  • The prospective renter must successfully demonstrate and complete the following skills:

    • Rig boat properly and demonstrate a basic understanding and knowledge of the parts and equipment of a sloop-rigged keelboat
    • Sail rectangular course and demonstrating appropriate sail trim on different points of sail, control, and mastery of the helm
    • Demonstrate a series of tacks, jibes, showing control of the boat (sail trim and helm), and awareness of boat position relative to the wind, and other vessels/objectives 
    • Luff into the wind, and recover from being "in irons" 
    • Make a controlled approach/landing to a mooring/dock
    • Basic understanding of navigational aids and right of way rules (e.g.): 
      • Red nuns, green cans and day markers 
      • crossing and overtaking situations, sail to sail and sail to power
      • commercial traffic right of way (restricted ability to maneuver)
    • Demonstrate an awareness of the condition of the weather, including forecasted changes, tides and their potential effect on sailing
       
  • Sail Newport Rental Policies, Rules and Procedures

    The person who will be taking the check out test needs to type in the initials of their name, agreeing to the following policies, rules and procedures. Please read through these carefully as some policies, rules, and or procedures may have changed.
  • Waiver of Liability, Assumption of the Risk & Photographic Release

    I acknowledge that I am 18 years of age or older and by signing this form, I accept the following statements:

    RI GENERAL LAWS OF RI SECTION, 7-6-9 Exemption from Liability 

    A) No person serving without compensation as a volunteer, director, officer or trustee of a non-profit corporation, including a corporation qualified as a tax-exempt corporation under 501(c) of the United States Internal Revenue Code [26 U.S.C. 501(c)], or of an unincorporated nonprofit organization or an unincorporated public charitable institution qualified as a tax-exempt organization under section 501(c) of the United States Internal Revenue Code, shall be liable to any person based solely on his or her conduct in the execution of such office or duty unless the conduct of such director, officer, trustee, or volunteer with respect to the person asserting such liability constituted malicious, willful or wanton misconduct. As used in this section, "compensation" does not include a per diem or per meeting allowance, health insurance benefits or reimbursement for out of pocket costs and expenses incurred in such service. Nothing herein shall be construed to exempt a volunteer from liability based upon his or her ownership and/or operation of a motor vehicle. 

    (B) Officers, directors, agents, servants, volunteers, and employees of a corporation shall not be liable for bodily injury to any person incurred while such person is practicing for, or participating in, any contest or exhibition of an athletic or sports nature sponsored by the corporation; provided such person has, or in the case of a minor, a parent or guardian of such minor has, signed a written waiver of liability of the corporation and acknowledgment of assumption of risk with respect to such practicing for, or participating in, any contest or exhibition of an athletic or sports nature sponsored by the corporation. 

    WAIVER OF LIABILITY AND ASSUMPTION OF THE RISK
    I, for myself and my crew, on behalf of family, estate, heirs, executors, administrators, successors, assigns and next of kin (collectively, “I”) voluntarily agree to assume all risks associated with participating in a sailing event, instructional program, racing program or sailboat rental.    In consideration for my and my crew's participation in any activity at SN, I hereby agree, to the fullest extent permitted by law, to waive any and all claims against and to hold harmless, release, indemnify, and covenant not to sue, SN, DEM, the State of Rhode Island, the City of Newport, and each of their affiliated companies, entities or subsidiaries, and their partners, employees, agents, representatives, volunteers, officers, directors, officials, sponsors, donors, and advertisers (collectively, the “Releasees”), from any and all loss, claim, liability or expense (“Claims”), including but not limited to Claims for property damage, personal injury, disability, illness or death, including but not limited to Claims arising from the alleged negligence of the Releasees, and Claims arising from participation in a Sail Newport event, regatta, program or boat rental.  

    PHOTOGRAPHIC RELEASE 
    I grant Sail Newport the right to use my name, age and photograph, and/or video without compensation, in any press release, web site posting, advertisement, brochure or other medium intended to promote Sail Newport. 

    COVID-19
    I acknowledge that COVID-19 has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact.  I agree to abide by the current State of Rhode Island, Department of Environmental Management, City of Newport and Sail Newport guidelines.

    I understand that by completing this form I am creating a legally binding document and agree to be bound by the laws of R.I. where I will participate in a Sail Newport event, instructional program or rent a boat.

    I agree to the terms of this Liability Waiver, Assumption of the Risk and Photographic Waiver and sign it voluntarily.
