Assumption of Risk, Release, Waiver of Liability, & Indemnification

EFFECTIVE July 13th, July 20th & September 7th, 2023

   
Participant/Company Nameand the Valley City - Barnes County Development Corporation and all of its directors, members, volunteers, and representatives understand and accept and hereby expressly agree that: (1) Participant acknowledges and understands that the Valley City - Barnes County Development Corporation's insurance does not cover participant and therefore acknowledges and understands the inherent risk of participating in Summer Nights on Central (herein after referred to as the "Event"), held on July 13th, July 20th and September 7th (Summer Vikes on Central) in Valley City and agrees to fully assume the risk of participation in the event. Participant also acknowledges that s/he understands the terms of this Release and that s/he may have in the future against the Valley City - Barnes County Development Corporation in connection with the condition and operation of the Event, including claims that may arise out of the Valley City - Barnes County Development Corporation’s own negligence or strict liability. (2) Participant hereby irrevocably and unconditionally waives, releases and forever discharges the Valley City - Barnes County Development Corporation and all of its directors, members, volunteers, and representatives (in their individual and representative capacities) from any and all existing and future claims, demands, liabilities, loss, causes of action, damages, expenses, costs and obligations, whether known or unknown, matured or unmatured, that in any way arise out of or relate to the Event. This waiver and release shall include any claims involving the Valley City - Barnes County Development Corporation’s own negligence and strict liability in connection with the condition or operation of the Event. (3) Participant shall indemnify, defend and hold the Valley City - Barnes County Development Corporation and all of its officers, directors, members, volunteers, and representatives (in their individual and representative capacities) harmless against all third party claims and expenses, including legal expenses and reasonable attorneys’ fees, arising out of or related to Participant’s acts or omissions during the Event or any other matter or circumstance related to Participant’s participation in the Event.
