Conduct During Application Period
During the No Contact Period, no Applicant may knowingly discuss an application to the Pharr Economic Development Corporation COVID-19 Emergency Business Loan Program with any City Commissioner, PEDC Board Member or Staff, and no City Commissioner and/or PEDC Board Member or Staff may knowingly solicit information relating to the application from a prospective Applicant. This section does not prohibit communications that: (a) are part of a posted PEDC Board meeting; (b) are conducted as part of a PEDC Staff-scheduled due diligence meeting; (c) are incidental, exclusively social, and do not involve the PEDC or its business, or the City Commission and/or PEDC Board Member’s role as a PEDC official; (d) are purely procedural, for example a question regarding where information may be obtained; or (e) do not involve the PEDC or its business and that are within the scope of the City Commission and/or PEDC Board Member’s private business or public office wholly unrelated to the PEDC. This Section does not prohibit communications between the City Commission and/or PEDC Board Members or Staff and an Applicant who has an existing contract or business relationship with the PEDC to discuss issues related to that contract or relationship. The PEDC Board Members and/or Staff shall disclose any Representations at the next PEDC Board meeting, or if the City Commission and/or PEDC Board Member will not attend, then next PEDC Board meeting, within 30 days of the Representation having been made. A prospective Applicant’s violation of this section may result in rejection of the Applicant’s application to the Pharr Economic Development Corporation COVID-19 Emergency Business Loan Program.
City Commissioners, PEDC Board Members, and PEDC Staff cannot accept from a prospective Applicant any gift, meal, lodging, transportation or entertainment. A prospective Applicant cannot provide a PEDC Board Member or PEDC Staff with any gift, meal, lodging, transportation or entertainment.
