The Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA) is a Federal law that establishes rights and responsibilities for uniformed Service members and their civilian employers. USERRA protects the job rights of individuals who voluntarily or involuntarily leave employment positions to perform service in the uniformed Services. In addition to time provided for the service itself, an employee must have enough time after leaving the employment position to travel safely to the uniformed service site and arrive fit to perform the service; time should be provided for the employee to return from service, as well.
USERRA does not specify how far in advance notice must be given to the employer though an employee should provide notice as far in advance as is reasonable under the circumstances. Employers may ask for military orders/documentation to support the leave, but military orders/documentation are not required for a leave to be approved. In accordance with the Act, The Larkin Company will ask for but not require advance notice and supporting documentation.
