DISCLAIMER AND RELEASE: Many of the dogs in our program come to us from Animal Control facilities. Our veterinarian screens for noticeable health problems and vaccinates each dog. Each dog is placed on heartworm prevention and is given flea and tick preventative. Even with this care, however, a small percentage of dogs may require vet care or become ill shortly after adoption or while fostering. I understand that Bonaparte’s Retreat offers no warranty or guarantee as to any animal’s disposition, physical condition, health, or ability to interact with any person or other animal. I understand that there are certain risks inherent in interacting with animals I fully understand all risks associated with and inherent to my meeting, interacting with, and caring for an animal and fully assume said risks for injury, loss, or damages of any kind resulting from such risks involved in any associated activities. I hereby agree to release and forever discharge and hold harmless Bonaparte’s Retreat and its directors, officers, employees, agents, volunteers, invitees, sponsors, donors, and all other persons or entities whomsoever from any and all claims (including liabilities, suits, or expenses), whether known or unknown, including claims caused or alleged to be caused by the negligence of Bonaparte’s Retreat or its directors, officers, employees, agents or otherwise, for injury, damage, death or other loss to me, my property, or the persons and property of third persons, in any way connected with my decision to become an animal care provider. I understand and hereby agree to waive all claims I may have against Bonaparte’s Retreat and agree that neither I nor anyone acting on my behalf will make a claim or file a lawsuit against Bonaparte’s Retreat. I, the Foster Care Provider named above, desire to temporarily care for an animal that belongs to Bonaparte’s Retreat with the support of Bonaparte’s Retreat. In consideration of the services of Bonaparte’s Retreat and in consideration of being given the opportunity by Bonaparte’s Retreat to foster an animal, I acknowledge and agree as follows:

I understand that I am solely responsible for the animal in my care. I understand that Bonaparte’s Retreat offers no warranty or guarantee as to any animal’s disposition, physical condition, health or ability to interact with any person or other animal. I understand that there are certain risks inherent in interacting with animals, including, but not limited to, exposure to infection, bacteria and allergic reactions.

I fully understand all risks associated with and inherent to my caring for an animal and fully assume said risks for injury, loss, or damages of any kind resulting from such risks involved in any associated activities. I hereby agree to release and forever discharge and hold harmless Bonaparte’s Retreat, and its directors, officers, employees, agents, volunteers, invitees, sponsors, donors, and all other persons or entities whomsoever from any and all claims (including liabilities, suits, or expenses), whether known or unknown, including claims caused or alleged to be caused by the negligence of Bonaparte’s Retreat or its directors, officers, employees, agents or otherwise, for injury, damage, death or other loss to me, my property, or the persons and property of third persons, in any way connected with my role as a Foster Care Provider. I understand and hereby agree to waive all claims I may have against Bonaparte’s Retreat and agree that neither I nor anyone acting on my behalf will make a claim or file a lawsuit against Bonaparte’s Retreat. I agree that this release is intended to be as broad and inclusive as permitted by the laws of the State of Tennessee and that it shall be governed by and interpreted in accordance with the State of Tennessee. I agree that in the event that any clause or provision of this release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this release, which shall continue to be enforceable.

I, as the Foster Care Provider, agree to take all reasonably necessary precautions to prevent against damage and injury by or to the animal. I understand and agree that I am responsible for the safety of the animal that comes into my care and for the safety of other animals and people with whom the animal comes into contact. Further, I promise to take adequate care of the foster animal while he/she is in my care by providing food donated by Bonaparte’s Retreat, water, and shelter as needed by an animal of this size and condition.

I understand the foster animal must be kept on a leash AT ALL TIMES when in an unfenced or unenclosed area, even when hiking, or walking from my house to a car. Many rescue animals are escape artists, especially in a new environment or when left alone. I will be aware and careful.

Bonaparte’s Retreat will provide food, supplies, basic veterinary care and medication for the animal. I agree to promptly notify Bonaparte’s Retreat if the animal is in need of any veterinary care, including, but not limited to, vaccinations, routine testing, refill of heartworm preventative, or treatment of illness so that this care can be provided in a timely manner. Bonaparte’s Retreat has sole discretion over the nature and level of veterinary care it will provide for the animal. Should I wish to provide further care than Bonaparte’s Retreat is able to fund, I am solely responsible for those costs. Control of external parasites (fleas and ticks) will be maintained by me as well.

When fostering an animal, I understand that I will receive training information and that I am encouraged to participate in a training program to allow the animal to have the best chance of success in a forever home.

Bonaparte’s Retreat agrees to publicize the availability of the animal for permanent adoption through outlets, such as its website, Pet Finder account and Facebook account, in an effort to secure adoption of the animal into a permanent home.

I understand that Bonaparte’s Retreat reserves the right to check on the welfare of any foster animal on my premises and to reclaim possession without payment of any kind. In the event that I do not comply with the foster guidelines and Bonaparte’s Retreat reclaims any foster animal from me, I waive claim to trespasser.

I agree to make the animal available to individuals referred by Bonaparte’s Retreat for possible permanent adoption. Bonaparte’s Retreat will facilitate meeting prospective permanent adopters and recommends that all meetings occur in mutually agreeable public places. Bonaparte’s Retreat will provide a representative to be present at any meetings with a prospective permanent adopter at the Foster Care Provider’s request.

If I desire to adopt the animal permanently, I must notify Bonaparte’s Retreat so that it will cease publicizing the availability of the animal. Upon notifying Bonaparte’s Retreat of my desire to adopt the animal permanently, I understand that Bonaparte’s Retreat may require that I make an application for permanent adoption.

If I decide I am no longer willing or able to foster the animal, I will notify Bonaparte’s Retreat and allow Bonaparte’s Retreat to make arrangements to be made for the animal. Bonaparte’s Retreat has the sole authority to authorize permanent adoption of the animal. I will not promise anyone that they can adopt the foster animal. The animal being cared for by the Foster Care Provider cannot be transferred into the possession of another without written consent of Bonaparte’s Retreat nor can this agreement be assigned without written consent of Bonaparte’s Retreat.
