, discontinue service, and/or leave at any time for any reason.
B) CLIENT agrees to be responsible for all children and animals on premises for the duration of the appointment, with the following understandings:
i) Any children or animals who pose an immediate or perceived physical threat to service professional(s) will be dealt with in whichever manner the service professional deems necessary to ensure their protection and safety.
ii) CLIENT will immeidately address any acts of aggression from children or animals including, but not limited to, unwarranted approach, non-consenting touch, auditory threat (barking, shouting, etc.), and more.
iii) Animals that cannot be subdued will be properly contained by CLIENT for duration of the appointment.
iv) Children that cannot be controlled will not be on premises for the duration of the appointment.
C) CLIENT agrees to provide a safe space for service professional(s), with the following understandings:
i) Excessive volume will not be tolerated. This includes, but is not limited to: yelling, power tools, electronic sounds, animal noises such as barking, or any other persistent loud sound.
ii) Severe pest infestation will not be tolerated. This includes, but is not limited to: infestation of insects, infestation of rodents, infestation of larger mammals, or excessive dead carcasses of insects, rodents, or other animals. Exceptions can be made to excessive dead carcasses if third-party extermination records are provided and verified.
iii) Service professional(s) who experience any perceived threat are entitled to discontinue service and leave immediately.
Waiver of Liability.
By providing signature associated with this form you agree to the following Waiver of Liability: Except as otherwise provided herein or in any agreement entered into with Megan Tucker, Monarch Cleaning, LLC, and/or any of its Subsidiaries and to the maximum extent permitted by the Act, no present or former worker, Manager or officer of the Company, nor any such Person’s Affiliates, officers, directors, employees, agents, lawyers, accountants or representatives, shall be liable to the client or any Business they represent for any act or omission performed or omitted by such Person in its capacity as worker, Manager or officer; provided that, except as otherwise provided herein, such limitation of liability shall not apply to the extent the act or omission was attributable to such Person’s willful misconduct or knowing violation of law as determined by a final judgment, order or decree of an arbitrator or a court of competent jurisdiction (which is not appealable or with respect to which the time for appeal therefrom has expired and no appeal has been perfected); and provided further that, such limitation of liability will not apply to any claims Members may have under United States securities laws or the rules and regulations thereunder with respect to the Manager’s or the Company’s compliance with any such United States securities laws or the rules and regulations thereunder. All parties shall be entitled to rely upon the advice of legal counsel, independent public accountants and other experts, including financial advisors, and any act of or failure to act by such person in good faith reliance on such advice shall in no event subject such Person or any of such Person’s Affiliates, employees, officers, directors, agents, lawyers, accountants or representatives to liability to the client or any Business they represent. This waiver of liability shall be extended to act which negatively impacts personal belongings, property, or pets, given that the acts and events are accidental and that reasonable care has been taken to prevent issues. This waiver of liability shall include any spaces at any properties discussed for the inital service booking as well as any spaces, properties, or personal belongings which are later serviced as part of future verbal or written agreements.
