ClubReady requires that subscribers who request the outbound transfer of Cardholder Data from ClubReady’s secure system environment follow a formal process which seeks to ensure the safe handling of this sensitive information in accordance with Payment Card Industry Data Security Standards (“PCI DSS”). The formal process is initiated when a subscriber seeks to transfer Cardholder Data from the ClubReady System to itself, to another
payment gateway, or to another third-party platform provider with payment facilitator capabilities. In requesting the transfer of Cardholder Data, Subscriber hereby acknowledges that it, or the third party to which it would have ClubReady transfer such sensitive information, is actively compliant with PCI DSS requirements and has in place sufficient technical and operational safeguards to effectuate a seamless transfer of Cardholder Data.
Subscriber expressly agrees that once Cardholder Data is transferred off the ClubReady System, ClubReady shall have no liability whatsoever for the security, accuracy or integrity of such information. Once Cardholder Data is transferred off the ClubReady System, the risk of loss passes entirely to parties other than ClubReady. In this regard, Subscriber provides ClubReady with a full release and a complete waiver of liability for any claims related to or arising out of the transfer of Cardholder Data off the ClubReady System. With full knowledge of the process requirements and the releases/waivers provided herein, Subscriber authorizes ClubReady to transfer Cardholder Data to the party listed below
