Nada Sudha School of Music, LLC

Nada Sudha School of Music, LLC, (“Nada Sudha”) is an institution which teaches vocal lessons in the Carnatic style of music, which is a traditional/classical music originating from South India.

In consideration of receiving musical lessons at Nada Sudha I agree to the following terms and conditions.

1. I hereby consent/give consent for myself/minor child to attend and participate in Nada Sudha classes/events in the premises/facilities as may be determined by Nada Sudha.

2. I understand and agree that it is my responsibility to ensure that I am/my child is in reasonable health and condition to attend Nada Sudha classes/events. I am aware of the risks involved in participating in Nada Sudha classes, including those associated with the travel to, from and during the classes/programs/events of Nada Sudha at any private or public premises/ facilities, whether owned or rented by Nada Sudha. I understand and agree that I am assuming all risk of illness, injury, harm, negligence, or damages that I/my child may incur whether physical/ psychological (including death, paralysis and other serious illness or injury) as a result of attending/participating in classes/events at any of Nada Sudha premises whether those risks are known or unknown.

3. I hereby release, waive, discharge, and covenant not to sue Nada Sudha, its owners, officers, landlords, employees, instructors, volunteers, facilities and representatives from any claim, demand, negligence of any kind, liability, and cause of action of any kind (tort, contractual or otherwise) resulting from or related to my/my child’s participation in the classes/ programs/events offered by Nada Sudha at any public or private premises/facilities, whether owned or rented by Nada Sudha, which may occur in present or in future participation. I also agree to indemnify and hold Nada Sudha and its owners, officers, employees, instructors, landlords, volunteers, facilities and representatives harmless from any and all claims, actions, suits, procedures, legal costs, attorney fees, investigative costs, expenses, damages, and liabilities of any kind.

4. I understand and agree that I or any adult authorized by me is responsible to drop off and pick up my child to and from Nada Sudha class(es) at the specified times mutually agreed to by Nada Sudha’s instructor and me. I also agree that I am solely responsible at all times for my child during the time he/she is attending classes/events at Nada Sudha.

5. I understand that during classes the instructor will need to do what is reasonably necessary to ensure smooth conduct of the classes. I represent and warrant that I will follow Nada Sudha guidelines and rules that Nada Sudha may decide as necessary for the development and nurturing of its students’ musical talent and for smooth conduct of its classes or programs. I further understand that Nada Sudha may in its sole discretion, prohibit any person from entering its premises/facilities on reasonable grounds.

6. Any controversy or claim arising out of, or relating to, this agreement, or the making, performance, or interpretation of it, shall be settled by arbitration in Contra Costa County pursuant to the California Arbitration Act, CCP § 1280, et seq., and judgment on the arbitration award may be entered in any court having jurisdiction over the subject matter of the controversy.

7. I expressly agree that the foregoing waiver and assumption of risks agreement is intended to be broad and inclusive as is permitted by the law of the State of California, and that if any portion thereof is deemed to be void or is held invalid, I agree that the balance shall, notwithstanding, continue in full legal force and effect.

I have completely read this waiver of liability, assumption of risk, indemnity, and understand its terms. I affirm that the agreement supersedes any and all previous oral or written promises or agreements. I am legally competent to sign this document for myself and/or on behalf of my child and voluntarily agree to the terms and conditions stated above. All information that I have provided here are true and correct.
