PHOTOGRAPHY SERVICES AGREEMENT
(Maternity • Newborn • Cake Smash • Family • Wedding • Other Photography Services)
This Agreement is entered into between:

1. BOOKING & PAYMENT
A non-refundable 30% retainer/session fee is required to secure all bookings.
The remaining balance may be paid on or before the session date, unless otherwise stated in writing.
Wedding photography requires full payment no later than [7 days] before the wedding date.
Sessions will not proceed if payment terms are not met.
2. RESCHEDULING & CANCELLATIONS
Maternity, Family, Cake Smash & Other Sessions
One reschedule is permitted with at least 48 hours’ notice.
Additional reschedules may incur a fee.
Cancellations result in forfeiture of the retainer.
Newborn Sessions
Booked tentatively based on due dates.
Dates may shift once baby arrives.
Retainer remains non-refundable if cancelled.
Wedding Photography
Wedding retainers are strictly non-refundable.
Date changes are subject to availability.
If the Photographer is unavailable on the new date, the retainer is forfeited.
3. SESSION CONDUCT & SAFETY
Safety is prioritised at all times, especially for newborns and children.
The Photographer may decline poses or setups deemed unsafe or impractical.
The Photographer is not responsible for outcomes affected by:
Child behaviour
Guest cooperation
Weather
Venue restrictions
Time delays beyond the Photographer’s control
4. SPECIAL REQUESTS (VERY IMPORTANT)
Any special poses, backgrounds, outfits, styling, or must-have images must be communicated before the session or event.
Requests made on the day or after the session are not guaranteed.
The Photographer is not obligated to recreate images seen online or on social media.
5. FAMILY & SIBLING PARTICIPATION
Immediate family members and siblings are permitted in maternity, newborn, and family sessions.
No special setups, extended posing, or styling are included unless booked.
If a dedicated family setup is required, a separate family photoshoot must be booked and paid for.
6. WEDDING & EVENT COVERAGE
The Client understands that weddings and events are live, uncontrolled environments.
The Photographer cannot guarantee specific moments, poses, or guest participation.
A shot list may be provided, but artistic discretion applies.
Delays caused by the Client, guests, or venue may reduce coverage time without refund.
7. CREATIVE STYLE & EDITING
The Client acknowledges they are booking the Photographer based on their portfolio and editing style.
Editing style, tones, and colour grading remain consistent with the Photographer’s brand.
Colour Changes
Colour changes are complimentary and limited to two (2) images only.
Additional colour changes or revisions may incur a fee.
Colour changes may be declined if they compromise image quality.
8. IMAGE SELECTION & DELIVERY
Clients may select the images they want edited, based on their package inclusions.
The Photographer does not guarantee a minimum number of images beyond the package.
Delivery timeframe is [2–3 weeks], depending on service type.
Additional images or edits incur additional charges.
9. RAW & UNEDITED IMAGES
RAW files and unedited images are not provided under any circumstances.
10. CAKE SMASH – CAKE & ALLERGIES
Cakes are supplied by the Client.
This policy exists due to allergies and dietary requirements.
The Photographer accepts no responsibility for reactions to client-supplied food.
11. CLIENT RESPONSIBILITY
Clients must arrive on time.
Late arrivals may result in reduced shooting time without refund.
The Photographer is not responsible for missed images due to:
Lateness
Lack of cooperation
Distractions
Unforeseen circumstances
12. COPYRIGHT & IMAGE USAGE
All images remain the copyright of the Photographer.
Clients receive a personal-use licence only.
Images may not be altered, filtered, or edited by the Client.
Commercial use requires written permission.
13. MODEL RELEASE
Unless requested otherwise in writing, the Client grants permission for images to be used for:
Portfolio
Website
Social media
Marketing and promotional materials
14. REFUNDS
No refunds are provided for:
Change of mind
Dissatisfaction with editing style
Child behaviour or guest cooperation
If the Photographer cancels due to unforeseen circumstances, a refund or reschedule will be offered.
15. LIMITATION OF LIABILITY
The Photographer is not liable for circumstances beyond their control.
Liability is limited to the amount paid under this Agreement.
16. GOVERNING LAW
This Agreement is governed by the laws of Queensland, Australia.
17. AGREEMENT
By booking, the Client confirms they have read, understood, and agreed to these terms.
