A Must Know About Website Privacy & Website Accessibility.
  •  -
  • Privacy Policy

  • Several privacy laws require certain websites to have a Privacy Policy.

A Privacy Policy is a statement provided on a website that explains how you collect, use, and disclose personally identifiable information (PII).

Any website that has as little as a contact form is collecting Personally Identifiable Information (PII) and should have a Privacy Policy.

Several privacy laws are now in place to protect the Personally Identifiable Information of citizens of certain states with fines that can reach $2,500-$7,500 per website visitor.

In addition, more and more states are proposing their own privacy laws, each with their own unique requirements and penalties for not complying. Some of these bills would enable citizens to sue businesses for simply having a contact form without an updated Privacy Policy. Several states make note that businesses of any size and any location will have to comply or may face fines or lawsuits.

What can you do to get protected?

If you do not have the budget to hire a privacy attorney to create and keep your policies up to date, we recommend using Termageddon.

Termageddon is a comprehensive website policies generator and will update your website policies when privacy laws change, helping you stay compliant and avoid fines and lawsuits, and they do it at a fraction of the cost of a privacy attorney.

A Termageddon license includes a set of policies (Privacy Policy, Terms of Service, Disclaimer and more) to help ensure your website and business is protected. If Termageddon sounds like a good solution for your business, the license costs $99/year, and we are charging a one-time setup fee of $100 to create the policy pages, insert/test the code and ensure your policies stay up to date with changes to the law. You will have full access to your policies with your own Termageddon account, and you will be notified when new laws go into effect and when your policies are being updated or when new disclosures require additional questions that need to be answered.

No matter what you decide to do with your website, we ask that all of our clients sign the Websites Policies Waiver form on the next page.

  • Policies Waiver

  •      All clients on any of Cre8 My Site's plans get a Termageddon Privacy Policy. Termageddon is a SaaS (Software as a Service) company that offers Auto Updating privacy polices for their clients. You can elect to not have Cre8 My Site handle your privacy policy for you and you can handle it yourself, but this will not effect the amount you pay each month.

By signing this waiver, or submitting this form you acknowledge that we informed you that applicable (state, national, or international) law may require your website to have a Privacy Policy. We are not attorneys, we do not provide Privacy Policies as a service, and we are not responsible for your business complying with any applicable privacy laws.

However, we have an affiliate relationship with a third-party privacy policy and terms and conditions generator service and we are able to assist you with linking those contracts to your site’s home page. You are under no obligation to utilize Termageddon, there are other generators available, but Termageddon is the one with which we have an affiliate relationship (receive a commission fee, if you decide to purchase) and recommend. Please note, should you choose to use Termageddon’s services, your relationship will be directly with them, governed solely by their Privacy Policy and terms of service.

  • Website Accessibility

In Accordance with The Americans With Disabilities Act of 1990
  • WHAT IS ADA COMPLIANCE?

A.D.A compliance is a law that was passed in 1990 preventing any discriminatory acts of any kind to individuals with a disability. You can read more about the act HERE

How does this effect my business?

Most businesses will fall under Title I and Title III of the Americans with Disability Act of 1990.

    • Title I  - You can read about Title I HERE . This title refers to Employment. If your business employees more than 14 individuals and you operate more than 20 weeks a year. Your compliance is required. You will not be allowed to discriminate against any employee who has a disability of any kind. You also must make reasonable accommodations for said employees so that their job performance is not hindered because of their disability.
    • Title III  - You can read about Title III  HERE . This Title refers to Public Accommodations and Commercial Facilities. This is the title that will most likely be utilizing services from Cre8 My Site. However, we accept any and all clients. This title is what governs small businesses that offer a service to the public. You as a business are not allowed to discriminate against any person(s) with a disability, and must attempt to make all reasonable accommodations to assist those people(s) with your services.
What does that mean for your business?

It means you are equal. It means you will not tolerate any employee or representative for your business that may be discriminating against anyone with a disability. It means you CARE.

You are a business that not only desires their business, but you will assist them in any possible way to help them with their services that they may need.

    How can we help?

Your desire to not only help, but to remain compliant is vital to the success of your business. It shows that you are compassionate towards all individuals who may need your services, or wish to be employed by your business. At Cre8 My Site we offer two (3) tools for all of our clients to assist in remaining complaint.
