Application for Membership in Local Union No. 564 of the International Union of Operating Engineers

Having formed a favorable opinion of your Union, I hereby make application to become a member thereof and if accepted I agree to the following:

OBLIGATION REQUIRED FOR MEMBERSHIP IN THE INTERNATIONAL UNION OF OPERATING ENGINEERS.

I do solemnly promise that I will, in accordance with the Constitution and General Laws and the Laws and rules for Government of Local Unions of the International Union of Operating Engineers, not violate any of the provisions of said Constitution, Laws, Rules, Rituals or of the Customs, or Mandates of this Local Union and that I will not enter either verbally or in writing into any individual contract or agreement of employment which contains any provisions looking to the withdrawal of my membership from this Local Union or of any other Local Union of said International Union of which I may hereafter become a member. I further promise, in the event of a claimed grievance by me against the Local Union or any other Local Union of which I may become a member, or against said International Union, that I will faithfully observe the procedure of, and fully accept the finding of, the Trial Boards and Appellate Tribunals set up within the Local Unions and said International Union. I further promise that I will not become a party to any suit at law or in equity against this Local Union of any other Local Union of which I may become a member or against said International Union, until I have exhausted all remedies allowed to me by said Constitution, Laws and Rules, before the tribunals of my Local Union and of said International Union, regardless of my opinion as to the fairness of justice which may be accorded to me by any or all such tribunal. I further promise to conform to and abide by said Constitution, Laws and Rules, and also all Regulations, Decisions and Orders provided for in said Constitution, General Laws and Rules, given by the officers in Authority. I further promise that I will do all in my power to advance the interests of this Local Union and of said International Union and any and all of its duly affiliated and good standing Local Union of which I may become a member. I further promise that I will never wrong an engineer who is a member of any Local Union, in good standing, of said International Union, or see that individual wronged if it is in my power to prevent it. I further promise that I will never divulge any of the secrets of this Local Union, or of any other Local Union of which I may become a member, to any person or persons who are not known to me to be members in good standing, and I further promise that I will at all times give union labor preference in filling any position of which I may have control, and to do all in my power to help an engineer who is a member of this Local Union or of any other Local Union of said International Union to procure employment; and that I will abide by any schedule of hours and wages and any and all working rules adopted by this Local Union or any other Local Union of which I may become a member or under whose jurisdiction I may work; to all of which I pledge my sacred honor I hereby designate the INTERNATIONAL UNION OF OPERATING ENGINEERS and its subordinate Local Union No. 564 to represent me for the purpose of collective bargaining and in any and all other situations that may arise under the operation of the National Labor Relations Act, and/or with any individual employer where the provisions of the National Labor Relations Act are not involved.

I also agree to pay an entrance fee of $5.00 and one month’s dues in advance, prior to initiation.

Initiated by Local Union 564 on Contributions or gif ts to th e International Union of Operating Engineers and this local Union are not deductible as charitable contributions for deferral income tax purposes

I, the undersigned employee, hereby assign from any wages earned or to be earned by me as your employee, to Local 564, IUOE, a sum of $ 5.00 for Initiation Fee, and a sum of 2 times my hourly wage plus any increases of Per capita tax as monthly Union Membership Dues.

I hereby authorize the COMPANY to make these deductions and to remit same to the Financial Secretary of the above mentioned UNION.

I understand that if the membership of Local 564 changes the amount of the regular monthly dues, in accordance with Constitution and By-laws of the Union, then this assignment shall be deemed as authorization and assignment for deduction of said regular monthly dues as so changed.

This assignment and authorization shall become effective as of the date it is received by the COMPANY and shall be irrevocable for the period of one year or until the termination of the current collective bargaining agreement between the COMPANY and the UNION, whichever occurs earlier; and this assignment and authorization shall be automatically renewed and shall be irrevocable for successive periods of one year each or for the period of each succeeding applicable collective bargaining agreement between the COMPANY and the UNION, whichever shall be the shorter, unless written notice is given by me, by registered US Mail, to the COMPANY and UNION during the ten day period immediately prior to the expiration of each period of one year, or during the 60 day period immediately prior to the expiration of each applicable collective bargaining agreement, whichever occurs earlier. If is understood, however, that this agreement shall continue in force under its terms only so long as I perform work falling under the jurisdiction of the above UNION.
