  • Bicycle Indiana has issued the following position statement in support of a three-foot passing law. We are reaching out to Indiana's legislators to author/sponsor legislation in the upcoming session for a three-foot passing law. Your support and acknowledgment is critical to this effort.     Three Foot Passing Legislation

    Position Statement: We believe that bicyclists traveling on Indiana roadways face the risk of an accident that can result in injury or death when operators of motor vehicles pass too closely, even when bicyclists are riding as far to the right as practicable.

    Recommended Law: When overtaking and passing a bicycle proceeding in the same direction, a person operating a motor vehicle shall practice due care by leaving a safe distance between the motor vehicle and the bicycle of no less than three feet until the motor vehicle is safely past the bicycle.

    Legalize the practice of safe drivers to cross the double yellow centerline, when clear, to pass a bicycle.

    Recommended Penalty: (1) A person who violates this law shall be subject to a fine of one hundred dollars ($100). (2) A person who violates this law with the violation resulting in a collision causing death or serious physical injury to the person operating the overtaken bicycle shall be subject to a fine not to exceed one thousand dollars ($1000) in addition to any other penalties prescribed by law.
