This Contract for Photography Services and Model Release (this "Agreement") is made between the above-referenced Client and Bridges Breeze LLC and Nick Bridges and/or Kristian Breeze (collectively, the "Photographers") relating to photography services provided by Photographer.

Upon execution of this Agreement described below, Photographer agrees to provide photography services for the Client according to the Photography Session provided to the Client (the “Photography Session”). 

1. Delivery

Photographs for standard portrait sessions will be delivered within a two to four week time frame unless otherwise stated. The client will receive at least the minimum number of edited digital images in the package selected. However, if there is something that prevents photographer from being able to achieve this delivery time frame, the photographer(s) will be sure to discuss this with the client. (Ex. illness, natural disasters.. etc.) Photographer(s) are not responsible for lost or stolen images following a photoshoot. If in the unfortunate case images are lost due to unforseeable circumstances (theft, SD card malfunction, system crashes, etc.) the photographer(s) will refund the client the amount paid to photographer(s), and the client will have the option to reschedule with the photographer(s).

 

2. Booking Fee and Reschedules

Booking fees are nonrefundable and secure your spot. Sessions begin at the scheduled time. Failure to arrive on time will be shooting time deducted from session. However, we understand life happens. Please communicate with us in order for us to try and accommodate.

Photographer(s) reserves the right to cancel the Photography Session due to unforeseen circumstances including, but not limited to: inclement weather, illness, emergency, or any other conditions which the Photographer deems may adversely affect the quality of the Photography Session. In the event Photographer cancels the scheduled session, the booking fee will be applied to a re-scheduled session that is agreed-upon by the parties. 

 

COVID-19 UPDATE

Unfortunately, we do still live in times of uncertainty in relation to the Covid-19 virus and its variants. Although photographer(s) have been fully vaccinated, it is the client's responsibility to communicate if the client is feeling unwell and has Covid-19 symptoms prior to a scheduled session so that a reschedule can be made. Photographer(s) are not responsible for a client contracting the Covid-19 virus following a photo session. The client fully acknowledges this risk.  Photographer(s) will also follow CDC guidelines in the case that restrictions of conducting photography with clients are placed. 

 

3. Client Galleries

Digital photographs will be delivered to the Client(s) in a password protected online client gallery. We offer the option to print from our website; however, we do grant the client permission to use external printing services. Clients will receive at least the number of images included in the package. No RAW or unedited images will be given. USB drive delivery is available upon special request. (USB may come with additional fee.) 

4. Client Cooperation

The Client will assist and cooperate with the Photographer in obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be photographed and taking time to pose for photographs at the Photographer’s direction. The Photographer(s) will not be responsible for photographs not taken as a result of the Client’s failure to provide reasonable cooperation and/or clear communication during or prior to the session. Example: If there are specific groupings or poses client is interested in, it is the client's responsibility to clearly communicate this during the session. If this session is for a minor, an accompanying adult must be present.

5. Copyright

The Client agrees that he or she has the authority to agree to the use of the likeness of all individuals to be photographed during the Photography Session. Client agrees and assigns the Photographer the irrevocable and unrestricted right to alter, use and publish all images taken during the Photography Session for advertising, display, publication, and all other marketing and/or educational purposes. The Client agrees to release all claims or right to any profit that may be generated for the use and publication of the same. The Client further agrees to indemnify and defend the Photographer for all claims, demands, or lawsuits made in relation to the Photographer’s use of the images as contemplated by this paragraph. The Photographer retains the exclusive copyright protection for all images taken during the Photography Session. The Client may not, without the express written permission of the Photographer, use the images taken during the Photography Session for professional display, profit, or other commercial endeavors. All images displayed on Photographer’s websites are subject to the protections of this paragraph. For all purchased images, the Photographer grants the Client permission to share the purchased images with family, friends, and on social networking websites so long as the images remain unaltered and textual credit as provided by the Photographer. Client's may feel free to share gallery from the session to friends and family. 

6. Our Brand

The client has reviewed the photographer’s portfolio prior to signing contract and understands the photographer’s editing and shooting styles. Please keep an open line of communication with photographer(s) for special requests or if you have any questions regarding this. We would love to be your photographer(s), but fully understand if we are just not the right fit. The client also agrees not to edit or alter final images. Cropping of imagery is okay for print and social media sharing purposes. Please ask photographer(s) for special requests. Special requests such as additional editing may come with a fee after the gallery is delivered. Unedited imagery will NOT be provided unless agreed by photographer(s) - this may come with special additional fee. 

Special Requests

If the photographer(s) feel it is in their best interest not to perform certain requests due to safety, or if the request goes against a law, the photographer(s) have the right to refuse the request. The photographer(s) will try their best to come up with an alternative solution to accomodate a client's request. 

7. Session Location and Time

The Photography Session will take place at the location and time agreed upon by the parties. Additional charges for travel time and travel-related expenses may be required in addition to package pricing. The assessment of such additional charges will be as agreed-upon by the parties in writing prior to the Photography Session. 

8. Release from Liability Related to Photography Session

Client acknowledges that modeling can, in some circumstances, be dangerous. The Client acknowledges that the Client and any minor children of the Client are not obligated to perform any act the Client deems dangerous or otherwise inappropriate. The Client agrees to let the Photographer know if the Client does not wish (or the Client’s minor children) to perform or participate in any act, including, but not limited to: the use of props or positioning in certain poses requested by the Photographer. While all reasonable precautions will be made to ensure the safety of any photography model, Client acknowledges that accidents may occur. Client hereby agrees to indemnify and hold harmless the Photographer (including the Photographer’s employees, agents, or business associates), from any injuries, illnesses, damages, or other losses that may occur directly or indirectly as a result the Photography Session.
