This agreement contains the entire understanding between the Photographer and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by both parties.
The media represented above has indicated that he/she will be attending the Texas Renaissance Festival on one or both days of the weekend(s) indicated above. If the media personnel is carrying any type of commercial photography or videography equipment, he/she is required to check in with the Festival Media Center staff upon arrival at the festival and display a media badge at all times while taking photos. Photographers who are not displaying media badges and are taking photos on the festival grounds will be asked to sign in to the media center or return their equipment to their vehicle.
Media may use photos to promote the festival across print and digital platforms such as social media and websites. Photographers MAY NOT sell photos taken at the festival at any time. Any credentialed media personnel caught selling photos online will not be allowed to apply for Media credentials in the future. By signing this agreement you acknowledge you have read this section and agree.
Media personnel is welcome to wear a costume or garb while shooting photos at the festival. However all media may NOT wear any type of mask or face covering at any time. When photos are being taken of children and families, it is important that all credentialed media can be seen fully with transparency. By signing this agreement you acknowledge you have read this section and agree. Any media personnel in violation of this policy will have their media credential immediately revoked and will not be able to apply for credentials in the future.
Assumption of Risk
Media personnel acknowledges that he/she may be exposed to certain risks and that injuries, death, property damage, or other harm could occur. The media personnel is voluntarily entering the festival grounds with knowledge of the risks, hazards, and other dangers involved. Media hereby accepts any and all risks of injury (including death) to Media arising out of or in any way connected with the Activity.The Texas Renaissance Festival management does not assume responsibility for accidents, theft or loss to any person resulting from, or in any way connected to the conditions or use of the premises covered by this agreement or by any mans of ingress thereto or egress there from.
Releasor hereby waives, releases and forever discharges any and all claims for damages for personal injury, death, or property damage which Releasor and/or Releasor’s children, heirs, executors, assigns,parents, personal representatives, or estate may have or which may hereafter accrue as a result of participation in the activity.
Media Representative, to the fullest extent permitted by law, shall indemnify, hold harmless, protect and defend the Texas Renaissance Festival from and against any and all liabilities, claims, damages, losses, demands, lawsuits,costs, and expenses, including (but not limited to) attorney fees, arising out of or resulting from negligence or misconduct of the media in connection with participation at the festival. Should any such claim, demand, or lawsuit arise or be asserted in any way whatsoever related thereto, whether arising under the laws of the United States, any state, or under any theory of law or equity, the media will indemnify, hold harmless and defend the Texas Renaissance Festival from any and all costs, expenses,or liability including but not limited to the cost of any settlement or judgement made or rendered against the festival.
If the media should require medical care or treatment for illness or injury sustained as a result of participation at the Texas Renaissance Festival, media agrees to be financially responsible for any costs incurred as a result of such treatment. Media represents that adequate health insurance is in effect to cover any injury or illness suffered or damage caused while at the festival.
If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.
The parties hereby agree that this Agreement is governed by the laws of the UnitedStates and the state of Texas, without reference to rules governing choice oflaws. If any dispute arises concerning this Agreement, venue shall be laidexclusively in the state and federal courts of Grimes County, Texas which shallhave exclusive jurisdiction over such dispute and the Parties consent to thepersonal jurisdiction of such courts.
