In  exchange for my being permitted to participate and/pr become a student of Jacob Flame’s Tang Soo Do University, I agree to the state paragraphs below. I further agree to be bound by the Waiver contained below.

 

Cancellation of Membership: 30 Days Written Notice is Required.

If I decide to cancel my membership at TSDU  for any reason, I agree to give TSDU at least 30 days written notice of my intent to do so. Any membership cancellation will not take effect until 30 days after written notice is received by TSDU. Unless and until my membership is cancelled, I acknowledge and agree that I am obligated to continue making monthly membership payments.

 

We do not offer refunds for summer camp. 

 

I acknowledge that classes and scheduling are subject to change within the sole discretion of TSDU. I further acknowledge that there will be no refunds for such changes.

WAIVER & INDEMNITY - Release of all liability   

1)  You (martial arts student and anyone signing this contract on your behalf as a parent or guardian) agree that if you engage in any martial arts training, physical exercise or activity at Jacob Flame's Tang Soo Do University ("TSDU") or use any part of TSDU's facility and equipment on the premises (including any property rented by TSDU of any affiliate of TSDU for purposes of any program including but not limited to instruction  or demonstration (hereinafter referred to as a "program"), you do so at your own risk. This includes, without limitation, your use of the studio, bathrooms, mats, parking area, sidewalk or any equipment in the karate studio and your participation in any program.

2)  You agree that you are voluntarily participating in these activities and using the studio and premises and assume all risk of injury, illness, damage or loss to you or your property that might result, including, without limitation, any loss or theft of any personal property.

3)  You further acknowledge that you are aware of the risks of the study of and participation in martial arts and cardio kickboxing or any other related exercise.  Such risks can include, but are not limited to torn ligaments and tendons, sprained joints, broken bones, head or spinal injuries, and death.  Knowing these risks you hereby agree to assume the risk on behalf of yourself (and your personal representatives, heirs, executors, administrators, agents and assigns) and release, discharge and hold harmless TSDU, Master Jacob Flame, Mrs.  Kinsie Flame, Mr. EJ Abaya, Mr. Robert Ramirez, Mr. Jack Cushway, Mr. Scott Wood and all of their affiliates, employees, agents, representatives, trustees, members, successors and assigns, including but not limited to  Pinecrest Schools,, Conejo Valley Unified School District, Conejo Valley Parks & Recreation and all their officers, employees and members, (hereinafter referred to collectively as "releasees") from any and all claims or causes of action (known or unknown) arising out of the negligence or carelessness of any of the persons or entities mentioned above.

4)  This Waiver of liability includes, without limitation, injuries which may occur as a result of (a) your use of any martial arts or exercise equipment or facilities which malfunction or break; (b) releasees improper maintenance of any exercise or martial arts equipment or facilities, (c) releasees negligent instruction or supervision, (d) your slipping and falling while in the karate studio or on the premises and/or (e) any injury inflicted by another student/member of releasees while practicing, participating, or observing any activity, class program tournament, instruction or demonstration, including but not limited to sparring.

5)  The Undersigned Hereby Agrees to Indemnify and Save and Hold Harmless releasees, from any loss, liability, damage or cost they may incur due to the presence of the undersigned in, upon or about TSDU's premises or in any way observing, practicing, participating or using any facilities or equipment of TSDU whether caused by the negligence of the releasees or otherwise.

6)  The Undersigned further expressly agrees that the foregoing Waiver and Indemnity Agreement is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

BY SIGNING BELOW YOU ACKNOWLEDGE THAT YOU HAVE CAREFULLY READ THIS WAIVER AND FULLY UNDERSTAND THAT YOU ARE RELEASING AND WAIVING ANY RIGHT THAT YOU MAY HAVE TO BRING A LEGAL ACTION OR ASSERT A CLAIM AGAINST RELEASEES AND ALL PERSONS OR ENTITIES REFERENCED ABOVE FOR RELEASEES NEGLIGENCE. "

 I, the undersigned, hereby represent and warrant that I am the parent and/or legal guardian of the Student/Participant named herein and have full authority to sign and enter into this Contract on the Student/Participant's behalf.

By signing below you acknowledge that you have carefully read this waiver and fully understand  that you are releasing and waiving any right that you may have to bring legal action or assert a claim against the releases and all persons or entities referenced above for releases negligence.

 I, the Undersigned, have read this Contract including the Waiver contained and herein. I, the undersigned voluntarily sign this contract and accept and agree with all terms, conditions, waivers, including the Waiver of Liability and Indemnity Agreement , contained herein.  I further agree that no oral representation, statements or inducement apart from the foregoing written agreement have been made.
