LIABILITY WAIVER/INFORMED CONCENT 

In consideration of being permitted to use HIIT CENTER online workouts, facilities and equipment, on behalf of myself, my family, my heirs, and my assigns, I hereby release HIIT CENTER, it’s owners, operators, employees, agents, and contractors from liability for injury, death, or property loss suffered by me resulting from the ordinary negligence of HIIT CENTER, it’s owners, operators, employees, agents, and contractors while I am using the facility, equipment, or in any way associated with participating in any and all gym activities now or in the future. I understand that it is my responsibility to consult with a Physician/Doctor prior to and regarding my participating in any Fitness program/regimen. I represent and warrant that I am physically fit and it have no medical condition and would prevent my full participation in this class. I acknowledge that I know, understand and appreciate the inherent risks of using HIIT CENTER online workouts, facilities and equipment and participation in any class, activity, program or instructions, including without limitations, use of the restrooms, parking area, sidewalk, or any of the facilities and equipment in HIIT CENTER. I know that these risks range from minor scrapes, strains, and bruises to significant injures such as broken or fractured bones, eye injury or loss, concussion, paralysis and even death. By execution of this agreement, I fully assume all inherent risks associated with participation and use of HIIT CENTER and assert that I am voluntarily participating in such activities. I hereby give permission to HIIT CENTER to use my image and photographic likeness in all forms of media for advertising, trade and any other lawful purposes. This includes any and all images, photographs, and videos taken of me, without compensation to me. All film or digital files shall constitute the sole property of HIIT CENTER. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. 

PAYMENT POLICY

I understand that HIIT CENTER does not require members to sign a contract for an extended period of time, and members may cancel at any time by submitting a cancellation request via webite http://www.thehiitcenter.com.

Month-to-Month Online Membership: $40/month (No contract. Auto-renews) 

PAYMENT:
a. A membership fee is payable when you join. 
b. Memberships auto-renew unless canceled (see cancellation policy below).
c. If paying by direct debit the Member agrees to pay the installment amount at the agreed payment frequency
until this Agreement is terminated. Should there be any outstanding payment(s)/debt(s) in payments the
Member authorizes HIIT CENTER to debit the outstanding balance in order to bring the account up to date. 
d. If your automatic direct debit cannot be processed due to insufficient funds or incorrect account information we will attempt to contact you before retrying the debit. Upon eventual processing of the debit, reversal and/or late fees may apply.

Your membership will be cancelled 30 days from the submission of the form cancellation. Note that if you have a scheduled payment within this period, the payment will be processed as scheduled. All payments are non-refundable.

MEMBERSHIP TERMS & CONDITIONS

1. Month-to-Month Membership: $40/month (No contract. Auto-renews)
2. DEFINITIONS: In this Agreement unless the contrary intention appears:
   a. A reference to a party includes that party’s legal personal representative heirs and assigns.
   b. “Member” includes the parent or guardian of the Member if the Member is under 18 years of age.
   c. “Intuit” is Intuit Products. "Square" is Square Products.
   d. “Gym” means HIIT Center at 1350 E. Mahan Drive, Unit D1, Tallahassee, FL 32308.
   e. “HIIT CENTER” means HIIT CENTER L.L.C.
3. MEMBERSHIP: By this agreement you are granted an online membership with HIIT CENTER for the period selected at the
   bottom of this agreement. The membership terms are set out in the following paragraphs
4. PAYMENT:
   a. A membership fee is payable when you join.

   c. If paying by direct debit the Member agrees to pay the installment amount at the agreed payment frequency until this Agreement is terminated. Should there be any outstanding payment(s)/debt(s) in payments the Member authorizes HIIT CENTER to debit the outstanding balance in order to bring the account up to date.
5. ONGOING OBLIGATIONS:
   Membership at HIIT CENTER requires you to:
   a. Update your contact details when they change so that we have your current information on file.
   b. Comply with all terms of this agreement.
   c. Pay all agreed fees.
   d. Ensure sufficient funds are available to cover all fees and advise us in advance if your bank account or credit card has closed or changed.
   e. Inform us in advance if there are any risks to your health if you participate in fitness services and if required seek approval from your Doctor.
   f. Acknowledge that it is your responsibility to cancel direct debit in respect of your membership.
   g. If your automatic direct debit cannot be processed due to insufficient funds or incorrect account information we will attempt to contact you before retrying the debit. Upon eventual processing of the debit, reversal and/or late fees may apply.
6. DEBT COLLECTION AGENCIES:
   a. If unpaid fees remain outstanding, and after attempts by us to rectify the arrears, we may engage a collection agency to request recovery.
   b. If paying by direct debit, upon default by the Member in regard to any obligation under this Agreement and failure to remedy the default after notification by HIIT Center, the Member authorizes HIIT Center to notify any debt collection agency of the default. Should this occur then at HIIT Center’s sole discretion it may
   terminate the Agreement, at which time the full outstanding balance for the remainder of the minimum term or payments (including any current outstanding balances) shall be due in full. The Member authorizes HIIT Center to add to the outstanding debt a fee of $50 and an amount equivalent to 25% of the full outstanding balance (being expenses reasonably incurred in collecting the debt) upon initial referral to the debt collection/credit reporting agency.
7. CANCELLATIONS:
   a. All memberships auto-renew.
   b. In order to cancel your membership, you must give a 30-day written cancellation notice via www.thehiitcenter.com. Note that if you have a scheduled payment within this period, the payment will be processed as scheduled. All payments are
   non-refundable.
   c. Once the selected term of your membership expires, you or we may cancel your membership.
   d. Upon cancellation, you must pay us any fees owed or we may take action to recover them.
   e. In the event that payments are being made by direct debit, you must contact HIIT Center to advise cancellation and have HIIT Center confirm termination. This process may take 5-7 business days to
   complete. The Member shall not consider that this agreement has been terminated until such time as this is confirmed by HIIT Center.
   f. HIIT CENTER reserves the right to terminate this membership agreement for the following reasons:
   i. Failure to abide by any of the criteria listed in the Terms & Condition.
   ii. Non-payment of fees
   g. Termination of this Agreement will also terminate the Direct Debit Request Authority.
   h. To cancel your membership you must complete and submit the Membership Cancellation form on the website. This will serve as your 30-day written cancellation notice as required by your membership
   agreement. Your membership will be cancelled 30 days from the submission of the online form. Note that if you have a scheduled payment within this period, the payment will be processed as scheduled. All payments are non-refundable.
   i. Memberships are not transferrable.
