    To qualify as a Castle Reseller you must meet the following criteria:

    • Have a retail store front and provide photographs of the store with application.
    • Initial order must be $500 or greater.
    • Provide a copy of tax exempt/resale license.
    • If an e-commerce mail-order business only, you must provide the location and proof of commercial warehouse or office space.

    To qualify as a Castle Distributor you must meet the following criteria:

    • Are an agent who supplies goods to stores and other businesses that sell to consumers.
    • Provide strong support to Castle's promotional efforts.
    • Must offer full line of Castle products to resellers and meet minimum initial stocking order requirements.

    • Minimum Advertised Price Policy 

    • Castle Creations requires its dealers to adhere to our Minimum Advertised Price policy. MAP for each applicable product is identified as per the current Castle Creations Dealer Price list. Dealers that are found to be in violation of this policy will be provided with one warning. If a dealer continues to advertise below MAP after the warning, the dealer may be canceled and all buying privileges revoked at Castle Creations sole discretion.

    • Terms and Conditions of Sale 

    • THE SALE OF PRODUCTS AND SERVICES ("PRODUCTS") BY CASTLE CREATIONS ARE SUBJECT TO THESE TERMS AND CONDITIONS (“AGREEMENT”) REGARDLESS OF OTHER OR ADDITIONAL TERMS OR CONDITIONS THAT CONFLICT OR CONTRADICT THIS AGREEMENT IN ANY PURCHASE ORDER, DOCUMENT, OR OTHER COMMUNICATION ("ORDER"). PREPRINTED TERMS AND CONDITIONS ON ANY CUSTOMER (“CUSTOMER”) DOCUMENT (FOR EXAMPLE: PURCHASE ORDERS OR CONFIRMATIONS) AND/OR CASTLE CREATIONS FAILURE TO OBJECT TO CONFLICTING OR ADDITIONAL TERMS WILL NOT CHANGE OR ADD TO THE TERMS OF THIS AGREEMENT.

    • 1. ORDERS. All Orders are subject to acceptance or cancellation by Castle Creations, in Castle Creations sole discretion. Each accepted order will be interpreted as a single Agreement, independent of any other orders. Payment for Products, Software and Services must be made by credit card, wire transfer, electronic funds transfer or some other prearranged payment method unless credit terms have been agreed to by Castle Creations Orders should be emailed to ccorders@castlecreations.com.

    • 2. PRICES. As published in Castle Creations most recent price list or provided to you via a formal quote. Prices are for Products or Services only and do not include taxes, impositions and any other charges, fees, shipping charges and duties imposed by any government authority. Customer is responsible for any additional fees and taxes.

    • 3. TERMS OF PAYMENT. Payment of the total invoice amount, without offset or deduction, is due at the time the order is ready to be shipped. Terms are only offered on special conditions. Under these conditions, any past due invoice is subject to added interest from the payment due date to the date of payment (at 1 ½ % per month), plus reasonable attorney fees and collection costs. Castle Creations may change the terms of Customer’s credit at any time. Castle Creations may also apply payments to any of the Customer’s accounts.

    • 4. DELIVERY AND TITLE. Reseller is responsible for all shipping costs and any applicable surcharges. Title and risk of loss pass to Reseller upon delivery of the Products to the carrier. Castle Creations delivery dates are estimates only and Castle Creations is not liable for delays in delivery.

    • 5. PRODUCT RETURNS. Reseller cannot return Products without a return material authorization ("RMA") number obtained from Castle Creations and are subject to a 15% restocking fee if approved.

    • 6. CASTLE CREATIONS LIMITED WARRANTY. Subject to the limitations and conditions hereinafter set forth, CASTLE warrants, at the time of delivery by CASTLE, each product to be free from (i) defects in material or workmanship and (ii) defects in design that in view of the state-of-the-art as of the date of manufacture should have been foreseen; provided, however, that the defect must be discovered and reported within twelve (12) months of date of purchase for new parts. The entire extent of CASTLE'S liability shall be limited to reimbursing Buyer for its costs of purchasing a rebuilt, overhauled, repaired or serviceable product from CASTLE, or at CASTLE’S sole discretion, the actual repair of the product. If CASTLE elects not to repair the product and if no rebuilt, overhauled, repaired or serviceable product is, at CASTLE'S sole determination, timely available then CASTLE may provide an equivalent CASTLE product. The product to be replaced or repaired must in all instances be returned, shipping prepaid, to CASTLE, unless otherwise directed by CASTLE. CASTLE'S LIMITED WARRANTY will apply to any product repaired or replaced by a CASTLE pursuant to CASTLE'S LIMITED WARRANTY; however, the applicable warranty for such product repaired or replaced shall be limited to the unexpired portion of CASTLE'S LIMITED WARRANTY as applicable.

    • 7. LIMITATION OF LIABILITY. CASTLE will be relieved of all obligations and liability under this Warranty if: The alleged defect in the product is due to misuse or negligence on the product of someone other than CASTLE; or CASTLE identification mark or name or serial number has been removed from the product in question; or The product and/or related equipment or system have not been maintained, operated or stored either in accordance with applicable manuals, communications or other written instructions of CASTLE, or in accordance with applicable regulations; or The product has been modified or altered after delivery other than by CASTLE or in accordance with a modification or alteration scheme approved in writing by the CASTLE. In addition, any product affected by a modified or altered product and/or related equipment or system will not be covered by CASTLE’S Limited Warranty; or The product is used for purposes other than conventional usage. Usage not considered conventional includes, but is not limited to government and military operations.

    • 8. FORCES BEYOND CASTLE CREATIONS CONTROL. Castle Creations is not liable for failure to fulfill its obligations for any accepted Order or for delays in delivery due to causes beyond its reasonable control, (for example: acts of God, acts or omissions of the Customer, man-made or natural disasters, epidemic medical crises, materials shortages, strikes, acts of terrorism,delays in transportation, or inability to obtain labor or materials through its regular sources).

    • 9. USE OF PRODUCTS. Products are not authorized for use in critical safety or other applications where a failure may reasonably be expected to result in personal injury, loss of life, or catastrophic property damage. If Customer uses or sells the Products for use in any such applications, Customer acknowledges that such use or sale is at Customer’s sole risk. Customer will indemnify, defend and hold Castle Creations harmless from and against any and all liabilities and costs arising out of or in connection with such use or sale.
