    AS PER THE SIGNED LISTING AGREEMENT, THE SELLER/LANDLORD AGREED TO ABIDE BY ALL MLS REPORTING RULES. NONCOMPLIANCE WITH MLS RULES CAN RESULT IN THE SELLER/LANDLORD BEING FINED BY THE BROKERAGE AND THEIR CREDIT CARD BEING CHARGED UP TO $2,500.

  • As mandated by the Mere Posting Service Agreement and the Trust in Real Estate Services Act, 2002 (TRESA), all deal related documentation including the completed Agreement of Purchase and Sale, Waivers, Amendments and Releases MUST be provided to Brokerage WITHIN 24 HOURS once final conditions are removed and the sale/lease is binding.

    The Property Owner is liable for any fines incurred by the Brokerage for the Property Owner’s failure to provide deal documentation to the Brokerage as required.

  • CANCELLATION OF LISTING AGREEMENT

    AUTHORITY TO OFFER FOR SALE OR LEASE


     

    RE: LISTING AGREEMENT AUTHORITY TO OFFER FOR SALE OR LEASE ("Listing Agreement") FOR:

  • BETWEEN: ICI Source Real Asset Services Inc., hereinafter referred to as (the “Brokerage”)

     

    AND:

  • , herein referred to as (the “Property Owner”).

    • The Property Owner and the Brokerage, by mutual consent, hereby agree to terminate the above-described Listing Agreement on the following terms:

    • The Property Owner acknowledges and agrees that as mandated by the Listing Agreement and the Trust in Real Estate Services Act, 2002 (TRESA), all deal-related documentation including the completed Agreement of Purchase and Sale, Lease Agreement, Waivers, Amendments and Releases MUST be provided to Brokerage WITHIN 24 HOURS once final conditions are removed and the sale/lease is binding.

    • The Property Owner is liable for any fines incurred by the Brokerage for the Property Owner’s failure to provide deal documentation to the Brokerage as required. The Property Owner's credit card will be charged for any fines incurred by Brokerage.

    • The Property Owner releases the Listing Brokerage from any and all liabilities, covenants, obligations and claims arising out of the Listing Agreement.

    • The Listing Brokerage agrees to immediately notify the Real Estate Board(s) of the cancellation in accordance with the MLS ® Rules and Regulations.

    • This Cancellation Agreement shall not take effect unless signed by all parties set out below.

    • For the purposes of this Cancellation Agreement, the Real Estate Board(s) includes Real Estate Association(s).

    • This Cancellation Agreement shall be binding upon the heirs, executors, administrators and assigns of all of the parties executing the Agreement.

    • “Property Owner” means a person disposing/leasing or attempting to dispose/lease of an interest in real estate by sale or lease and/or the sale of a business.
