MEMBERSHIP-RELEASE AGREEMENT

I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A LEGALLY BINDING CONTRACT BETWEEN MYSELF AND Sun Valley Paragliders, Inc., the Sun Valley Company and the US Hang Gliding & Paragliding Association, (USHPA) its owners, officers, directors, agents, employees, servants, contractors, and affiliates, AND I HAVE SIGNED IT OF MY OWN FREE

Further, I acknowledge that this Release Agreement is the entire agreement between myself and Sun Valley Paragliders, Inc., the Sun Valley Company and the USHPA, concerning the risks of injury or death resulting from my participation in paragliding or speed flying activities.

I hereby expressly agree that this release agreement is intended to be as broad and inclusive as is permitted by the laws of the State of Idaho and that if any portion hereof is held invalid, I agree that the balance of the agreement shall continue in full force and effect.

 

COPY THE FOLLOWING STATEMENT TO SIGNIFY UNDERSTANDING:

I understand that paragliding and speed flying are inherently dangerous sports that may result in injury, paralysis, or death to me.

As lawful consideration for being permitted by Sun Valley Paragliders, Inc., the Sun Valley Company and the USHPA, or its agents, employees, servants, or affiliates to participate in these activities and/or use their equipment or facilities, I hereby agree that I, my spouse (if applicable), my heirs, distributees, guardians, legal representatives and assigns will not make a claim against, sue, attach the property of, or prosecute Sun Valley Paragliders, Inc., the Sun Valley Company and the USHPA and/or any of its agents, employees, servants or affiliates for injury (including death), or damage or any loss suffered as a result of my participation in paragliding or speed flying activities and resulting from negligence or other acts, howsoever caused, by any employee, agent, servant, contractor or affiliate of Sun Valley Paragliders, Inc., the Sun Valley Company and the USHPA or inadequate instruction, or unsafe or defective equipment used in paragliding or speed flying activities.

I hereby acknowledge that, THE RISK OF PERSONAL INJURY OR DEATH IS ALWAYS PRESENT, JUST AS IT IS IN ANY OTHER HIGH-RISK SPORTS ACTIVITY (motorcycle riding, skiing, scuba diving, mountain climbing, etc IF MY PARTICIPATION IN PARAGLIDING OR SPEED FLYING ACTIVITIES RESULTS IN MY INJURY OR DEATH, Sun Valley Paragliders, Inc., the Sun Valley Company and the USHPA, ITS AGENTS, EMPLOYEES OR ANY PERSON ASSOCIATED WITH Sun Valley Paragliders, Inc., the Sun Valley Company and the USHPA CANNOT BE SUED FOR ANY RESULTING DAMAGE OR LOSS OF ANY KIND.

In addition, I hereby release and discharge Sun Valley Paragliders, Inc., the Sun Valley Company and the USHPA, its owners, offices, directors, employees, agents, servants, and affiliates from all actions, claims or demands, I, my heirs, distributees, guardians, legal representatives, or assigns now have or may hereafter have for injury (including death), or damage or any other loss resulting from my participation in paragliding or speed flying activities.

I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS.

Under penalty of perjury, I hereby verify that I am more than eighteen (18) years of age at the time that I sign this release.
