Booking & Retainer

Digital Collection prices are non-negotiable and are locked in once your Retainer has been received.

A non-refundable retainer of $200 is required to reserve your photography session.

This retainer secures your date on the calendar and locks in the pricing of your selected digital collection. Because only a limited number of sessions are accepted each month, the retainer ensures that your session time is reserved exclusively for your family.

The retainer must be received within 24 hours of booking. If payment is not received within this timeframe, the session date will be released and may be offered to another client.

The remaining balance of your selected photography collection is due on or before the day of your session, prior to the session beginning.

Images from sessions with unpaid balances will not be held indefinitely and may be permanently deleted if payment is not received according to the payment terms outlined in this contract.

Session Arrival

To ensure a calm and relaxed experience, clients are encouraged to arrive 10–15 minutes early to their scheduled session.

If you anticipate being late, please notify your photographer as soon as possible.

Photography sessions are carefully scheduled to respect the time of all clients. Late arrivals may impact the available session time.

• 10+ minutes late: A $30 late fee will apply. Your photographer will continue the session for the remaining scheduled time.
• 20+ minutes late: A $60 late fee will apply. Depending on the photographer’s schedule, the session may still proceed; however, this cannot be guaranteed.

If arrival exceeds 20 minutes, the session may be considered a no-show, and a new $200 retainer will be required to schedule a future session.

For the purposes of timing, arrival is defined as the moment the client is fully prepared and ready for the first photograph to be taken.

Photography Package Selection & Payment

Full payment of your selected collection must be received prior to the beginning of your photography session.

If payment has not been received at least one hour before the scheduled session start time, the session will be cancelled and the retainer will be forfeited.

Please allow adequate time for payments to process when submitting electronic payments.

Andriana Dyakova Photography cannot begin the retouching and editing process until all payments, including any additional purchases made during the session, have been received in full.

Payments can be made by credit cards, Zelle (using dyakova@mail.com), Venmo, check or cash.

Clients are kindly asked to notify Andriana Dyakova Photography by email once payment has been sent.

Session Location

Newborn sessions are available either in the studio or in the comfort of your home.

• Studio Sessions take place at the Oceanside studio in a calm, minimal environment designed for fine-art newborn photography.

• In-Home Sessions are available for an additional $300 travel and setup fee. This option allows families to enjoy a beautifully styled newborn session within their own home while the photographer brings a curated selection of props, wraps, and styling elements.

Rescheduling & Cancellation

If illness or an unexpected circumstance arises, please notify the photographer as soon as possible.

Clients are permitted one complimentary rescheduling if the request is made at least 48 hours prior to the scheduled session time.

Additional rescheduling requests may require a new retainer.

Andriana Dyakova Photography reserves the right to reschedule a session if necessary due to illness, emergency, or unforeseen circumstances. In such cases, every effort will be made to arrange a mutually convenient new date.

Illness Policy

The health and safety of newborns and families is extremely important.

If anyone in the household or in close contact with those participating in the session experiences symptoms of illness — including congestion, coughing, fever, sneezing, or sore throat — within 10 days prior to the scheduled session, the session must be cancelled.

In these situations, the retainer will be refunded.

If a client or household member is diagnosed with COVID-19 or influenza within five days after the session, the photographer must be notified immediately so appropriate precautions can be taken.

If the photographer becomes ill, every effort will be made to reschedule the session at the earliest mutually convenient date.

Electronic Devices During Sessions

In order to maintain a calm environment and allow the photographer to focus fully on creating beautiful images, personal cameras, phone photography, and video recording are not permitted during the session unless prior approval has been given.

Andriana Dyakova Photography is not obligated to allow additional recording devices during a session.

Photography Style

Professional photographer Andriana Dyakova cultivates her own personal style and provides unique props. She is not able to accept requests to copy the work of other photographers. Please review her beautiful portfolio before booking services.

Please understand that family & kids, newborn, maternity and wedding photography is an art, subject to the creativity of the photographer and her personal artistic style. When you select Andriana as your photographer, you have chosen her because of her photographic style, and you grant her the right to exercise her creativity in the interest of providing you with wonderful finished work consistent with her personal portfolio style.

Andriana Dyakova Photography has creative control over poses and is unable to manipulate your child's facial expressions - she works to capture your baby's natural facial expressions whether sleeping or awake.

Andriana Dyakova has the final say in the finished product that is delivered to you to complete your contract with her. Unfortunately, no refunds will be granted for work completed, and reshoots are not possible.

Image delivery

Andriana Dyakova Photography delivers images that have been edited to the highest professional standard in the style of her own portfolio. Every image is individually custom color corrected. This includes removal of blemishes and flaking skin; skin retouching, and adjustment of temperature & tint, exposure, contrast, sharpness; tone curve adjustment and specific color adjustments.

Not included in your package: Hair color changes or adjustments, removal of extreme scarring, laugh lines, nail color & filing, fake eyelashes, dress adjustments and body-shaping, etc.

All digital images will be provided within three (3) weeks of the session date. The gallery delivery timeframe begins once the full balance has been paid.

Your images are delivered in high resolution, thoughtfully prepared for printing at the professional photography lab of your choice.

Please note that while every image is carefully edited with attention to tone and detail, Andriana Dyakova Photography is not responsible for the final results produced by third-party printing labs, as quality may vary depending on the lab and materials selected.

No refunds are possible once a digital package has been delivered.

Raw images

Andriana Dyakova Photography does not deliver images that have not been edited to the highest professional standard and to the style of her portfolio.

Raw images are not provided or stored and will not be provided under any circumstances.

Photo retouching of Delivered Images

Requests for additional retouching must be made within 24 hours of receipt of your finalized images from Andriana Dyakova Photography. After that time, your contract will be considered officially complete and no further changes will be made.

Andriana Dyakova Photography has the right to refuse any requested edits to the images.

Additional Retouching: $50+ per photo.

Image Copyright/Model Release

The copyright for the photographs provided remains with Andriana Dyakova Photography.

Andriana Dyakova Photography strongly encourages sharing images and links online from the official Andriana Dyakova Photography website and social media accounts so that your (Client) friends and family can see your family’s beautiful images!

The images taken by Andriana Dyakova are for personal use and for you (Client) and your friends and relatives. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from Andriana Dyakova Photography.

Andriana Dyakova Photography retains the copyright on all images and reserves the right to use the images for advertising, display, publication, social media and/or other purposes for our portfolio.

Digital files and previews remain the exclusive property of Andriana Dyakova Photography. These images may not be used for profit, commercial endeavors, professional display, or in any competition.

Copying, taking screenshots, saving or scanning images from the galleries on the Andriana Dyakova Photography website, or associated social media sites is considered stealing, regardless of the intent for use. You (Client) agree to be invoiced and pay for the cost of EACH digital image used by you (Client, friends, relatives) in an unauthorized way at Andriana Dyakova Photography’s current price per digital file.

By signing this contract, you attest that you (Client) have the authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the photographer in the event of litigation arising out of such use.

Liability:

You (Client) are aware that when you choose to print your images through a personal chosen lab that the quality of the end result print of the digital files delivered is not under the control of the photographer. Andriana Dyakova Photography is free from any liability for any potential claims whatsoever based upon discoloration in the end result.

If Andriana Dyakova Photography cannot fulfil this contract due to fire or other reasons beyond the control of the photographer, or due to the photographer’s illness or emergency, then the photographer shall return any retainer or sitting fee to you (Client) but shall have no further liability with respect to the contract. This limitation on liability shall also apply if the event of photographic materials is damaged without fault on the photographer. The client releases any and all employees of Andriana Dyakova Photography from all liabilities, claims and damages that may result from any accidents or incidents that could have been prevented that may happen during the session.

Andriana Dyakova Photography is not responsible for any injuries of participating parties that may occur during a photography session. You (Client) will be responsible for yourself, your children and any other participating family members/individuals and release Andriana Dyakova Photography from any claims against their person or their business. 

Signatures

By signing this contract, you agree that you have read and understood each section of the contract.

You are also agreeing not to copy, save, or reproduce images in anyway other than backing up your digital files. This includes copying and saving images from website, social media, or any form of advertisement.
