"The Kaplan for Doctors Without Borders Challenge" 2011 Official Rules
1. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED, TAXED OR OTHERWISE RESTRICTED BY LAW.
2. SWEEPSTAKES PERIOD: "The Kaplan for Doctors Without Borders Challenge" (otherwise known as the “Sweepstakes") commences at 6:59 A.M. EST on January 1, 2011 and ends at 11:59 P.M. EST on March 31, 2011 (the “Sweepstakes Period”). Completed official entry forms deposited at any of Kaplan's centers or Kaplan on-campus sites must be deposited by the close of business on March 31, 2011. Visit the Kaplan website at www.kaptest.com/challenge for a list of participating Kaplan centers and on-campus sites. Mail-in entries must be postmarked by March 31, 2011 and received by April 7, 2011 and online entries must be sent electronically during the Sweepstakes Period by March 31, 2011.
3. ELIGIBILITY: This Sweepstakes is open to legal residents of the 50 United States and the District of Columbia, Puerto Rico, and Canada (excluding the Province of Quebec), otherwise known as the “Eligible Jurisdictions,” who are eighteen (18) years of age or older as of the date of entry. Entrants must be present in one of the Eligible Jurisdictions at the time they enter the Sweepstakes. Officers, directors, representatives and employees of Kaplan, Inc. ("Sponsor"), its parent, affiliates or subsidiaries, or their respective advertising, promotion, publicity, production, and judging agencies (“Sponsor and its agents”) and their immediate families and household members and the persons with whom they are domiciled are not eligible to enter or win.
4. TO ENTER: There are 4 ways to enter the sweepstakes.
A. In Person: To enter, simply pick up an official entry form at any participating Kaplan on-campus site or Kaplan center in the United States, Puerto Rico, or Canada (excluding the Province of Quebec) during the Sweepstakes Period, while supplies last, and either drop off the completed entry form at a participating Kaplan on-campus site or Kaplan center. Completed official entry forms deposited at any of Kaplan's centers or Kaplan on-campus sites must be deposited by the close of business on March 31, 2011 (or)
B. By Mail: Mail your completed entry form with first class postage to: Attn: The Kaplan for Doctors Without Borders Challenge, Kaplan, 395 Hudson Street, New York, New York 10014. . You may also enter by hand-printing on a 3" x 5" postcard all of the information listed above and mailing the postcard with first class postage affixed to: Attn: The Kaplan for Doctors Without Borders Challenge, Kaplan, 395 Hudson Street, New York, New York 10014. Mail-in entries must be postmarked by March 31, 2011 and received by April 7, 2011 (or)
C. By Website: You can also enter online by visiting the Kaplan website at www.kaptest.com/challenge and following the instructions to complete and submit an official entry form. As part of your entry, you will be asked to provide your first and last name, email address, address and phone number, your school, the year that you will graduate, and any graduate school entrance exams (or licensing exam) you plan to take. All entries must be entered by March 31, 2011.
D. By SMS: If you are a wireless service subscriber and have a text messaging capable device, to enter the drawing text "CHALLENGE", a text message, to the short code "30364". You will be charged standard text and data rates for each text message sent or received from your handset according to the Terms and Conditions of your Service Agreement with your wireless carrier. Each wireless carrier's rate plan may vary, and entrants should contact their wireless carrier for information on messaging rate plans and charges relating to your participation in this Sweepstakes. Any text message form of entry into this Sweepstakes will be required to supply email address, test of interest, zip code and graduation year.
LIMIT ONE ENTRY PER PERSON AND EMAIL ADDRESS. Multiple entries will be disqualified. Entries are void if they contain typographical, printing or other errors. Entries generated by a script, macro or other automated means are void. Entries that are mutilated, altered, incomplete, mechanically reproduced, tampered with, illegible, inaccurate, forged, irregular in any way, or otherwise not in compliance with these Official Rules are also void. All entries become the property of the Sponsor and will not be returned to the entrant. Sponsor and its agents will not be responsible for lost, late, illegible, incomplete, misdirected, postage due, or damaged entries, mail or email or for Internet, network, computer hardware and software, phone or other technical errors, malfunctions and delays that may occur or for any other problems related to web site entries. In the event of a dispute regarding the identity of the person submitting an online entry, the entry will be deemed to have been submitted by the authorized account holder of the email account from which the entry is made. The authorized account holder is the natural person to whom an email address is assigned by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) responsible for assigning email addresses for the domain associated with the submitted email address.
By entering or accepting a prize in this Sweepstakes, entrants agree to be bound by the decisions of the judges, the Sponsor and these Official Rules and to comply with all applicable federal, state, provincial, and local laws and regulations.
5. WINNER SELECTION: Ten entrants will be selected from all eligible entries received in a random drawing to be held at 3:00 p.m. EST on or about April 30, 2011. The drawing will be conducted by Sponsor or its designee, whose decisions shall be final and binding in all regards. Participants need not be present to win. Please note that if the entrant selected as the winner resides in Canada, he/she will have to correctly answer a timed, test-prep question from an official admissions or licensing exam in order to be confirmed as the winner and claim the prize.
6. WINNER NOTIFICATION AND VALIDATION: The entrants selected in the drawing will be notified by certified mail return receipt requested approximately 10 days after the drawing. An Affidavit of Eligibility and Compliance with these Official Rules and a Liability and (unless prohibited) Publicity Release must be executed and returned by the selected entrant within thirty (30) days after prize notification is received at entrant's mailing address. Failure to complete, sign and return any requested documents within such period, or to correctly answer the test-prep question, if applicable, or the return of any prize notification or prize as undeliverable may result in disqualification and selection of an alternate winner in Sponsor's sole discretion. The selected entrant will not be confirmed as the winner of the prize unless and until his or her submissions are received and validated by Sponsor.
7. PRIZE: Ten Winners will each receive a $500 gift card for textbook rental redemption at Chegg.com. Gift card may only be redeemed for available textbooks on Chegg.com. Odds of winning depend on the number of eligible entries received for this sweepstakes.
All federal, state, provincial and local taxes are the winner's sole responsibility. The prize may not be transferred. No prize substitutions allowed, except Sponsor reserves the right in its sole discretion to substitute prize with a prize of comparable value.
8. GENERAL CONDITIONS: By entering the Sweepstakes and/or accepting the Sweepstakes prize, entrants: (a) accept all the conditions, restrictions, requirements and/or regulations required by the Sponsor in connection with the Sweepstakes including, without limitation, these Official Rules; (b) agree to release and hold harmless the Sponsor and its agents and successors from any and all claims, damages, injury, death, loss or other liability that may arise from entrant's participation in the Sweepstakes or the awarding, acceptance, possession, use or misuse of the prize, (c) agree to be contacted by Sponsor or its partners or affiliates by email, mail and/or telephone regarding this Sweepstakes or any of Sponsor's or its affiliates' products, services and promotions. Unless winner is a resident of TN or otherwise prohibited by law, acceptance of a prize constitutes permission to use winner's name, picture, likeness, address (city, state/province and country) and biographical information for advertising and publicity purposes in all media worldwide without prior approval or compensation. Acceptance of a prize constitutes a waiver of any claim to royalties, rights or remuneration for said use. Sponsor reserves the right in its sole discretion to modify, suspend or cancel all or any portions of the Sweepstakes because of technical errors or malfunctions, viruses, hackers, or for other reasons beyond Sponsor's control that impair or corrupt the Sweepstakes in any manner. In such event, Sponsor reserves the right to award prizes at random from among the eligible entries received up to the time of the impairment or corruption and/or received through uncorrupted methods of entry. Sponsor also reserves the right in its sole discretion to disqualify any entrant who fails to comply with these Official Rules, who attempts to enter the Sweepstakes in any manner or through any means other than as described in these Official Rules, or who attempts to disrupt the Sweepstakes or the kaptest.com website or to otherwise circumvent any of these Official Rules. This Sweepstakes is governed by the laws of New York, with venue in New York County. New York. All claims must be resolved in the state or federal courts of New York County, New York.
9. WINNERS’ LIST: Starting approximately April 30, 2011, a winners' list may be obtained by sending a self-addressed stamped envelope to: "The Kaplan for Doctors Without Borders Challenge, Kaplan, Inc., Marketing Department, 395 Hudson Street, New York, New York 10014. All winners' list requests must be received by May 31, 2011.
10. USE OF ENTRANT AND WINNER INFORMATION: The information that you provide in connection with the Sweepstakes may be used by Sponsor or its partners or affiliates to send you information about their products and services. If you would like your information removed from Sponsor's mailing list or if you do not wish to receive information from Sponsor or if you would like to be removed from Sponsor's mailings regarding sweepstakes, call 1-800-KAP-TEST, e-mail customer_care@kaplan.com, or write to Sponsor at Kaplan, Inc., Marketing Department, 1440 395 Hudson Street, New York, New York 10014. Sponsor will process your request within 60 days.
