Online and Physical Exhibition Processes, Procedures, Terms and Conditions
1. Artists are required to submit the following details for each piece submitted (i) name of artist including email and phone number contact details, (ii) Title of Piece, (iii) medium of material, (iv) artwork dimensions in centimetres (height x width x depth), (v) estimated weight of piece including frame (for shipping cost estimates if necessary), (vi) whether the artwork is framed or unframed, (vii) does the frame include glass?, (viii) one photo in either of the following formats: .JPG, .JPEG or .PNG in relation to each piece of artwork (SMAG reserves the right to require fuller or better images), (ix) sales price in GBP (£) and, if desired, (x) artists are permitted to submit a typed 200 character maximum description of each piece as a summary or comment on the work, to be included on the site. NOTE: SMAG Art will not publish private contact details, of any artist, other than the Artist’s name, on its website including, for avoidance of doubt, email addresses, bank details or phone numbers.
2. Up to a maximum of two works may be submitted per artist and each artist is required to pay a non-refundable, administrative fee of £6.00 for each piece of artwork included in the exhibition upon submission of the works.
Making Payment of Non-Refundable Entry Fees
In order to make payment for entry fees, please go to www.smagart.com and click on the Entry Fees button. There you will find two options: (i) £6.00 if one piece is being submitted and (ii) £12.00 fee if two pieces are submitted. Payments on our website can be made with all major credit cards. Alternatively, if you prefer to make a bank transfer, please use the following details: St Michael's Art Gallery, Sort Code: 30-90-90; Account Number: 3308 7868. Please make sure you include your surname as reference so we can identify your payment.
a. This fee covers both an online and physical submission, if you choose that option on the online submission form. That is, you do not pay twice for one piece submitted online and physically except - note, for existing artwork you may currently have online - an entry fee for the Physical Exhibition in October/November 2024 will be required for any pieces currently online that you wish to exhibit physically, to the extent that piece of work was submitted online "prior to" 15 June 2024. That is, if a piece submitted for the October/November 2024 Physical Exhibition was previously submitted online on or after 15 June 2024, no additional fee will be required for the October/November 2024 Physical Exhibition. Given the online site is a relatively permanent fixture, from time to time, the SMAG Directors reserve the right to remove certain works from the online exhibition to the extent we feel the site needs a refresh. We do not guarantee a minimum specific time/duration that a piece will be presented online at www.smagart.com but our mission is to help you sell your work whilst raising funds for charities so we will always want to maintain a piece for as long as we think it is still saleable.
3. SMAG will not accept pieces of artwork on a “Not For Sale” basis. By submitting each individual piece of artwork, the Artist is making an express pledge to SMAG Art that, for the time period upon which that artwork is on display for sale on the SMAG ART website and/or a "Physical Exhibition", that any sale is conducted through SMAG Art in its capacity acting as agent on behalf of the Artist.
4. Artist Sales and Commission - By submitting this form, all artists are deemed to have granted authority and confirmation of responsibility (see below attestation requiring online signature) allowing the sale of their work at the specified price, or such other price as may be agreed by phone call or email between the artist and SMAG, and that SMAG is expressly permitted to retain 30% of such price as commission for its own account. SMAG Art will act as the agent of each such artist under this authority.
5. The SMAG Art Directors reserve the right to reject any offensive or inappropriate exhibits.
6. Order, positioning, hanging/display, whether online or at a physical exhibition, are at the discretion of the SMAG Art Directors.
7. Artists must insure their own work if they want protection from loss, theft or damage. SMAG Art and, in the case of a physical exhibition display, St Michaels & All Angels Church (“St. Michael’s Church”) accept no responsibility for any loss, damage or theft of artwork during any exhibition.
8. Online Submissions - if a potential purchaser wishes to view the original, SMAG Art will put them in touch with the artist with the artist’s consent.
9. Online Submissions - The responsibility for packaging and despatch of the painting will be the responsibility of the artist. In the event of a purchase, SMAG Art will first receive confirmation of the purchase and hold the proceeds, together with costs of delivery, as agent of the artist. Only once it has been confirmed that delivery of the artwork in question has been made, whether by recorded delivery or other means, will SMAG Art release the net proceeds to the artist.
10. Physical Exhibitions - All items of work require a label in black on white card, firmly affixed to the reverse of the work by suitable means. This must be in BLOCK CAPITAL LETTERS and include (i) Title of work, (ii) Name of artist, (iii) Material used, (iv) Sales price. The final page of this form includes an option to fill in label forms for each piece and print out, prior to submitting the online form, which may be useful. Please ensure you print in portrait style and single-sided. You may also want to use thicker paper, if available, for printing labels.
11. Physical Exhibitions - On completion of the physical exhibition, artists should collect any unsold works after 10:30am on the final day of the exhibition or on the following day (details for pickup to be provided for each relevant Physical exhibition separately from these terms). Please note that we have no space to store uncollected work after the stipulated collection dates for the exhibition. SMAG reserves the right to dispose of any uncollected artworks.
12. Physical Exhibitions - All work sold can be collected by purchasers on or before the final day of exhibition provided funds have been cleared. SMAG Art will endeavour to make payments to artists for items sold within six weeks of the closure of the exhibition, if not sooner.
13. Physical Exhibitions - All pieces of artwork should be submitted ready to exhibit with suitable cords, wires or hooks in position on the reverse of the artwork. Those works deemed too heavy to hang will be placed in suitable areas at the exhibition venue at the discretion of the SMAG Art Directors.
14. Physical Exhibitions - Rack Submissions - an artist submitting 1-2 works of art to the general physical exhibition would be allowed to submit up to an additional two pieces for the Rack. If an artist has not entered pieces in the General exhibition via an online entry form, they will not be permitted to submit works to the Rack. This is becuase we have no way of then tracking your contact details if a Rack piece sells. These rack pieces must be (i) unframed, and at an appropriate size subject to SMAG Director's discretion, (ii) preferably maximum flat board thickness (i.e. no canvasses), (iii) sealed or wrapped in protective coating like cellophane for protection and (iv) limited to a sales price of no greater than £100 to distinguish rack entries to thos ein the general exhibition. Sold pieces can be replaced in a similar fashion as we allow for the general exhibition. The pieces in the Rack will not feature online or in the catalogue, nor be subject to an entry fee, but will be subject to a 50% commission (which differs from our 30% commission on general entries). All other terms and conditions, including being on display at the artist’s risk, will apply. As not recorded separately in the catalogue, the details of works for the Rack, including price, title of the piece and artist name, need to be clearly marked/attached on each work.
15. All artists must specify their full contact details (including a phone number) so queries relating to works, viewing, costs of despatch, price of sales and proceeds can be dealt with quickly.
16. SMAG ART Limited is a company, limited by guarantee, which is a not for profit company. The proceeds of our Online and Physical Exhibitions and any other income received by SMAG ART will be donated to charities, determined by the Directors.
17. SMAG ART is not registered for VAT at present; if it does register in the future, then VAT would be added to all prices.
18. The SMAG Art Directors reserve the right to add, alter or amend the above conditions from time to time.
19. These terms and conditions shall be governed and construed in accordance with English Law.
