    (Hereafter referred to as the “Landlord”)

  • (Hereafter referred to as the “Housemate”)

     


    In regards to the house located at:

    7019 Wyoma Trail

    Spring, TX 77379

    (Hereafter referred to as the “Property”)


    1. LEASE Agreement:

    This is a Lease Agreement (the “Agreement”) between the above-named Landlord and Housemate for the above-named Property. This Agreement outlines the rights and responsibilities for the Housemate and Landlord.

  • 3. PAYMENT Schedule and Details

  • Payment shall be made to Jeffrey Gill or before the 1st of each month during the entire length of this Agreement. The rent includes utilities such as electricity, water, gas, trash service, yard maintenance, Homeowners’ Association Dues, and high-speed internet.

    Should the Housemate’s payment be returned for insufficient funds, the Housemate shall be liable to the Landlord for $50.00 as a penalty. Should the Housemate’s payment be five (5) or more days late, the Housemate shall be liable to the Landlord for, in addition to rent due, $20.00 per day as a penalty starting from the 1st of the month. After the 10th day of no payment Landlord may at their discretion, terminate the lease Agreement.

    4. EARLY TERMINATION of the Tenancy:

    If the Housemate elects to leave before the end of the lease term as described in this Agreement, it is not the Housemate’s responsibility to find a replacement. The departing Housemate will continue to be responsible for his/her rent payment until the end of the lease term or until a replacement Housemate approved in writing by the Landlord starts paying rent, whichever occurs first.

    The Landlord has the right to terminate the tenancy by providing the Housemates with 30 day notice.

    5. LIVING ARRANGEMENTS:

  • The bathrooms must remain neat and clean at all times. Housemate will have full access to all common areas including living/family room, dining room, breakfast nook, kitchen (including cabinets, appliances, and storage), laundry/utility room (including cabinets, appliances, and storage), common-area closets, back patio/yard, and community amenities such as Swimming Pool and Tennis Courts. The garage area will be available as an optional feature if selected above under paragraph one of this section of the Agreement.

    6. UTILITIES and Services:

    Utilities and services such as electricity, water, gas, trash service, and yard maintenance are included in the rent. 100% of these Utilities will be the responsibility of and be paid for by Jeffrey Gill.

    7. CLEANING and Household Chores:

    The Housemate and other Housemates will divide all household chores amongst themselves.

    Each Housemate will maintain common areas including the guest bathroom clean and orderly ensuring to pick up after themselves. Landlord will be responsible for “deep cleaning“ of common areas on occasions as necessary. Housemate will be notified of such deep cleaning prior to being done.

    8. RESPONSIBILITIES:

    The Housemate shall comply with all obligations required of tenants by applicable provisions of the building, house, and health codes, HOA, and other applicable authorities; maintain the Property in good condition during the entire length of this Agreement, and will neither cause nor allow any abuse of the facilities therein. 

    The Housemate will notify the Landlord of any condition that may create harm or cause damage to the Property. If the Property, or any part of the Property is partially damaged by fire or other casualty not due to the negligence or willful act of the Housemate or an agent of the Housemate, the Property will be immediately repaired by the Landlord and there will be an abatement of rent corresponding with the time during which the Property was untreatable. If timely repair is not feasible, at the sole discretion of the Landlord, this Agreement will terminate with no further obligations by either party . 

    Upon the termination or expiration of this Agreement the Housemates shall redeliver the Property, amenities, furniture, appliances and any other applicable aspects of the Property, in as good condition as at the commencement of the Agreement or as improved by Landlord during the Agreement. Reasonable wear and tear from use and obsolescence to the Property shall be accepted. Furthermore, the Landlord retains a Landlord Lien on all personal property placed upon the premises to secure the payment of rent and any damages to the House.

    9. PROPERTY RULES & Guidelines:

    The Housemate agrees that the Property shall be a non-smoking environment. No smoking is allowed anywhere within the property with the exception of  the back patio and yard..

    No drugs of any kind are allowed within the property, including the surrounding outside areas. If drug use is confirmed, the Landlord has the right to terminate the Agreement without providing notice.

    No pets are allowed in the property unless previously discussed and agreed with the Landlord and other Housemates.

    10. VISITORS of Housemate:

    No visitors may stay the night unless approved by Landlord.

    11. HOUSE ALTERATIONS:

    Housemate shall make no alterations, additions or improvements to the Property (including the application of paints, stains, nails or screws to the woodwork, walls, floors or furnishings) without first obtaining the expressed written consent of the Landlord.

    12. Governing Laws

    This Agreement shall be governed and construed in accordance with the laws of the State of Texas.

    The parties hereby indicate by their signatures below that they have read and agree with the terms and conditions of this Agreement in its entirety.
