2. I am aware that the process of DYNO testing/calibration can be potentially harmful to my vehicle, unforeseen conditions may exist in my vehicle’s engine, drivetrain, and/or suspension that when stressed, may not perform as expected. I am voluntarily participating in this activity with knowledge of the potential consequences that may occur to my vehicle, I hereby agree to accept any and all risks of injury or damage and verify that statement by placing my initials below.

3. As consideration for being permitted by New Era Performance LLC to participate in this activity and use its facilities, I hereby agree that I, my assignees, heirs, distributes, guardians, and legal representatives, will not make a claim against, sue, or attach the property of New Era Performance LLC or any of its affiliated organizations, its employees, agents for any injury or damage resulting from the negligence or other acts, however caused, by any employee, agent, or contractor of New Era Performance LLC and any of its affiliated organizations (and it employees and agents) from all actions, claims, or demands that I, my assignees, heirs, distributes, guardians, and legal representatives now have or may hereafter have for injury or damage resulting from my participation in Dyno testing of my auto. I also understand that I will not be allowed to be in the dyno testing area while such testing actually occurs.

4. Dyno testing/diagnostics of a vehicle may greatly increase the horsepower and torque a stock vehicle produces. It is my responsibility to ensure my property is properly equipped with tires, a transmission, a drivetrain, safety equipment, and other vehicle components that are rated to travel at increased speeds. New Era Performance LLC is not responsible for the products or vehicles' proper use and service. New Era Performance LLC is not responsible for damage to distressed parts already on my vehicle, replacement of parts is my responsibility. I verify that statement by placing my initials below.

5. I understand that during the dyno session, New Era Performance LLC will only work on the vehicle's computer, read plugs and set the throttle blade to the proper angle (if applicable). During the Dyno session, it may be found that my vehicle has a mechanical or electrical problem that prevents the Dyno diagnostic to continue. If this occurs my vehicle will be pulled off the dyno equipment and I will be instructed by New Era Performance LLC staff on the repair of my vehicle. If I choose to have New Era Performance LLC perform repairs I will be charged $100.00 per hour with a 1 hour minimum for labor plus costs of parts. I may also choose to take my vehicle elsewhere for repairs. Once my vehicle is repaired I may continue my Dyno session. If I choose to have my vehicle repaired elsewhere, I agree to pay the balance of my Dyno session in full. I verify that statement by placing my initials below.

7. By providing my initials below, I acknowledge and accept responsibility for any vehicle spills (oils, coolant, or any other liquids) that may occur during the dyno session, agreeing to pay a cleaning fee of $100.
