Release & Liability Waiver

1. I understand that by signing this document, I AM AGREEING TO WAIVE CERTAIN LEGAL RIGHTS.  I am aware that before doing so, I SHOULD SEEK INDEPENDENT LEGAL ADVICE.

2. I understand that the Procedure is a potentially dangerous undertaking and UNDERGOING THE PROCEDURE MIGHT RESULT IN THE SUFFERING OF INJURIES INCLUDING INFECTION (both minor and life threatening), REJECTION, SCARRING, BLEEDING OR DECREASED SENSITIVITY BRUISING, SWELLING, OR DEATH.

3. I have considered the physical demands of undergoing the Procedure and I DECLARE THE CLIENT IS IN PROPER PHYSICAL CONDITION TO UNDERGO THE PROCEDURE and free from any condition, impairment, disease infirmity or other illness that would prevent undergoing the Procedure.

4. I VOLUNTAIRILY ASSUME ALL RISKS AND RESPONSIBILITY FOR ALL LOSSES AND/OR DAMAGES associated with and arising from the Client undergoing the Procedure and/or the use of the Relegation Tattoo Inc.'s equipment and/or premises.

5. I COVENANT TO RELEASE, WAIVE, DISCHARGE Relegation Tattoo Inc.; it assignees; owners; officers; directors; managers; artists and staff (paid or unpaid); or agents; (the "Releases") from any and all liability to the Client or the Client's personal represenative, assigns, executors, heirs and next of kin for any and all liabilities, actions, claims, demands, losses, cost, expenses, or damages at law or equity of every kind which the Client may now or in the future have against the Releases and from any claims or demands therefore on account of any injury, including but not limited to the death of the Client or any and all dmages to or loss, theft or destruction of property, arising out of or related to undergoing the Procedure and/or the use of Relegation Tattoo Inc.'s equipment and/or premises caused or alleged to be caused in whole or in part by the negligence, breach of contract or otherwise.  Without limiting the generally of the forgoing.  I further release the Releases from breach of any duty arising from any and all resources which I may now or hereafter have under the Occupiers Liability Act [RSBC 1996] Chapter 337 and amendments therto.

6. I COVENANT TO INDEMNIFY AND DEFEND THE RELEASES AT MY SOLE EXPENSE, from any claimds or demands associated with and arising from the Client undergoing the Procedure and/or the use of the Relegation Tattoo Inc.'s equipment and/or premises.

7. I expressly agree that THIS RELEASE AND LIABILITY WAIVER IS INTENDED TO BE AS BROAD AND INCLUSIVE AS PERMITTED BY LAW and that if any portion is held invalid, it is agreed that the remaining clauses continue in full legal force and effect.

8. i expressly agree that THIS RELEASE AND LIABILITY WAIVER AGREEMENT IS THE ENTIRE AGREEMENT and no other written or oral agreements, warranties, covenants that in any way vary the terms of this agreement, shall be enforceable.

I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing.
I further acknowledge that Relegation Tattoo Inc. has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19.
I further acknowledge that Relegation Tattoo Inc. can not guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, tattoo shop staff, and other tattoo shop clients and their families.
I voluntarily seek services provided by Relegation Tattoo Inc. and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending my appointment.
I attest that:
* I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
* I have not traveled internationally within the last 14 days.
* I have not traveled to a highly impacted area within the United States of America in the last 14 days.
* I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.
* I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non contagious by provincial or local public health authorities.
* I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.
I hereby release and agree to hold Relegation Tattoo Inc. harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the tattoo shop, or that may otherwise arise in any way in connection with any services received from Relegation Tattoo Inc. I understand that this release discharges Relegation Tattoo Inc. from any liability or claim that I, my heirs, or any personal representatives may have against the tattoo shop with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Relegation Tattoo Inc. This liability waiver and release extends to the tattoo shop together with all owners, partners, sub-contractors, and employees (paid or unpaid).
