Disclosure To Clients Regarding The Collection Of Personal Information During The COVID-19 Pandemic
This Notice describes how Massage Envy (the “Company”) collects and uses your personal information collected in relation to the Company’s COVID-19 pandemic screening procedures and instances where the Company may disclose your personal information to third parties. Clients with disabilities may access this notice in an alternative format by contacting management.
For the safety of the Company’s employees, clients, and in an effort to curb the spread of COVID-19, the Company will be collecting certain additional categories of personal information relevant to the COVID-19 pandemic during the pendency of the COVID-19 pandemic, including information such as your temperature; travel information and history; health screening questions, including whether you are experiencing related symptoms, and symptom history; information whether you have been in contact with anyone exhibiting COVID-19 symptoms, and whether you have been in contact with anyone that has tested positive for COVID-19.
Prior to the COVID-19 pandemic, businesses did not routinely measure temperatures as part of the health and safety policy. However, the EEOC, DFEH and CDC have provided guidance allowing businesses to measure temperatures as a method of checking symptoms for the protection of their employees and clientele. The Company may also ask clients questions about symptoms prior to entering a worksite. The Company is collecting this information in an effort to limit or curb the spread of COVID-19, to implement sanitary measures as necessary, to follow legally mandated procedures related to COVID-19, and to monitor and protect the health and safety of its employees, clientele, and the public.
Any disclosure of COVID-19-related information to management and employees at locations where a client that tests positive has visited will be anonymous, limited and disclosed only to the extent necessary for those employees who were in contact with the client to self-isolate, monitor symptoms, and/or get a COVID-19 test, for sanitizing purposes, or to report to relevant authorities. The result of a positive test may also be shared anonymously to third-party cleaning services to the extent that sanitizing needs to be conducted due to a positive test to protect the safety of the Company’s employees and clients. The information will otherwise be kept confidential, and the identity of the individual that tested positive will not be revealed. This will continue until we are notified by the CDC or local authorities that we are no longer at risk.
Changes to This Notice
The Company reserves the right to update this Notice at any time. If the Company needs to use your personal information for a different purpose than those it notified you about at the time of collection, the Company will provide you with notice and, where required by law, seek your consent, before using your personal data for a new or unrelated purpose. The Company may process your personal data without your knowledge or consent only where required by applicable law or regulation.
