THE PARTIES TO THIS AGREEMENT AGREE AND ACKNOWLEDGE THAT THIS RELEASE INVOLVES INTERSTATE COMMERCE AND THAT ALL DISPUTES ARISING UNDER THIS AGREEMENT SHALL BE RESOLVED THROUGH BINDING ARBITRATION PURSUANT TO THE SOUTH CAROLINA UNIFORM ARBITRATION ACT, AS MODIFIED HEREIN.

CAROLINA UNIFORM ARBITRATION ACT, AS MODIFIED HEREIN.

1. Pet care services will be provided at the rate provided by Baxter’s Bed

& Biscuit upon receiving and reviewing this form. Rates for subsequent services are subject to change. Fees for services are due prior to owner’s departure. Accepted forms of payment are cash, check, or PayPal.

2. Scheduling & Visit Times: Bookings made in less than 24 hours

notice are subject to a $20 last minute booking fee for pet sitting, dog walking. Baxter’s Bed & Biscuit, LLC will visit at the requested times as close as possible. However, if we are caring for multiple pets, the times may be shifted a little to accommodate our clients. We will do our very best to arrive at the appointed times. If your target time is 7:00PM, we may come as early as 6:00 PM, or as late as 8:00 PM. 3. The owner is solely responsible for any harm caused by their pet while their pet is in Baxter’s Bed & Biscuit Services. Baxter’s Bed & Biscuit LLC, its owners, employees, representatives, or any person affiliated with the company shall not be held liable any health problems, illness or injury including death, that may result from another pet, or action or inaction of a Baxter’s Bed & Biscuit, LLC owner employee, representative or visitor. 4. Client authorizes Baxter’s Bed & Biscuit, LLC to perform pet care services as outlined in this contract, and Veterinary Release, which

shall become part of this contract. Prior to any future pet care services Client agrees to notify Baxter’s Bed & Biscuit, LLC of any changes to the information on these forms.

In My Home Boarding: Pick up and drop off times are between 8am

and 5:30pm. Special arrangements may be made ahead of time but are

at the discretion of Baxter’s Bed & Biscuit, LLC. Client agrees to

notify Baxter’s Bed & Biscuit, LLC via TEXT message or email

regarding ETA for both pick up and drop off and adhere to those

6. Emergency Care: In the event that pet(s) being cared for require

immediate medical attention, Baxter’s Bed & Biscuit LLC will attempt to contact the Client prior to obtaining emergency care. However, Client agrees that pet sitter has the authority to act in pet’s best interest even if this means seeking medical attention prior to notifying Client. Client agrees to that all such services should be the responsibility of the client. Client agrees to reimburse Baxter’s Bed & Biscuit LLC for any additional fees and/or expenses incurred while tending to emergency or veterinary care within 7 days. All unpaid accounts shall bear interest of 3.5% per month until paid in full. 7. Inclement weather/Natural disaster/Act of War: In the event of inclement weather, natural disaster, or act of war Baxter’s Bed & Biscuit LLC is entrusted to use best judgment in caring for pet(s Client recognizes that in the event of inclement weather, natural disaster, or act of war Baxter’s Bed & Biscuit LLC reserves the right to alter services outlined in this contract. In the event of an emergency, Baxter’s Bed & Biscuit LLC has requested on your contract the name and phone number of a person living nearby. If Baxter’s Bed & Biscuit LLC is physically unable to reach your home due to impassable roads, please provide us with this information so that we can contact this person to request assistance. If an evacuation occurs, your pet(s) may be transported to the designated “Safe Zone Location” outside of Charleston, SC. Your Revised 5/15 3 pets’ health and well-being is our utmost concern and we will contact you as soon as possible to keep you informed of these events. 8. Fences: Fenced in yards are wonderful playgrounds for our dogs and allow them additional space to exercise and play. However, no fence system is totally secure. Baxter’s Bed & Biscuit LLC does not accept responsibility or liability for any client’s animals that escape or become lost or injured, fatal or otherwise, when instructed to leave the clients animals in a fenced in area. This includes electronic, wood, metal or any other type of fence.

9. House Cleanliness: Baxter’s Bed & Biscuit LLC will not be responsible for house maintenance or cleaning up after your pet. If your pet is unattended and causes damage or dangerous and unsanitary conditions in your residence during your absence, Baxter’s Bed & Biscuit, LLC is expressly authorized to hire a professional cleaning service at your expense. 10. Household Emergencies: Please leave the name and number of a trusted maintenance company or a person you can rely on to attend to any household emergencies that may arise during your absence. This includes but is not limited to; leaking pipes, malfunctioning water heaters and heating and air units. 11. Personal Emergency: In the event of personal emergency or illness of pet sitter, Client authorizes Baxter’s Bed & Biscuit LLC to arrange for another qualified person to fulfill agreed upon responsibilities as set forth on this contract. Client will be notified in such case. 12. Returned Check Charges: There is a $45 fee for all returned checks. 13. Late Payments: There is a 3.5% late charges fee per month for all late payments. Payments are considered late if not received at the time of the first visit. There is a 3-day grace period following the date of the last visit before 3.5% late fees are charged. After 90 days all unpaid charges and fees will be submitted to collections. 14. Extra Services/Unforeseen Purchases: Any additional necessary costs such as food, litter, cleaning supplies or other necessary items that contribute to the health and well-being of your pet will be purchased by Baxter’s Bed & Biscuit LLC. Any charges for unplanned services will be due within 7 days of completion of service engagement. Invoice for additional charges (including receipts) will be left at Client’s home upon completion of service engagement. A $25 trip fee will be applied. 15. Confirmation: Client agrees to review official confirmation provided by Baxter’s Bed & Biscuit LLC prior to departure date. Client agrees to call, text, or email Baxter’s Bed & Biscuit LLC prior to departure if no confirmation has been received or if there is an error in the confirmation. If Client expects to arrive home earlier or later than planned, Baxter’s Bed & Biscuit LLC must be notified as soon as possible. Client is responsible for contacting Baxter’s Bed & Biscuit LLC upon arrival home to ensure the safety of their pets. If Baxter’s Bed & Biscuit LLC is not contacted, resulting in a sitter being sent to your home and you are present, you will still be charged the full cost of the pet sit. Baxter’s’ Bed & Biscuit LLC will continue pet sitting

services until owner arrival has been confirmed at the owner’s expense. 16. Early Returns/Last Minute Changes: It is not unusual for trip plans to change at the last minute. However, please understand that Baxter’s Bed & Biscuit LLC carefully schedules our time to service you and our other clients. Therefore, there are no refunds or credits for early returns or changes made within 24 hours to the start of pet care on non-holidays. Changes made outside of 7 days prior to holiday sits will be no less than the original fee for scheduled services.

Pet Sitting: Client agrees to make payment in full 7 days prior to the beginning of pet sitting services. Baxter’s Bed & Biscuit accepts cash, checks, & PayPal. Please make all checks payable to Erika Lloyd. 18. Overnight Pet Sitting: Non-Holiday Payment Policy: A 50% deposit is due to hold all overnight appointments at the time of booking. New Clients of Baxter’s Bed & Biscuit LLC must pay in full at the time of booking. Remaining balance is due 7 days prior to the start of services. Holiday Payment & Cancellation: Full payment is due at time of booking in order to confirm a holiday appointment.

Pet Sitting: Non-Holiday: Baxter’s Bed & Biscit LLC requires a 48 hour notice of cancellation for pet sitting or boarding. Less than 48 hour notice will result in the Client being billed for 50% of the fee for booked services.

Pet Sitting: Holidays: Holiday fees will be applied to services scheduled: the week prior to Christmas through New Years Day, Easter, Memorial Day, July 4th, Labor Day and Thanksgiving. Cancellations with less than a seven day notice for services scheduled on a holiday will not be refunded the 50% deposit of the total invoice for scheduled pet care. Cancellations made less than 72 hours will still be charged the full amount of originally scheduled services. We request your understanding that Holiday travel is a peak service time for pet care.

Pet Sitting: Holiday Deposit: A 50% deposit is required at the time of booking to reserve all pet sitting services scheduled on a holiday. All balances will be due 7 days prior to the start of services.

Cancellations for Mid-Day Service: A 24-hour notice is required prior to the next scheduled visit. Otherwise payment is due for the time originally agreed upon.

20. Photography: I consent of photographs or recording of my dog being used by Baxter’s Bed & Biscuit LLC for the purpose of promoting any company of Baxter’s Bed & Biscuit LLC without compensation being due to me. I release all rights I may possess to said images, or recordings to Baxter’s Bed & Biscuit LLC. 21. Liability: Baxter’s Bed & Biscuit LLC, its employees and/or independent contractors, agrees to provide the services in a caring, responsible manner. The client waives and relinquishes any and all claims against Baxter’s Bed & Biscuit LLC, its employees and/or independent contractors, except those arising from gross negligence of the pet sitter. Client agrees to notify Baxter’s Bed & Biscuit LLC of any concerns related to agreed upon services within 24 hours of return home. 22. Emergency contact: Client agrees to provide Baxter’s Bed & Biscuit LLC with contact information where he/she can be reached while away. Client will also provide a name and phone number of someone who is authorized to handle any major problems that may arise. If Client or designated contact person cannot be reached in a timely manner, Client agrees that Baxter’s Bed & Biscuit LLC may resolve emergencies at its sole discretion. 23. Visitors: If anyone will be entering Client’s home while it is under our care, Client agrees to notify Baxter’s Bed & Biscuit LLC. We will not enter an occupied home if we have not previously been mae aware of visitors. Similarly, unless we receive instructions from Client, we will not grant access to the home to any visitors. Baxter’s Bed & Biscuit LLC will not be held responsible for any damages incurred to Client’s home or pet(s) by visitors. It is understood that anyone with access to the home will be notified of Baxter’s Bed & Biscuit LLC presence and vice versa. The police will be called, without exception, on all intruders or suspicious acts.

24. Outdoor Access: Baxter’s Bed & Biscuit LLC will not be held liable for

the well-being or actions of any pet with unrestricted or unsupervised access to the outdoors. 25. Aggressive Pets: If a pet has a history of biting or other aggressive behavior, Baxter’s Bed & Biscuit LLC reserves the right to refuse or cancel service. The owner will be liable for the pet sitter’s medical

expenses and/or damages that are the result of an animal bite or injury or destruction to home due to pet’s aggressive behavior. 26. Vaccinations: Client agrees to provide Baxter’s Bed & Biscuit LLC with proof of current vaccinations for all pets. Should pet sitter be bitten or otherwise exposed to any disease or ailment received from Client animal(s), Client agrees to pay all costs and damages incurred. 27. Future Services: Client authorizes this signed contract to be valid for future services without additional signed contracts or written authorization. 28. In the Event Your Pet Should Need Immediate Medical Attention: In the event that pet(s) being cared for require immediate medical attention, Baxter’s Bed & Biscuit LLC will attempt to contact the Client prior to obtaining emergency care. However, Client agrees that pet sitter has the authority to act in pet’s best interest even if this means seeking medical attention prior to notifying Client. Client agrees to that all such services should be the responsibility of the client. Client agrees reimburse Baxter’s Bed & Biscuit LLC for any additional fees and/or expenses incurred while tending to emergency or veterinary care within 7 days. All unpaid accounts shall bear interest of 3.5% per month until paid in full. After 90 days all unpaid charges and fees will be submitted to collections.

29. Arbitration and Jurisdiction: All parties to this agreement agree that

the exclusive jurisdiction for the resolution of all disputes arising in any manner concerning this agreement or any addendum to or extension of same shall be in the State of South Carolina, County of Charleston and that South Carolina Law shall govern all such matters. Any arbitration between the parties shall be conducted in Charleston County, South Carolina. In the event the parties cannot agree upon a single arbitrator, each shall appoint an arbitrator who must be a member of the Charleston County Bar Association, having at least ten (10) years experience in general business or real estate matter. The arbitrators so appointed shall agree upon a third arbitrator. In the event that the arbitrators so appointed by the parties cannot agree upon a third arbitrator, the presiding Circuit Court Judge of Charleston County shall appoint a third member of the arbitration panel. Each party shall bear its own costs incurred in the course of said arbitration, including the payment of the arbitrator’s fees and expenses, however, the prevailing party shall be entitled to an award of all costs, expenses, and attorney’s fees incurred at the discretion of the panel.

30. Limitation on Liability: The parties expressly agree that the maximum liability of Baxter’s Bed & Biscuit, LLC to its customers, clients and pet owners shall be, under all circumstances, the fees paid by customer, client or pet owner to Baxter’s Bed & Biscuit LLC. 31. No Insurance: Client acknowledges that Baxter’s Bed & Biscuit LLC does not and shall not under any circumstances provide any insurance coverage for the benefit of owner, their property, or their pet.

By signing this contract, you acknowledge that you understand and accept the terms and conditions set forth by this agreement and the

policies of Baxter’s Bed & Biscuit LLC.
