Assumption of the Risk and Waiver of Liability Relating to

Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

A Click Above, LLC has put in place preventative measures to reduce the spread of COVID-19; however, cannot guarantee that you, your family or your pet(s) will not become infected with COVID-19.

Further, attending classes and/or events at A Click Above, LLC could increase your risk and your family or pet (s) risk of contracting COVID-19.

I attest to the best of my knowledge, I do not have Covid-19 at the time of attending A Click Above, LLC classes or events and understand the risks of unknowing exposure to this and other illnesses by myself, my family, other participants and third parties. I have not been tested and found positive; I am not waiting for test results and do not have symptoms. I agree I will not knowingly expose others to any contagious illness I may be at risk to have. I will follow all A Click Above, LLC rules and requirements to reduce exposure and the possibility of contracting or spreading the virus. I will fully cooperate with and follow any City, County, or State guidelines that have jurisdiction in the area in which the classes or events are taking place. If any of the above should change during the completion of class session or event that is the subject of this consent, I will inform A Click Above, LLC and proceed according to the new information.*

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my family, pet(s) and I may be exposed to or infected by COVID-19 by attending classes and/or events and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at A Click Above, LLC may result from the actions, omissions, or negligence of myself and others, including, but not limited to, A Click Above, LLC partners, instructors, and class participants and their families. *

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my family, pet(s) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my family or pet(s) may experience or incur in connection with my attendance at A Click Above, LLC or participation in classes (“Claims”). On my behalf, on behalf of my family and pet(s), I hereby release, covenant not to sue, discharge, and hold harmless A Click Above, LLC, its partners, instructors, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of A Click Above, LLC, its partners, instructors, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any A Click Above, LLC classes or events.*

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

FOR PARENTS/GUARDIANS OF PARTICIPANT OF MINOR AGE (UNDER AGE 18 AT TIME OF REGISTRATION)

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liability incidents to my minor child’s involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF A CLICK ABOVE, LLC, to the fullest extent permitted by law.
