TERMS AND CONDITIONS 2021
TMSA reserves the right to exclude anyone for any reason.
Booth locations may change from year to year.
The show reserves the right to relocate booths at its own discretion.
TMSA will attempt to limit relocations, however, if the need arises your cooperation is appreciated.
Vendors are not allowed to resell their booths at any time. TMSA reserves the right to reassign the booth spaces to our waiting list. Any indication of a resold booth will result in permanent termination from future TMSA Shows.
Applications are time-stamped as they are received. This timestamp determines the order in which booth spaces are assigned but has no bearing on who will be selected for the show.
Booth fees are due with the submission of your application. Applications will be reviewed on Tuesdays. Notifications will be sent out via email on Tuesday afternoons. If you are not accepted you will receive a refund in full.
YOU ARE RESPONSIBLE FOR YOUR OWN TENT, TENT ANCHORS, TABLES, CHAIRS, LIGHTS, EXTENSION CORDS, DISPLAY, ETC.
Vendors are only allowed to sell items that have been approved in the application process.
No vendor is allowed to give away food or beverages unless otherwise approved by the Red Fern Festival committee.
No Smoking within the Vendor Area. ( you can't smoke in your booth)
PLEASE READ THIS CAREFULLY!! Information changes from show to show, and current applicants are responsible for all current information enclosed.
SHOW INFORMATION: The show will be held on Friday & Saturday, September 10th & September 11th, 2021. The show opens to the public on Friday from 12:00 PM - 9:00 PM, Saturday from 9:00 AM - 8:00 PM. Set-up will begin Friday, September 10th at 6:00 AM. The teardown will be Saturday at 7:00 PM. THIS IS AN OUTDOOR FESTIVAL. FESTIVAL WILL BE HELD RAIN OR SHINE, but may be postponed or canceled due to COVID -19 restrictions.
REFUNDS: There will be no refunds once you are accepted to the show.
SECURITY: TMSA will offer overnight security Friday evening. Security Fees are included in the booth cost. You may leave your booth intact overnight. MERCHANDISE MAY BE LEFT OVERNIGHT AT YOUR OWN RISK. TMSA is not responsible for any damages or losses that may occur during the show.
ADVERTISING: Advertising for the show will occur in various online/print festival publications. In addition, TV and radio stations will be notified via multiple press releases. The festival is also advertised on the TMSA website and numerous local websites.
LOCATION: Downtown Tahlequah, Muskogee Ave., from Choctaw to Goingsnake. NORRIS PARK IS TOBACCO FREE, NO SMOKING INSIDE THE VENDING AREA.
SALES TAX: In accordance with state law, ALL VENDORS must include a copy of their State of Oklahoma sales tax permit. If you do not have an Oklahoma sales tax permit, you must sign a tax form that TMSA provides before you leave the festival.
LIABILITY WAIVER AND INDEMNIFICATION AGREEMENT
By submitting this form vendor agrees that they will be responsible for their own security during the Show, including set-up, tear-down, and regular show hours. Overnight security will be provided Friday night from 7:00 PM - 7:00 AM. In consideration for the opportunity to be a vendor at the Show, the vendor agrees to indemnify and hold harmless Tahlequah Main Street Association, Inc., the City of Tahlequah, Tahlequah Area Chamber of Commerce, its members, representatives, sponsors, and show venue from any damage or loss accruing to you, your agents, representatives, affiliates, business, sole proprietorship, organization or your property, which might occur during your participation at the Show.
Media Release: By submitting this form I consent to be photographed, interviewed, and/or videotaped by representatives of TMSA, and media outlets (newspaper, T.V. & radio stations, etc.). Any information or images obtained from those activities may be reproduced by TMSA, and/or the public media for use in advertising, publicity, or educational activities, including but not limited to websites, publications, videos, print, and television news. I hereby waive any claims I may have and release TMSA, and its representatives from liability of claims arising out of such activities.
