  • USER PRECAUTIONS

  • 1. Chilled Squirrel recommends that you have your e-bike maintained and serviced at either our Chilled Squirrel Cape Town or Johannesburg branch. If any of these branches are too far from you we may recommend another.

    2. Familiarize yourself with your electric bicycle and the functions of the Chilled Squirrel e-bike and it’s electronic systems in a safe environment before participating in road traffic for the first time.

    3. Always wear a helmet when riding an electric bicycle for your own safety. In October 2004, the South African government passed a law making it compulsory for all bicyclists to wear helmets. The regulation requires the use of a protective helmet that is properly fastened and fitted while riding a bicycle or being carried as a passenger. sure that the tires have the pressure recommended by the manufacturer before riding the bike.


    4. Make sure that the brakes are operating properly before riding the bike.

    5. Do not use a mobile phone or any other electronic devices while riding an electric bicycle; it is imperative that you pay attention to traffic.


    6. If possible, ride in bike lanes and always in the correct direction of traffic.

    7. Adhere to all valid traffic regulations.

    8. Keep in mind that other traffic participants may underestimate the speed of an electric bicycle.

    9. Ride with both hands on the handlebars when riding your electric bicycle.


    10. Ride as defensively as possible.

    11. Care in Gear Changing : when gears are changed please make sure that you are not using the throttle at the same time. This puts too much unnecessary pressure on the transmission components. Change one gear at a time and do not apply big pressure on the pedals whilst changing the gears - only light pedal- ing when gears are changed.

    IMPORTANT SAFETY NOTICE: 


    Please ensure that Battery Power is turned off on the battery and at the power switch on your Handlebars before you adjust any technical settings including your chain or pedals and before you repair or adjust any other components or parts.The PAS (pedal assist function) may kick in automatically initiated by any movement of the chain or pedals thereby injuring the rider.

    Please keep your hands away from adjusting anything other than settings on your handlebar unless your power is OFF.

  • HANDLING AND CHARGING THE BATTERY

  • 1.Chilled Squirrel’s Samsung Cell Lithium batteries need to be recharged with Chilled Squirrel chargers or Chilled Squirrel power supplies.

    2.Never short circuit the battery by connecting the contacts of the battery.

    3.Never open the battery, as this could damage the battery and possibly lead to overheating. The battery cannot be serviced by the user. Opening the battery case voids all warranty and product liability claims. Never use a battery which has obvious damage to the case(s) or the battery connector.

    4. It is best to store the battery in a cool location at temperatures between 10 °C and 25 °C. Never store the battery in locations where the temperatures can reach more than 45 °C or fall below -10 °C . The bat-tery should never be exposed to extreme temperature fluctuations or humidity, and always protect the battery during storage from humidity to prevent corrosion of the connectors.

    5.Never drop the battery. Always protect it from physical damage. Damage may lead to short- circuits, and as a result cause overheating of the battery.

    6.Do not dispose of used batteries in regular household trash. Be aware that used batteries must be dis-posed of properly. Chilled Squirrel batteries can be returned to Chilled Squirrel to be recycled. WARNING Re Charging the battery:

    7.Only use the Chilled Squirrel power supply or charger that was supplied with the system to charge the battery. The use of other power supplies/chargers can damage the battery.

    8.Keep the power supply or charger away from water or moisture when charging and/or connected to pre-vent electrical shock or short-circuits.

    9.Do not use a power supply or charger that has obvious signs of damage to the cable, housing, or the connector.

    10.Extreme temperatures will affect battery life, especially during charging. Avoid charging in direct sunlight or in very hot or cold temperatures. This will reduce the life of the battery considerably. We recommend charging the battery at room temperature approximately 20 °C. The battery should be warm to room temperature before it is charged, particularly if it was exposed to cold temperatures during a ride.

    11.The battery can be charged when mounted on the bicycle or removed from the docking station. A Lithium Ion battery does not have a memory effect, which means that the battery’s maximum energy capacity is not affected if it is repeatedly recharged after only being partially discharged. The battery does not need to be completely drained before charging. We recommend charging the battery after every ride, preferably when the state-of-charge display shows less than 50%. 

    12. Battery Locked on: Please ensure your battery is Locked on properly before you ride. This requires you turn the key in the lock of the battery and check if it is properly locked on before you ride away

    13. Remove the keys from the lock to avoid the keys falling out whilst riding.

    14. Turn the Power off in two places: When not riding - please turn the power off at The handlebars console power button that is next to your LCD display AND on turn the power switch off on your Battery. Otherwise the battery may discharge while it is not being used.

    15. Charge your new battery full upon receiving: After you take delivery of your new Electric bike, please charge it full. Yo u will know it is full when the red light on your Charger turns Green.

    16. Best time to stop using your battery: to ensure maximum life cycles, it is best to stop using the battery when you are down to one notch left on your LCD Display. Or to be on the very safe side, two notches. If you con-tinue using your battery beyond this, it could cause the cells to swell and damage the permanently which will reduce the amount of life cycles you get on your battery

    TIP: 

    Carrying your battery charger with you will help . You may then charge for half an hour along the way just to make sure you do not discharge the battery completely which could potentially cause damage.

    17. When charging the battery on the bike: please make sure that both of these power switches are off whilst charging.

    18. Do not leave the battery standing flat (completely discharged ) , make sure it is charged to at least 50% full . Especially if you do not ride the bike for a while -it does the battery harm to leave it standing in completely flat/ discharged state for an extended period of time.

    19. Do not over-charge the battery. it is better to remove the charger as soon as the green light comes on (which confirms the battery is fully charged) . It takes approximately 3.5 hours to charge the battery full. Do not leave the battery in a charging mode unattended for longer than 3 hours.

    20. Storage & Transportation of the Battery : when you travel and require your battery to be transported in any way , it is best for the make sure the battery is charged to 50% capacity instead of 100%. Avoid vibration and shock - your battery should be packed with soft materials such as wrapped in bubble wrap or in a blanket or towel.

    21. Long-term storage of your battery : If you intend to leave your battery unused for an extended period make sure it is charged to 50% ( not full ) and then charge it once a month to the 50% level. Batteries will discharge themselves even when not used. If you keep the cells charged at 50% in storage this will ensure a healthy battery with optimal life cycles.

  • MAINTENANCE AND CARE

  • In order to ensure extended use of the Chilled squirrel systems, all plug-in contacts of the system should be checked every two to three months and cleaned with a soft and dry brush, if necessary. It must be ensured that no dirt or humidity penetrates the battery docking station when the battery is removed. The Bafang motor and battery does not require other maintenance.

    Never use a high pressure washer or a garden hose to clean the motor , LCD display or battery systems. The force of a water jet could damage the electrical components.

  • TRANSPORTING AN ELECTRIC BIKE

  • When transporting your electric bike always remove the battery. In case of inclement weather, your motor and system connections should be protected from the elements. When travelling by air, it is important to un-derstand that a lithium battery is classified as dangerous goods and must be transported by a qualified han-dler. Please note that your battery cannot accompany you and your bicycle on a commercial flight. 

  • REPAIRS AND SPARE PARTS

  • For repair of your electric bicycle, please consult us at our service centre either in JHB or CT or a quali-fied dealer. The use of spare parts from unknown sources, for example, replacement parts from third par-ties, is strictly prohibited. If you need spare keys for the battery, please contact chilled squirrel . Please retain the key number for your records. It is located on the battery key. 

  • OPTIMIZING BATTERY RANGE

  • The following factors influence the range of your battery:

    1. Topography

    Riding in mountainous terrain requires a much higher energy input compared to riding in flat areas.

    2.Climbing

    Riding up steep hills requires much more energy than riding on flat ground. More effort or possibly a change to a more gradual route can affect overall range.

    3.Level of assistance

    Choose the level of assist required based on riding conditions, rather than just riding in one particular level all the time. Remember that energy consumption more than doubles from level 5 assist to level 9.

    4.Battery state of charge

    Make sure the battery is fully charged before every ride. This will provide the best possible range from the battery each time.

    5.Weight and load capacity

    Every ounce counts! Limit your cargo, think about getting an efficient type of bicycle for the system, even what type of gear you wear.

    6.Tire pressure

    Tires with pressure that is low will have increased rolling resistance, and require more energy from the battery. It is important to regularly check your tire pressure, the max. pressure is typically written on the sidewall of any tire. Slick, skinny, high pressure tires offer the most efficiency for you and your battery.

    7.Acceleration and constant speed

    It is important to ride efficiently; electric propulsion systems consume more energy when accelerating from a standing position. Try to keep your speed constant, starts and stops greatly affect your overall range.

    8.Outside influences/weather

    You will notice some difference in range when it is very hot or cold outside, this influences how quickly the battery will discharge. Headwinds can also greatly affect system performance. Expect more range on days with moderate climate.

    9.Cadence and Shifting

    Keeping your cadence high (between 80-90 rpm) is the most efficient pedalling range for most cyclists. A high pedalling rate in combination with the lowest level of assist will offer the most range, the more slow-ly you pedal and the more you rely on the electric assist, the less range you will get. Use your shifters to ride efficiently, just as you would with any other bicycle!

     

  • WARRANTY AND GUARANTEE INFORMATION

  • The Chilled Squirrel warranty covers a 1(one) year period for all parts of the Motor and battery systems(s) to the first owner, within the framework of the following conditions:

    1.This warranty exclusively covers systems provided by Chilled Squirrel excluding all the other bicycle com-ponents provided by other bicycle manufacturers.

    2.This warranty covers the repair and/or the replacement of Chilled Squirrel motor and battery systems pro-vided that the equipment concerned loses its functionality within the agreed warranty period and also provided that the claim is not related to any of the following cases expressly excluded under this warranty.

    3.Any other legal provisions, particularly with respect to warranty regulations, are not restricted by this war-ranty.

    4.This warranty only covers material and manufacturing defects. It is only effective with a valid proof of pur-chase consisting of the original purchase document or receipt indicating the date of purchase, the serial number, the dealer’s name and the designation of the system model. Chilled Squirrel reserves the right to reject the coverage of this warranty if the accompanying documentation of Chilled squirrel components is not accurate or complete.

    5.In the case of a warranty claim, Chilled Squirrel undertakes to either repair faulty system components and/or to replace such components, at Chilled Squirrel’s discretion (Service Replacement Unit).

    6.Warranty repairs have to be exclusively performed by Chilled squirrel. Any component to be repaired un-der the framework of this warranty has to be transferred to the dealer at the client’s own expenses and risks, and, after the completion of such repair, has to be picked up at the dealer. In the case of rightful warranty claims, Chilled Squirrel reserves the right to bear or repay transportation expenses. In order to have

    7.A previous determination whether a warranty claim is justified or not, the end user has to submit his claim to the dealer from whom he purchased the product so that the respective dealer handles the shipment to Chilled Squirrel.

    8.Costs for repair work performed in advance by persons who have not been authorized by Chilled Squirrel will not be reimbursed. In such a case, any warranty claim will cease.

    9.Repair work and/or replacement of components during the warranty period does not lead to an extension and/or a new start of the warranty period. Repair work and direct replacement during the warranty period may be performed with functional replacement components of equal value.

    10.The One-year warranty period starts with the date of purchase. Warranty claims must be reported imme-diately.


    11.No warranty claims are accepted – without limitation to other reasons – in the case of damages due to the following:

    a)  External influences, particularly falling rocks, collision, accident and other external events with an immediate external effect due to mechanical powers.

    b)  Purposeful and/or malevolent acts, theft and robbery as well as natural hazard events and/or acts of mischief.

    c)  Inappropriate use e.g. the product was exposed to liquids, chemicals of any type and/or extreme temperatures, wetness and humidity and/or if the battery suffers damages due to non-compliance with the special instructions set forth in the chapter “Handling and Charging of the Battery“.

    d)  Overcharging the battery or not adhering to the instructions of battery handling.

    12.No warranty claims are accepted - without limitation to other reasons:

    a)  In the case of test, maintenance, repair and replacement work due to normal use.

    b)  If the model, serial or product number on Chilled squirrel product has been changed, deleted, blurred or removed. The seal and/or the serial number decal on the battery housing has been bro-ken or obviously manipulated.

    c)  In the case of use of the battery in systems that are not approved for such use with this particular product.

    d)  In the case of the operation of the Chilled Squirrel system with batteries other than the batteries designed for the Chilled Squirrel system (refer to user manual).

    e)  If one or more than one Chilled Squirrel part has been opened, altered or repainted.

    13.This warranty only covers the above mentioned repair work and/or the replacement of defective or com-promised components. It excludes any claims as to the reimbursement of property damages, downtimes, expenses for renting or leasing equipment, travel expenses, lost profit or any other claims. Chilled Squirrel liability in connection with this warranty is limited to the respective acquisition value of the product.

    14.This warranty only covers original Chilled Squirrel components. The use of spare parts from unknown sources, for example, replacement parts from third parties, is strictly prohibited.

    15.Warranty will be voided on any system on which it will be concluded that there has been any case of modi-fication or tampering with firmware.

  • ACKNOWLEDGEMENT , INDEMNITY AND WAIVER

  • The following provisions are drawn to your attention if the Consumer Protection Act 68 of 2008 ("the CPA") ap-plies to this Acknowledgement, Indemnity and Waiver:

    •In terms of clause 3.1 there is an acknowledgment by you inter alia regarding the risks associated with the use of the Products by a User, confirmation that you fully understand how the Products work and are to be used and that wish you wish to proceed to make use the Products at your own risk, the effect of which is that you make an acknowledgement of fact;

    •In terms of clause 3.2 there is a waiver and abandonment of any Claim by a User against Chilled Squirrel and an indemnity in favour of Chilled Squirrel from and against any liability in respect of any Claim of a User and any Claim of any Third Parties against Chilled Squirrel, the effect of which is that a User may have limited or no recourse against Chilled Squirrel or may be liable to Chilled Squirrel in the circum-stances referred to aforesaid;

    •In terms of clause 3.4 there is an indemnity in favour of Chilled Squirrel from and against any and all costs and expenses (including legal costs on the scale as between attorney and own client) sustained or in-curred by Chilled Squirrel in connection with any Claim against Chilled Squirrel, the effect of which is that you may be liable to Chilled Squirrel for payment of certain costs and expenses.

    1.For purposes of this acknowledgement, indemnity and waiver:

    1.1.“Claim” means any claim for loss, damage (whether direct, indirect, consequential or otherwise), cost or expense arising, directly or indirectly, as a result of, or in respect of:

    1.1.1.your use of the Products; and/or

    1.1.2.our provision of the Services; and/or

    1.1.3.where we supply the Products to you and you are acting as a sales agent, reseller or distributor of the Products; and/or

    1.1.4.any other act or omission of Chilled Squirrel (whether negligent or otherwise), and whether as a result of any injury, illness, harm, death, damage to property or damages of whatsoever nature and howsoever arising;

    1.2.“Chilled Squirrel” and/or "us" and/or "our" means Chilled Squirrel (Pty) Ltd (Registration Number: 2014/016572/07) and its holding companies, subsidiaries, related or inter-related parties, officers, direc-tors, employees, agents and associates;

    1.3.“Products” means and includes (but is not limited to):

    1.3.1."E-Bikes" being a conventional pedal powered bicycle to which an electronic motor and battery have been fitted and includes electric "fat bikes" and electric "mountain bikes"; and/or

    1.3.2.components utilised in the manufacture and/or customisation of E-Bikes such as electronic mo-tors, batteries, LCD display/power consoles and safety thumb throttles; and/or

    ]1.3.3.accessories such as battery chargers, handle grips, seats and branded clothing; and/or

    1.3.4.any other products, components and accessories developed and/or supplied by us from time to time; and “Product” means any of the Products, as the context may require;


    1.4. ”Services" means the provision of any services directly or indirectly associated with the manufacture and/or supply of the Products and includes (but is not limited to) providing advice on selecting the appropriate Product for you, converting a conventional pedal powered bicycle to an E-Bike, customising an E-Bike to your specifica-tions and riding preferences and/or any other services developed and/or supplied by us from time to time

    1.5 “Third Parties” means every person purchasing our Products from or through you and/or having access to or using the Products by arrangement with you, or at your invitation, including, for the avoidance of doubt, the parent(s) or legal guardian(s) of any Third Party who is a minor or any Third Party who is under any form of legal disability and “Third Party” shall mean any one of them;

    1.6 “User” and/or "you" and/or "your" means any person who purchases our Products and/or engages our Services from time to time, including any parent(s) or legal guardian(s) of any minor or any legal guardian(s) of any person under any form of legal disability.

    2. Please read the terms and conditions of this acknowledgement, indemnity and waiver carefully and make sure you understand them before purchasing any Products and/or engaging our Services. Please do not purchase any Products and/or engage our Services if you do not agree to the terms and conditions of this acknowledge-ment, indemnity and waiver. If you do continue to purchase any Products and/or engage our Services, doing so will be confirmation that you agree to the terms and conditions of this acknowledgement, indemnity and waiver and agree to be bound by them. This acknowledgement, indemnity and waiver must be read with our standard terms and conditions, which are available on our website at https://chilled-squirrel.myshopify.com/ ("Terms and Conditions”).

    3. I/We hereby:

    3.1 record that I/we, to the maximum extent reasonably possible:

    3.1.1acknowledge that there may be risks associated with the use of the Products, that bicycling and re-lated activities can be hazardous and may result in personal injury or even death;

    3.1.2 acknowledge that Chilled Squirrel has fully explained to me the various Product options available to me, the benefits and risks associated with any specifications and riding preferences selected by me includ-ing any instructions I may have furnished in respect of the conversion of a conventional pedal powered bicycle to an E-Bike and/or any customisation of an E-Bike;

    3.1.3 acknowledge that I have received instruction and satisfactory answers to any questions regarding the use and functionality of the Products;

    3.1.4 acknowledge that in the case of new Products, I have received a copy of the manufacturer’s written instructions and warranty;

    3.1.5 confirm that I have carefully considered and understand the fact, nature and potential risks associat-ed with the use of the Products;

    3.1.6 acknowledge that I make use of the Products entirely at my own risk; ]

    3.1.7 confirm that Chilled Squirrel is not responsible for any modifications made by me to the Products after delivery thereof;

    3.1.8 confirm that if at any time the Products do not appear to be functioning properly, I will stop using it immediately and return it for inspection and possible repair or adjustment;


    
3.2 to the maximum extent permitted in law, waive and abandon any Claim personal to me/us against Chilled Squirrel and/or waive and abandon any Claim I may have against Chilled Squirrel and indemnify Chilled Squirrel and hold it harmless from and against any liability in respect of any Claim by me and any Claim of any Third Parties against Chilled Squirrel;

    3.3 undertake to make payment of any Claim against Chilled Squirrel within 7 (Seven) days of written de-mand from Chilled Squirrel;

    3.4 indemnify Chilled Squirrel and hold it harmless from and against any and all costs and expenses (in-cluding legal costs on the scale as between attorney and own client) sustained or incurred by Chilled Squirrel in connection with any Claim against Chilled Squirrel.

    4. This acknowledgement, indemnity and waiver must be read in conjunction with any applicable provisions of our Terms and Conditions relating to warranties, privacy, data protection, use and disclosure of informa-tion and any applicable law. ]

    5. In the event of any dispute in respect of any aspect of this acknowledgement, indemnity and waiver, such dispute will be dealt with in terms of the dispute resolution provisions contained in our Terms and Condi-tions.

    6. I/we warrant, represent and undertake to Chilled Squirrel that where I/we are purchasing any Products from Chilled Squirrel (including where I/we are acting as sales agents, resellers or distributors of the Prod-ucts) and/or engaging Chilled Squirrel to provide any Services on behalf of a Third Party, I/we are the duly authorised agents of such Third Party. Furthermore, I/we will provide a copy of this acknowledgement, in-demnity and waiver and Chilled Squirrel’s Terms and Conditions to such third party together with all perti-nent instructions, warnings and information relating to the use of the Products to such Third Party.

    7. The provisions of this acknowledgement, indemnity and waiver shall be binding on my/our estate(s), ex-ecutors, administrators, liquidators, trustees, successors in title, permitted assigns of the parties and refer-ence to any party shall be deemed to include such party's estate, executors, administrators, trustees, succes-sors in title, permitted assigns or liquidators, as the case may be.

    8. No term or condition of this acknowledgement, indemnity and waiver is intended to breach any peremp-tory provisions of the CPA and any regulations promulgated thereunder ("Prohibited Provision"). Any breach of any such Prohibited Provision shall be governed by the provisions of clause 9 mutatis mutandis.

    9. Each provision of this acknowledgement, indemnity and waiver shall be considered severable and if, for any reason, any such provision is held to be invalid, contrary to, or in conflict with any applicable present or future law or regulation (including, without limitation, the CPA or any regulations promulgated thereunder) or in terms of a final, binding judgment issued by any court, it shall not impair the operation of, or have any ef-fect upon such other portions of this acknowledgement, indemnity and waiver as may otherwise remain valid or intelligible, which shall continue to be given full force and effect and bind the parties hereto.

    10. This acknowledgement, indemnity and waiver may be amended, varied and/or modified by Chilled Squirrel at any time and such amendment variation and/or modification shall be effective immediately upon publication thereof on the reverse side of any purchase order and/or posting thereof on our website at https://chilled-squirrel.myshopify.com/. Accordingly, the conclusion of any purchase order whether in-store on via our website at https://chilled-squirrel.myshopify.com/ will be deemed to be acceptance by you of any such modified acknowledgement, indemnity and waiver.


    11. No indulgence, leniency or extension of time granted by a party shall constitute a waiver of any of that party's rights under this acknowledgement, indemnity and waiver and, accordingly, that party shall not be precluded as a consequence of having granted such indulgence, from exercising any rights against any other party which may have arisen in the past or which might arise in the future.

    12. This acknowledgement, indemnity and waiver, together with our Terms and Conditions, contains the entire agreement between Chilled Squirrel and you in relation to the subject matter hereof and no party will be bound by any undertakings, representations, warranties promises, terms or conditions or the like not recorded herein. Save as contemplated in clause 10, no alteration, cancellation, variation of, or addition hereto will be of any force or effect.

    13. This acknowledgement, indemnity and waiver will be governed by and construed in accordance with South African law.
