    The Brandon Hall Declaration of Covenants, Conditions, and Restrictions requires that submittal and approval of this Application is needed prior to beginning any construction, installation, or alteration to the exterior of your house or lot.  This includes painting, roofing, landscaping, patios, decks, fencing, driveways, pools, play equipment, and other additions or modifications. Every Brandon Hall homeowner is subject to these covenants. The homeowner is responsible for proper drainage and any problem which may occur on a neighbor’s lot resulting from your drainage changes. Carefully scrutinize all drainage plans and consult a drainage professional.  Though neighbor approval is not required, depending on the improvement, the Association may solicit your neighbors regarding your submission and consider their input as part of the review process.  Forsyth County may require plan review or permits for certain types of improvements. The homeowner is solely responsible for fulfilling any review, permit or code requirements. County approval does not constitute Brandon Hall approval. Copies of said approvals must be submitted once received by the County.  The ARC has 45 days from submission date to approve or deny the modification request, but the ARC does usually respond promptly if all required information is provided.  Please understand that a fine in the amount of $500.00 will be assessed to the account should a modification take place without prior approval from the Association.  Any changes to approved modifications must be resubmitted for review. Failure to do so will VOID the original approval.  All modifications must begin within 6 months of approval and be completed within 120 days of the start date or modifications must be resubmitted.

    I understand and agree that no work on this request shall commence until written approval of the Architectural Review Committee has been received by me. I represent and warrant that the requested changes strictly conform to the community Design Guidelines and that these changes shall be made in strict conformance with the Design Guidelines. I understand that I am responsible for complying with all city, state, and county regulations. Neither the Brandon Hall Homeowners Association, Inc., (“HOA”), the HOA Board of Directors, the Architectural Review Committee nor their respective members, secretary, successors, assigns, agents, representatives or employees shall be liable for damages or otherwise to anyone requesting approval or an architectural alteration by reason of mistake in judgment, negligence or non-feasance, arising out of any action with respect to any submission. The Architectural Review Committee is directed toward review and approval of site planning, appearance and aesthetics. None of the foregoing assumes any responsibility regarding design, methods of construction, or technical suitability of materials. I hereby release and covenant not to sue all of the foregoing from/for any claims or damages regarding this request or the approval or denial thereof.

    Paint/Stain

    This request is for paint and stain changes to the exterior of your house. House paint colors that are the same as when the house was built are usually approved automatically. Any changes from the original colors should be color coordinating, different than your nextdoor neighbors’ schemes, and fitting for your house style and the neighborhood. Include pictures of the other sides of the house for painting and/or structures that will be stained or painted. A screenshot of the output of color visualization app (optional) should be submitted as supplemental pictures.

    Roof

    This request is to replace your home’s roofing shingle. Our neighborhood standard is that each home’s roofing shingles should not be the same color as either adjacent neighbor home.  The HOA Community Standards requires that roofing shingles must be architectural type with minimum 10 year warranty.

    Tree removal

    The HOA encourages the removal of trees that are dead, diseased, compromised, safety hazards, or causing damage to the house or other structures as stated in our Covenants. The request must be submitted with pictures of the tree(s) and may require an arborist report. A front yard tree that was originally planted by the builder should be replaced with a hardwood. The ARC can provide a Forsyth county guide of the types of trees that can be used in the front.  In the description provide species and size of replacement tree. Add an arborist report with the supplemental pictures.

    Fence

    This request type is to install a new fence or add to existing fence. For staining an existing fence use the Paint/Stain request type, and fence repairs don’t require an ARC request. There are 2 approved wood fence designs and 1 metal fence design which are shown in the Brandon Hall fence guideline document. Please include which fence design is used in the work description.

    Landscape/Hardscape

    This request type is to install a new landscape areas or hardscapes including retaining walls, firepits, or other outdoor structures.  Replacing dead shrubs in an existing shrub bed with a comparable shrub doesn’t require an ARC request. Any work in the undisturbed buffer area on your lot will require Forsyth County approval (Planning Dept. (770) 781-2115).

    Deck/Patio/Porch

    This request type is to install or modify a deck, patio, or porch.  Maintenance on an existing structure doesn’t require an ARC request. A new deck or porch requires an architectural design with both vertical and horizontal elevations. Projects that require county permits must submit a copy of the permit.  A Lot plan drawing or sketch is also required for new structures.

    Play area and equipment

    This request type is to install a permanent play area or equipment in the backyard. No play equipment is allowed in the front of the house except a self-standing basketball goal that is movable and placed in an area that doesn’t cause a problem with any neighbors. Pictures of the products or examples of the requested items are required along with a Lot plan drawing showing the location of the item(s).

    This request type is to install or extend a driveway, sidewalk, or steps on the lot. The HOA Covenants only allows concrete to be used for driveways and sidewalks.

    This request type is for major structural changes the house, the addition of a pool, or a detached garage. These additions require an architectural design with both vertical and horizontal elevations. Projects that require county permits must submit a copy of the permit.

    Provide the brands and product names of the paints and stains chosen. Also provide the application area and color codes for each paint or stain used. Any changes from the original builder colors used should be color coordinating, different than your next door neighbors’ schemes, and fitting for your house style and the neighborhood. There should be 3 different paint colors for siding, trim, and doors and shutters. You should use good product brands for exterior use and at least 7 year warranty. Sherwin Williams and Behr have online apps to help you choose and visualize coordinating colors (please provide a screenshot from any visualization tool used). For staining doors, decks, patios, fences, or wood trim, use good product brands for exterior use and at least 5 year warranty. Red stain colors are no longer approved. Note: put NA for unused color entries.

Pictures of products include: play sets, flagstone, rocks, pavers, wall blocks, edging, plants, trees, doors, shutters, lighting fixtures, and other purchased items used in the project. Picture examples of the your finished project will help the ARC team to visualize it, and you could use pictures from friends, neighbors, contractors, or Pinterest of a similar finished project.

This includes both attached and detached structures such as decks, porches, pools, garages, and any alteration to existing structures on the lot. To create a lot drawing, you can use a copy of your Plat provided from your home purchase or you can obtain a Plat drawing from the ARC committee upon request.
