GDPR Consent Form for Personal Photography

A. What are you consenting to?

This is not legally binding or obligation, but to remain GDPR compliant, Celphyking Studios believe, it needs to inform and take necessary consent for the photography, editing, storage, communication, share and rights of the media. This consent form is for a friendly and social gathering photoshoot. The client has not agreed to pay the photographer any retainer for this social photo session. Additional prints or digital images may be available for purchase.

 

B. Location Costs & Fees

As this is a social gathering in which Tarak Nath Gorai, the hobbyist photographer of Celphyking Studios, will be taking his own and his friend's photos. He will glad to take any photo of attending guests at the social gathering within the limitation and time. There is no cost & fees associated with the photography and distribution of digital copies. While you are encouraged to donate towards his professional gear and cost of upkeep of the superb service.

 

C. Data Archive

All images will be stored at various Celphyking’s hard-drive/ cloud-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. The photographer is not responsible for loss or damage to the digital files due to circumstances beyond the photographer’s control. The photos are edited as the post-production of the photos deem necessary.

 

D. Third-Party Services

To edit the photos, various online and SAS based third-party software are used, who may, in turn, save, archive, process the images. You understand that Celphyking Studios take utmost care to safeguard your photos/images, but various third-party software may have their vulnerability, and Celphyking Studios cannot take liability for the data loss, steak, hack, breach of the same.

 

E. Purchase of Print Copies

You are free to purchase print copies, albums, canvas prints from the Celphyking website. Such prints are supplied by external suppliers, and Celphyking does receive an affiliate commission. All deliveries and print quality need to be dealt with the ordering companies. Tarak can attempt to help facilitate support.

  

F. Model Release

I hereby give to Celphyking Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:

 a) To copyright the same in the photographer’s name or any other name that he/she may select;

 b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and;

I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.

 

G. Liability

The photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. 

 

H. Copyright & Penalty:

Celphyking Studios | A Tarak Nath Gorai Photography retains all copyrights to all images created during client’s session. A digital release will be included with digital files to print portraits for personal use up to designated size listed on print release.

 

I: Your Terms of Use:

The digital release does allows you the publication right of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission.

You are allowed to copy, scan, download, print, share, alter, or otherwise share any image created by Celphyking Studio | A Tarak Nath Gorai Photography during/after client’s photo session.

This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook ( any other social media), or hard copy images. 

 

J: Social Share:

You consent Celphyking Studios to freely share any photos on their website, social pages and or future promotional material. If there are any special photos that you do not want to be shared, please feel free to contact me and all effort will be made to honour your request.

As this is a social gathering photo, all photos from a single related event will be shared as a single album/collection/gallery, with the photos of the event/day/category together. There may be photos of other attending guests, or their friends and socials connect who can also access the photo folder. Tarak Nath Gorai, of Celphyking Studios, cannot control who share who's photo where. It's left to the individual judgement and collective common sense. If your photo is shared or appears on another guest's social pages or elsewhere, you need to directly contact the person who shared.

 

K: Consent to retain personal details 

You consent Celphyking Studios to capture, retain and use your contact details for effective future communication of the distribution of images, communication and other related matters. The contact may be retained indefinitely as most likely you are also socially connected with Tarak Nath Gorai or his family or common friends and the contact details may be of social in nature.

 

L: Note from photographer:

I work very hard to create images that reflect you and your family while keeping in line with my artistic vision and creativity. I know you will want to share them and include a sneak-peek for that very reason. However, I ask that you simply link back to my blog/website/Facebook page instead of right-clicking, saving, and sharing the image via your own page.

I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you. Please do share and enjoy the photos and proudly attribute them in whatever means best possible.
