L-CAT Responders act on behalf of local authorities and emergency services. Because of the nature of the work for which you are applying, this post is NOT protected by the Rehabilitation of Offenders Act 1974. You are therefore required to disclose information about ALL convictions (whether spent or unspent), cautions, reprimands and final warnings, no matter when they occurred, or if they led to a conditional discharge. Failure to disclose all previous convictions (whether spent or unspent), cautions, reprimands and final warnings, will result in your application being unsuccessful. All information will be treated in confidence and will only be taken into account when absolutely necessary.
I declare that the information given on this form is true and complete to the best of my knowledge and belief. I understand that if I am subsequently appointed, any of the following will render me liable to disciplinary action which may include dismissal: (i) any false statement, (ii) failure to disclose medical information, (iii) failure to disclose any criminal convictions where required to do so, (iv) failure to disclose relationship to, or canvassing of, a person holding a position of authority in the organisation.
This Nondisclosure Agreement (the "Agreement") is entered into by and between Lincolnshire Community Assistance Team (L-CAT) ("Disclosing Party") and (" Receiving Party ") for the purpose of preventing the unauthorized disclosure of Confidential Information as defined below. The parties agree to enter into a confidential relationship with respect to the disclosure of certain proprietary and confidential information ("Confidential Information").
1. Definition of Confidential Information .
For purposes of this Agreement, "Confidential Information" shall include all information or material that has or could have commercial value or other utility in the business in which Disclosing Party is engaged. If Confidential Information is in written form, the Disclosing Party shall label or stamp the materials with the word "Confidential" or some similar warning. If Confidential Information is transmitted orally, the Disclosing Party shall promptly provide a writ ing indicating that such oral communication constituted Confidential Information.
2. Exclusions from Confidential Information .
Receiving Party's obligations under this Agreement do not extend to information that is: (a) publicly known at the time of disclo sure or subsequently becomes publicly known through no fault of the Receiving Party; (b) discovered or created by the Receiving Party before disclosure by Disclosing Party; (c) learned by the Receiving Party through legitimate means other than from the Dis closing Party or Disclosing Party's representatives; or (d) is disclosed by Receiving Party with Disclosing Party's prior written approval.
3. Obligations of Receiving Party Information in strictest .
Receiving Party shall hold and maintain the Confidential confidence for the sole and exclusive benefit of the Disclosing Party. Receiving Party shall carefully restrict access to Confidential Information to employees, contractors and third parties as is reasonably required and shall require those persons to sig n nondisclosure restrictions at least as protective as those in this Agreement. Receiving Party shall not, without prior written approval of Disclosing Party, use for Receiving Party's own benefit, publish, copy, or otherwise disclose to others, or permit the use by others for their benefit or to the detriment of Disclosing Party, any Confidential Information. Receiving Party shall return to Disclosing Party any and all records, notes, and other written, printed, or tangible materials in its possession pert Information immediately if Disclosing Party requests it in writing.
4. Time Periods pertaining to Confidential.
The nondisclosure provisions of this Agreement shall survive the termination of this Agreement and Receiving Party's duty to hold Confidential Information in confidence shall remain in ccurs first. effect until the Confidential Information no longer qualifies as a trade secret or until Disclosing Party sends Receiving Party written notice releasing Receiving Party from this Agreement, whichever o
Nothing contained in this Agreement shall be deemed to constitute either party a partner, joint venturer or employee of the other party for any purpose.
If a court finds any provision of this Agreement inval id or unenforceable, the remainder of this Agreement shall be interpreted so as best to effect the intent of the parties.
This Agreement expresses the complete understanding of the parties with respect to the subject matter and supersedes all prior proposals, agreements, representations and understandings. This Agreement may not be amended except in a writing signed by both parties.
8. Waiver. The failure to exercise any right provided in this Agreement shall not be a waiver of prior or subsequent rights. This Agreement and each party's obligations shall be binding on the representatives, assigns and successors of such party. Each party has signed this Agreement through its authorized representative.
I, the undersigned do hereby agree not to use social media such as blogs, wikis, social networking websites, podcasts, forums, message boards, or comments on web-articles, such as Twitter, Facebook, LinkedIn, forums, to air any personal problems or vengeances against members current or past as well as any response group or any partner to L-CAT. I also agree to not act in a way that will bring L-CAT, its work or members any negative attention or negative advertising. I agree to respect L-CAT and its code of conduct and to behave in a professional manner when representing L-CAT. I acknowledge receipt of the L-CAT social media policy.
The following statement is issued in pursuance of the Health and Safety at Work Act 1974 and associated legislation.
1. The policy is the direct concern of all employees, members and other persons using or visiting L-CAT premises as relevant.
2. The policy is regard to Health, safety and welfare of all employees and other persons using L-CAT premises as a paramount of importance.
3. L-CAT have responsibilities under the Act so far as is reasonably practicable to:
a) Promote standards of occupational health , safety and welfare which comply with the Health and Safety at Work etc, Act 1974 and all other relevant statutory provisions; European Community Directives and Approved Codes of Practice;
b) Provide and maintain a working environment which is safe and without risks to health, including safe means of access and egress;
c) Ensure that premises, plant, equipment and systems of work are safe and without risks to health;
d) Develop safety and welfare awareness amongst employees, members and other persons using or visiting L-CAT premises as relevant and individual safety responsibility at all levels, through information, instruction, training and supervision, to ensure their health and safety at work;
e) Ensure that there are suitable arrangements for the safe handling and storage and transport of articles and substances;
f) Encourage full and effective joint consultation on occupational health, safety and welfare matters;
g) Work closely with Safety Representatives, to promote and achieve a workplace that is safe and without risks.
4. L-CAT are responsible for the implementation and monitoring of the policies.
5. Employees and other persons visiting or using L-CAT premises have a duty under the Act to take reasonable care for the health and safety of themselves and of other persons who may be affected by their acts or omissions at work;
Each such person is required:
a) To comply with instructions and guidelines issued for their safety and to adhere to correct procedures;
b) To co-operate with L-CAT in carrying out their own duties and responsibilities under the Act or relevant statutory provisions.
c) To work safely and efficiently;
d) To use the approved protective clothing and equipment;
e) To report any defect in any machine, accessory, or electric cabling;
f) To report any hazard or near miss promptly;
g) To report all accidents promptly.
6. The statement of policy of Health, Safety and Welfare at Work will be monitored and reviewed regularly by L-CAT health and safety Committee.
