WAIVER, RELEASE AND INDEMNITY MUST BE SIGNED BY ALL GUESTS: The undersigned acknowledges and agrees that none of Rifflin’ Hitch Lodge Limited Partnership, R.H. Management Services Incorporated, Gud Management Services Limited, Clearwater Fine Foods Incorporated or any officer, director, contractor, employee or representative of any of them,(the “Releasees”) is liable for any personal injury, damage to property, death or any other loss or damage of any nature whatsoever that I may suffer while en route to or from Rifflin’ Hitch Lodge (the “lodge”), or during my stay at the lodge, or while participating in any activity associated therewith, whether or not caused by any act or omission, negligent or otherwise. The term “activities” used herein shall include all activities, events or services provided, arranged, organized, conducted, sponsored or authorized by the Releasees and shall include, but are not limited to: fishing,boating, hiking, wildlife watching excursions, and all travel by plane, helicopter, and other water and motor vehicles. I am fully aware that the environment in which these activities are conducted involves the risk of extreme weather, immersion in cold water, hypothermia, drowning, collision with natural objects and other vessels, encounters with hunters or domestic or wild animals, including bears, negligence of other persons, becoming lost or separated from the party or guide and negligence on the part of the Releasees, including the failure of the Releasees to safeguard or protect me from such risks. I freely accept and fully assume all such risks and the possibility of personal injury, death, property damage or loss resulting there from. Without limiting the generality of the foregoing, I hereby agree to waive any or all claims that I have or may have in the future against the Releasees and to release, hold harmless and indemnify the Releasees from and against any liability, damage or loss of any nature arising from, related to, or connected with such risks or my consumption of any alcohol on or off the premises and whether provided by the lodge or not. I acknowledge and agree that the Releasees shall not be liable for any delay in transportation to or from the lodge for any reason whatsoever, or for any changes in law, regulation or policy of any sort that may affect my right to fish or retain fish. I accept and agree that it is my responsibility to be aware of and abide by all laws applicable to fishing in Canada. I agree to comply with all directions of Rifflin’ Hitch Lodge management and staff as to lawful fishing, conservation and day-to-day operations. This waiver, release and indemnity shall be effective and binding upon my heirs, next of kin,executors, administrators and representatives in the event of my death or incapacity, and any rights, duties and obligations in respect hereof shall be governed by and interpreted solely in accordance with the laws of the Province of Newfoundland and Labrador and no other jurisdiction. Any legal process relating to this waiver, release and indemnity shall be brought solely within the Province of Newfoundland and Labrador and shall be within the exclusive jurisdiction of the courts of the Province of Newfoundland and Labrador.
