Agreement between The Greater You Inc. and {clientFull}(Client) whereby The Greater You agrees to provide Coaching Services:

SERVICES

This agreement, between The Greater You Inc and the above-named client, will begin on date signed and will be ongoing from date of agreement or until terminated by Client or The Greater You Inc.

Coaching / Mentor sessions are conducted over the phone, internet, or in person if applicable. To begin the session, the COACH / Mentor will initiate the session per the means determined in advance.

RESPONSIBILITIES

1. Coach / Mentor agrees to maintain the ethics and standards of behavior set by the International Coach Federation (“ICF”) (www.coachfederation.org/ethics).

2. Client is responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results. As such, the Client agrees that the Coach / Mentor is not and will not be liable for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.

3. Client understands that coaching is not to be used as a substitute for professional advice by legal, mental, medical or other qualified professionals and will seek independent professional guidance for such matters. If Client is currently under the care of a mental health professional, Coach will recommend that Client inform the mental health care provider.

4. Client agrees to communicate honestly, be open to feedback and assistance, and create the time and energy to participate fully in the program.

PROCEDURE

The time of the coaching meetings and/or location will be determined by Coach and Client based on a mutually agreed upon time. The Coach will initiate all scheduled sessions and will initiate the session at the scheduled meeting times:

LATE / NO SHOW

Sessions that are more than 15 minutes late will be considered missed/canceled and will be subject to the cancellation policy.

CONFIDENTIALITY

This coaching relationship, as well as all information (documented or verbal) that the Client shares with The Greater You Inc and/or the Coach as part of this relationship, is bound to confidentiality by the ICF Code of Ethics but is not considered a legally confidential relationship (as in Medicine or Law). The Greater You Inc/Coach/Mentor agrees not to disclose any information pertaining to the Client without the Client’s written consent. The Greater You Inc/Coach/Mentor will not disclose the Client’s name as a reference without the Client’s consent. Confidential information does not include information that: (a) was in The Greater You Inc/Coach’s possession prior to its being furnished by the Client; (b) is generally known to the public or in the Client’s industry; (c) is obtained by The Greater You Inc/Coach from a third party, without breach of any obligation to the Client; (d) is independently developed by The Greater You Inc./Coach without use of or reference to the Client’s confidential information; or (e) that The Greater You Inc/Coach is required by law to disclose.

SPONSORSHIP:

If primary payment comes from a party other than Client, or Client is a minor, Client agrees that Coach may discuss coaching sessions, billing information, and other information regarding the coaching agreement with the client’s sponsor(s), listed below. Client reserves the right to request that certain information shall not be disclosed and Coach agrees to operate in good faith by consulting the Client before discussing sensitive information.

In the event of the Client divulging information deemed to be a risk to him/herself and/or others, Coach may be legally responsible to notify the client’s parents and/or other appropriate personnel.

According to the ethics of our profession, topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, further coach professional development and/or consultation purposes.

CANCELLATION POLICY

Client agrees that it is the Client's responsibility to notify the Coach 48 hours in advance of the scheduled calls/meetings. The Greater You Inc reserves the right to bill Client for a missed meeting. Coach will attempt in good faith to reschedule the missed meeting.

TERMINATION

Either the Client or The Greater You Inc may terminate this agreement at any time with written notice.

 

RELEASE OF LIABILITY

Life Coaching is a service that provides personal coaching to specific individuals and/or groups. The client is aware that coaching is in no way to be construed or substituted as psychological counseling or any other type of therapy or medical advice. Kwinten will at all times exercise his best professional efforts, skills, and care of ensuring the client is coached to meet their life coaching goals, the client understands and acknowledges the coach will not be liable legally or otherwise, for the actions the client may or may not undertake as a result of the life coaching sessions. No assumption of responsibility is made or given, and the client requesting such advice agrees not to hold The Greater You Inc / Kwinten Kemp (Provider) responsible or liable in any form or fashion, for such actions taken of their own accord. The method and process by which this advice and direction are given in no manner whatsoever, written or verbal, constitutes an agreement or liability on the part of the provider and is acknowledged to be different in many ways than clinical and medical counseling.

You (the client) agree that using any of these life coaching services is entirely at your own risk. Life coaching services are provided "as is", without warranty of any kind, either expressed or implied, including without limitation any warranty for information services, coaching, uninterrupted access, or products and services provided through or in connection with the service. This service is requested at the client's own choice and with inherent singular responsibility. Any actions or lack of actions, taken by the client of such advice is done so solely by choice and responsibility of the client and is neither the responsibility nor liability of The Greater You Inc / Kwinten Kemp (Provider). The client takes full responsibility for the decisions they make after being coached as well as the consequences. The client enters into coaching with full understanding that they are responsible for creating their own results. Periodically I, Kwinten Kemp, may provide links to other web sites or written print material which may be of value, interest, and convenience to you. This does not constitute an endorsement of material at those sites or any associated organization product of service. It is the responsibility of the user to make their own informed decision about the accuracy of the information at those sites and print material including their privacy policies. In no event shall The Greater You (Provider) be liable for any incident or consequential damages resulting from the use of the material.

LIMITED LIABILITY

Except as expressly provided in this agreement, The Greater You Inc makes no guarantees or warranties, express or implied. In no event will The Greater You Inc./Coach be liable to the Client for consequential or special damages. Notwithstanding any damages that the Client may incur, The Greater You Inc/Coach’s entire liability under this agreement, and the Client’s exclusive remedy, will be limited to the amount paid by the Client to The Greater You Inc./Coach under this agreement for all services rendered up until the termination date.

This is the entire agreement of the parties, and reflects a complete understanding of the parties with respect to the subject matter. This agreement supersedes all prior written agreements, oral representations, discussions, or understandings.

If a dispute arises out of this agreement that cannot be resolved by mutual consent, the Client and The Greater You Inc and/or Coach agree to attempt to mediate in good faith for up to thirty (30) days after the notice is given. If the dispute is not resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party.
