We assure you that all personal information shared orally and/or in writing will be managed with ethical and legal considerations.     We may disclose the following personal information to financial service providers (such as companies providing home mortgages), Federal, State, and nonprofit partners for program review, monitoring, auditing, research, and/or oversight purposes, and/or any other pre-authorized individual and/or organization.  The types of information we disclose are as follows: 
    - Information you provide on applications/forms or other forms of communication.  This information may include your name, address, Social Security Number, employer, occupation, account numbers, assets, expenses, and income. 
    - Information about your transactions with us, our affiliates, or others; such as your account balance, monthly payment, payment history, and method of payment. 
    - Information we receive from a consumer credit reporting agency; such as your credit bureau reports, your credit and payment history, your credit scores, and/or your creditworthiness. 
    - We do not sell or rent your personal information to any outside entity. 
    - We may share anonymous, aggregated case file information; but this information may not be disclosed in a manner that would personally identify you in any way. This is done in order to evaluate our program, gather valuable research information, and/or design future programs. 
    - We may also disclose personal information about you to third parties as permitted by law. 
     
    How is your personal information secured? 
    We restrict access to your nonpublic personal information to HOPE employees who need to know that information in order to perform their housing counseling duties.  We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information; and we train our staff to safeguard client information and prevent unauthorized access, disclosure, or use. 
     
    Opting Out of Certain Disclosures 
    You may direct HOPE to not disclose your nonpublic personal information to third parties (other than disclosures made to project partners and those permitted by law). However, if you choose to opt out, we will not be able to answer any questions from your creditors, which may limit HOPE's ability to provide services such as foreclosure prevention counseling. If you choose to opt-out, please sign below under the “Opt-Out” clause.  If you choose to release your information as stipulated in this Privacy Policy, sign under the “Release” clause.   • About Us and Program Purpose: HOPE of Evansville, Inc. (HOPE) is a nonprofit, HUD-approved comprehensive housing counseling agency. We provide education workshops and a full spectrum of housing counseling including pre-purchase, foreclosure prevention, and financial empowerment. We serve all clients regardless of income, race, color, religion/creed, sex, national origin, age, family status, disability, sexual orientation, or gender identity. We administer our programs in conformity with local, state, and federal anti- discrimination laws, including the federal Fair Housing Act (42 USC 3600, et seq.). As a housing counseling program participant, please affirm your roles and responsibilities along with the following disclosures and initial, sign, and date below
     
     

    Counselor’s Roles and Responsibilities 
    - Reviewing your housing goal and your finances; which include your income, debts, assets, and credit history. 
    - Preparing a Client Action Plan that lists the steps that you and your counselor will take in order to achieve your housing goal. 
    - Preparing a household budget that will help you manage your debt, expenses, and savings. 
    - Your counselor is not responsible for achieving your housing goal, but will provide guidance and education in support of your goal. 
    - Neither your counselor nor HOPE employees, agents, or directors may provide legal advice. 
    Client’s Roles and Responsibilities 
    - Completing the steps assigned to you in your Client Action Plan. 
    Providing accurate information about your income, debts, expenses, credit, and employment. 
    - Attending meetings, returning calls, providing requested paperwork in a timely manner. 
    - Notifying HOPE or your counselor when changing housing goal. 
    - Attending educational workshop(s) (i.e. pre-purchase counseling workshop) as recommended. 
    - Retaining an attorney if seeking legal advice and/or representation in matters such as foreclosure or bankruptcy protection. 

     
    Termination of Services: Failure to work cooperatively with your housing counselor and/or HOPE will result in the discontinuation of counseling services. This includes, but is not limited to, missing three consecutive appointments. 
     
     Agency Conduct: No HOPE employee, officer, director, contractor, volunteer, or agent shall undertake any action that might result in, or create the appearance of, administering counseling operations for personal or private gain, provide preferential treatment for any person or organization, or engage in conduct that will compromise our agency’s compliance with federal regulations and our commitment to serving the best interests of our clients. 

    Agency Relationships: HOPE has financial affiliation (if funded by HUD) or professional affiliations (if not funded by HUD) with HUD, Housing Action Illinois, the State of Indiana, Vanderburgh County, City of Evansville, and banks including Old National Bank and Fifth Third Bank. As a housing counseling program participant, you are not obligated to use the products and services of HOPE or our industry partners. 

    Alternative Services, Programs, and Products & Client Freedom of Choice: HOPE has a first-time homebuyer program developed in partnership with the City of Evansville. However, you are not obligated to participate in this or other HOPE programs and services while you are receiving housing counseling from our agency. You may consider seeking alternative products and services from entities including the Federal Housing Authority (FHA) for first-time homebuyer loan programs, and Community Action Program of Evansville or the Indiana Housing & Community Development Authority for other first-time homebuyer programs. You are entitled to choose whatever real estate professionals, lenders, and lending products that best meet your needs. 

    Referrals and Community Resources: You will be provided a community resource list which outlines the county and regional services available to meet a variety of needs, including utilities assistance, emergency shelter, transitional housing, food banks, and legal aid assistance. This list also identifies alternative agencies that provide services, programs, or products identical to those offered by HOPE and its exclusive partners and affiliates. 

    Privacy Policy: I/we acknowledge that I/we received a copy of HOPE's Privacy Policy. 

    Errors and Omissions and Disclaimer of Liability: I/we agree HOPE, its employees, agents, and directors are not liable for any claims and causes of action arising from errors or omissions by such parties, or related to my participation in HOPE counseling; and I hereby release and waive all claims of action against HOPE and its affiliates. I have read this document, understand that I have given up substantial rights by signing it, and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law. If any provision of this document is unenforceable, it shall be modified to the extent necessary to make the provision valid and binding, and the remainder of this document shall remain enforceable to the full extent allowed by law. 
     
    Quality Assurance: In order to assess client satisfaction and in compliance with grant funding requirements, HOPE, or one of its partners, may contact you during or after the completion of your housing counseling service. You may be requested to complete a survey asking you to evaluate your client experience. Your survey data may be confidentially shared with HOPE grantors such as HUD, Housing Action Illinois, State of Indiana, Vanderburgh County, or City of Evansville.

  • Down Payment Assistance Program Guidelines

  • Following are general guidelines concerning HOPE’s homebuyer assistance program. This is not necessarily a complete list of rules and regulations but highlights the most important ones for this program. The following abbreviations and definitions apply:

     

    HOPE –refers to the agency, HOPE of Evansville, Inc.

    Assistance –refers to down payment and/or closing cost assistance provided by HOPE

    Clients – refers to applicants or potential homebuyers using HOPE’s Assistance

    Program – refers to HOPE’s homebuyer education and financial Assistance program

                                                   

    1.     INCOME. Clients must meet Program income eligibility guidelines as published by HUD on an annual basis and provided to Clients with their initial application. All income and assets from all household members must be verified by HOPE through third party documentation.

     

    2.     FIRST-TIME HOMEBUYER. Clients must be first-time homebuyers. Some exceptions include divorcees, owners of manufactured homes, and previous homes owned more than 3 years ago.

     

    3.     MORTGAGE AND TERMS. Clients must qualify for and obtain an acceptable mortgage with a lender of their choice as long as that lender does not charge excessive fees, high and/or variable interest rates, balloon payments, or extraneous fees. The monthly payment including principal, interest, taxes, homeowner’s insurance, and private mortgage insurance cannot exceed 30% of the buyer’s monthly gross income. Prior to closing, Clients must provide verification of homeowner’s insurance listing the City of Evansville Department of Metropolitan Development (DMD) as a second mortgage holder.

     

    4.     NEED FOR ASSISTANCE. Clients must have an assessed need for Assistance in order to qualify for HOPE’s financial Assistance Program. Need will be determined by HOPE staff, based on established parameters reported to the Department of Metropolitan Development annually.

     

    5.     PURCHASE CONTRIBUTION. Clients must contribute toward their home purchase, which will be matched as needed by HOPE to a maximum of $10,000 for homes with a sales price below $150,000 or $15,000 for homes with a sales price above $150,000. Clients are required to contribute a minimum of $1,000. If a need for Assistance is confirmed, the minimum down payment assistance provided is $1,000. Both the Client’s and HOPE’s funds can be used for down payment and/or closing costs and may not be adequate to cover the total purchase costs. Clients cannot receive cash back at closing.

     

    6.     WHOLE HOUSE AND PEST INSPECTION. A whole house and pest inspection is required. All defects and/or safety items noted on the inspection report must be repaired or resolved by the property Seller at the Seller’s expense, followed by a satisfactory re-inspection, prior to closing. (See Guideline #16 for additional information regarding inspections.)

     

    7.     LEAD BASED PAINT INSPECTION. If the house was constructed before 1979, a Visual Assessment must be completed on all painted surfaces. If deteriorated paint is found, appropriate action must be taken to stabilize each deteriorated paint surface using acceptable lead-safe work practices. At the Visual Assessment stage, Clients have the option of requesting a professional test for lead at their expense. If the Visual Assessment shows no deterioration of a painted surface, Clients can sign a waiver stating they are aware of the potential presence of lead paint and choose not to address it.

     

    8.     COURSE COMPLETION. HOPE’s “Live the Dream” course or the online “Framework” course must be successfully completed by the Clients to become eligible for Assistance, however course completion does not guarantee Assistance. HOPE charges a $80 fee for the “Live the Dream” course and $75 for the online “Framework” course. Refunds of this fee are not given should the Clients fail to qualify for and/or receive Assistance.

     

    9.     EVANSVILLE PROPERTIES. Only properties purchased within the City limits of Evansville are eligible for Assistance through HOPE. By signing this form, you are agreeing it is your responsibility and not the responsibility of HOPE or its employees to determine if the property you are purchasing is within the City limits of Evansville.

     

    10.  HISTORIC REVIEW. This review is conducted by DMD and must be completed prior to purchase and prior to any repair work done on the property.

     

    11.  PURCHASE LIMIT. Sales price cannot exceed 95% of the area median purchase price. In 2023, the maximum purchase price is $174,000 for an existing home and $255,000 for a new home.

     

    12.  CONTINGENCY ADDENDUM. HOPE requires the completion of a Contingency Addendum with the executed Purchase Agreement. Clients should receive confirmation of their Program eligibility prior to signing any Purchase Agreement. If Clients execute a Purchase Agreement prior to receiving eligibility confirmation, they understand they are doing so at their own risk and possible expense.

     

    13.  REPAYMENT REQUIREMENT. Any grant Assistance provided by HOPE to the Clients is contingent upon the Clients living in the property as their primary residence for during an affordability period and not selling the property or re-financing their mortgage within that period. If the Assistance provided is less than $15,000 the affordability period is 5 years. If the Assistance provided is $15,000 the affordability period is 10 years. No payments are required during this period, however failure to adhere to those restrictions could result in a partial or total repayment of the Assistance amount. The Assistance loan will be due and repayable upon the sale and transfer of title before the end of loan term’s affordability period. The loan is forgiven at 20% per year for 5 year affordability periods and 10% per year for 10 year affordability periods. A deed restriction must be signed by the buyer and recorded by the County Recorder. 

     

    14.  FREEDOM OF CHOICE. Clients understand they are free to choose lenders, loan products, and homes regardless of any recommendations that may be given by any representative of HOPE or any partner of HOPE. While affordable homes, lending products, and/or purchase Assistance grants may be offered by HOPE or by partners of HOPE, Clients understand and acknowledge they are under no obligation to use any of these programs or services.

     

    15.  AVAILABILITY OF FUNDS.  Assistance grants are dependent upon the availability of HUD funds to HOPE. These funds are not guaranteed to any applicant or Clients of the Program.

     

    16.  MAJOR SYSTEMS.  HOPE requires Clients determine the age and condition of the home’s major systems prior to making an offer to purchase. A 5-year life expectancy rule will be applied to all major systems, which is defined as HVAC, Plumbing, Electrical, Roof, Foundation, and Walls. If a whole house inspection reveals problems or questions with major systems and recommends “Monitor” on the report, a follow-up inspection and report may be required by DMD from a professional in that field to determine the life expectancy. Permits may be required depending the on the repair or replacement that is needed. If it is determined the life expectancy is less than 5 years, a replacement will be required by DMD.

     

    17.  INSURANCE & RESIDENCY VERIFICATION. HOPE will conduct an annual review to determine whether or not the Clients maintain homeowners’ insurance and whether or not the Clients' house remains the Clients' primary residence. HOPE will send the Clients a letter in the mail asking for verification (i.e. signed affidavit of residency and proof of insurance) once per year on the anniversary date of the Clients' closing. These forms of verification must be completed and returned to HOPE.

(hereinafter referred to “HOPE”) to obtain and review my credit report through a credit reporting agency chosen by HOPE. I understand and agree that HOPE intends to use the credit report for the purposes of evaluating my financial readiness to purchase a home. 
     
    My signature below also authorizes the release to credit reporting agencies of financial or other information that I have supplied to HOPE in connection with such evaluation. Authorization is further granted to the credit reporting agency to use a copy of this form to obtain any information the credit reporting agency deems necessary to complete my credit report. 
     
    In addition, in connection with determining my ability to obtain a loan, I authorize HOPE to share with potential mortgage lenders and/or counseling agencies my credit report and any information that I have provided, including any computation and assessments that may have been produced based upon such information. These lenders may contact me to discuss loans for which I may be eligible, and these counseling agencies may contact me to discuss counseling services. Furthermore, I understand that should I choose to apply for mortgage financing through HOPE, a revised credit report may be required. Additional credit reports may result in additional fees charged to me.
