We are very pleased to offer you employment with West-Can Seal Coating Inc. and welcome you to the team. The terms and conditions of this offer of employment are outlined below. Your initials on each page, and signature in the space provided, indicates your acceptance of our offer on these terms and conditions.
Position
You will be employed as {{Position}} with the Employer and you will be reporting to the Crew Lead.
This offer is contingent upon the following:
Satisfactory completion of a Fit for Duty test (Drug & Alcohol and/or Audiometric). Testing must be performed PRIOR TO the start date.
You must submit copies of the following prior to the start date:
Proof of and ongoing maintenance of a valid driver’s license. Employees are required to notify the Employer immediately of any changes in the status of their driver’s license.
- A clean five year commercial driver’s abstract that has been completed within 30 days of start date
- All valid safety tickets and training required and obtained for the position hired for
- Valid First Aid /CPR Level C with AED certification, if applicable
- Pass the Company COVID-19 Screening Questionnaire
- You must read and agree to West-Can Seal Coating Inc. Policies and Procedures - COVID-19 Policy (Schedule “D”) and abide by it’s content for the extent of the Employment Term.
Duties
You shall perform your duties and responsibilities faithfully and with every effort. The Employer may require you to perform the duties of other positions, or alter or add to the present duties at any time which may be different from those described in the position description (attached as Schedule “A”).
Term
Notwithstanding the date upon which you may execute this offer letter, your employment in this position shall be deemed effective after May 1, 2020 and will continue until approximately October 1, 2020 (NOTE: the end date of seasonal employment is subject to change (prior to the noted date or extended beyond the noted date) without notice in line with the company’s seasonal workload).
Total Compensation
Wage – The wage for this full-time seasonal position is {{$20.00}}/hr less all required or permitted deductions and withholdings. Overtime (where applicable) is paid based on Employment Standards of the province in which you are working. Employees will be paid bi-weekly via direct deposit, and paystubs are distributed electronically via email. It is your responsibility to notify HR or Payroll of any changes to banking information or email address.
Training – For all training required, $130.00 per day will be paid. This includes orientation and third party training such as ACSA courses, and third party and client orientations. A onetime payment for completion of Safety Sync/Work Hub requirements will be paid at a maximum of $260.00 upon successful completion of 100% of the requirements. 100% compliance is required prior to attending orientation and starting work.
Vacation - Employees will receive 6% for vacation and 3.6% for general holiday pay for a total of 9.6% of your regular wages. The pay will be retained until the end of August, then paid on every pay period to the end of the season.
Health Benefits – Following the completion of 1 full season (minimum 90 days) and 3 months into the 2nd consecutive season with West-Can Seal Coating Inc. qualifying employees are eligible for Company Health Benefits. Annual premiums for Company Health Benefits are co-payed between the Employee and the Company.
Registered Retirement Savings Plan (RRSP) – Following the completion of 1 full season (minimum 90 days) and 3 months into the 2nd consecutive season with West-Can Seal Coating Inc. qualifying employees are eligible for RRSP Benefits.
The Employer will match the Employees contribution to a maximum of 5% of regular wages on the Employer offered RRSPs.
5 Year Commercial Drivers’ Abstract – The Company will with the Employees’ approval contact the Provincial Registrars and pull on your behalf a 5 Year Commercial Drivers’ Abstract. The cost for doing so ($30.00) will be deducted from the Employees’ first payroll.
Safety Boot Allowance – Employees are eligible for a $25.00 safety boot reimbursement annually. Safety boots must be CSA approved footwear with minimum 6 inch support from the heel. Employees can apply for reimbursement by submitting receipts to payroll@west-cansealcoating.com. Reimbursement will be applied to the employees pay.
Per Diem - You will receive a $40.00 per day non-taxable meal allowance if you are away from home base (Didsbury Office).
Accommodation - Accommodations (based on double occupancy, unless other manager approved arrangements have been made) will be booked and covered by the Employer. Statutory Holidays – The Employer will provide accommodations the last date worked prior to the Statutory Holiday and the night prior to the restart date following the Statutory Holiday. NO EXCEPTIONS will be made.
Electronic Logs – West-Can Seal Coating Inc. follows Federal Hours of Service regulation, meaning that all employees are required to maintain an electronic duty status log book. To meet this requirement all employees are required to have a smart phone with a data plan and Wi-Fi capabilities. Employees will be reimbursed $10.00 per pay period for the minimal usage of data and additional cellular charges that may be accrued for work purposes. As a condition of employment, employees are required to comply with hours of service and submit duty status logs promptly. Training in hours of service, and electronic logs will be provided. Only the use of Employer approved applications will be permitted.
Termination
By You:
You may terminate your employment at any time by providing to the Employer two (2) weeks’ written notice.
The Employer may decide, in its sole discretion, to waive your required notice of termination.
By the Employer:
The Employer may terminate or fundamentally alter your employment without just cause for any reason, in its
absolute discretion, by providing you with written notice, or compensation in lieu of notice, or a combination thereof, equal to the minimum requirements of the Employment Standards Code. The employee shall not be entitled to any amounts greater than the statutory minimums set out by the Alberta Employment Standards Code.
It is understood and agreed that the above notice or payment in lieu of notice, or combination thereof, is reasonable and adequate notice, and will fulfill all requirements for notice, or payment in lieu of notice imposed by law.
Upon termination or alteration of your employment as set out herein, it is understood that you shall have no further claims against, or be entitled to any further remuneration or compensation from, the Employer arising from the termination or alteration of your employment.
Confidentiality
You acknowledge and agree that you hold a position of trust with the Employer and that it is a condition of employment with West-Can Seal Coating Inc. that you maintain in the strictest of confidence with all confidential information respecting the business and affairs of the Employer and its business partners, suppliers and customers ("Confidential Information"). You further acknowledge and agree that such Confidential Information shall, for all purposes, be held by you in a fiduciary capacity and solely for the benefit of the Employer. You agree that you will not, either during the continuance of your employment by the Employer or at any time thereafter, use for your own purpose any Confidential Information or disclose, divulge or communicate orally, in writing, on social media or otherwise, to any person or persons, any Confidential Information other than when it is necessary in the course of business.
Confidential Information shall not include any information that:
i) was in the possession of, or known to you, without any obligation to keep it confidential, before it was disclosed to you by the Employer;
ii) is, or becomes, public knowledge through no fault of you; or
iii) is, or becomes, lawfully available to you from a source other than the Employer, which source, to the best of your knowledge, is legally permitted to disclose such information and is not under confidentiality restrictions.
Use of Company Property
Employees issued Company property are expected to exercise care, perform required maintenance and follow operating instructions, safety standards and guidelines.
The improper, careless, negligent, destructive or unsafe use or operation of equipment can result in disciplinary action, up to and including termination of employment.
Rules and Regulations
You shall observe the existing and future Company Rules and Regulations. It is the responsibility of the employee to ensure the Company Policies and Procedures (Schedule “C”) and the Company COVID-19 Policy (Schedule “D”) have been read and understood prior to commencing work with the company, any questions in this regard are to be forwarded to the Human resources department.
As the disruption caused by COVID-19 persists, we continue to consider the potential health risks for our construction sites. The goal is to provide a safe workplace, and strict adherence to safety procedures is necessary. Your active participation is critical, as the COVID-19 guidelines, rules and regulations are a work in progress, and it will be a team effort to protect each other.
Violation of any Company rule or regulation is subject to disciplinary measures up to and including termination.
Absenteeism and Illness
Punctual attendance is crucial to the success of the company. The Company has the right to require you to supply proof of illness in the form of a doctor's certificate or other form satisfactory to the Company. Excessive absenteeism may be subject to disciplinary measures up to and including termination.

Other Terms and Conditions
You agree that the Employer has the right to enact or invoke policies and procedures governing its employees, and you agree to be bound by all such policies and procedures, except where they specifically contradict the terms of this offer letter.
A copy of the comprehensive Company Policy and Procedure Manual will be given to you upon commencement. Additional copies can be obtained from the Human Resources Department by requesting a copy. The Employer reserves the right to amend the Policy and Procedure Manual without notice at any time.
Invalid or Unenforceable Terms
If any term or condition is determined to be invalid or unenforceable to any extent, the remaining terms and conditions shall not be affected thereby, and each of the remaining terms and conditions shall be valid and enforceable to the fullest extent permitted by law.
Entire Agreement
This letter, and all other documents referred to or incorporated herein, constitute the entire agreement between the parties, and replaces and supersedes all previous communications, representations, understandings and agreements whether written or verbal between the parties.
Independent Legal or Other Professional Advice
You acknowledge that prior to executing this offer letter you have had the opportunity to obtain independent legal or other professional advice.
The above offer is valid until Aug 21, 2019 at 4:00 PM MDT.
