THE CUSTOMER AGREES TO THE FOLLOWING: The customer, the undersigned, hereby personally guarantees, unconditionally and at all times, the payment when due of any and all indebtedness of customer to Kaplan Telephone Company, Inc. and Louisiana Competitive Telecommunications, Inc. (collective dba “Kaptel”) for the services and equipment provided pursuant to the Agreement. The undersigned waives notice of any transaction or obligation guaranteed which Kaptel may create, renew, extend, or alter in whole or part from time to time during the term of this Agreement to such customer, corporation, partnership or other entity.
NOTICE TO CUSTOMER: All Services are provided subject to the regulations, rates, and charges by Kaptel. You acknowledge and agree that the Plan is non-cancelable for the above selected Contract Term Length duration. In the event you terminate the services prior to the end of this agreement, Customer will be obligated to pay Kaptel a termination fee equal to the nonrecurring charges (if unpaid) and One Hundred Percent (100%) of the monthly recurring charges for the terminated Service(s) multiplied by the number of full months remaining in the Term. This provision survives termination of the Agreement. You will also be required to pay any promotions, installation charges or remainder of installation charges subsequently given prior to cancellation of service. The monthly total billed regulated charges consists of end-user monthly billed Kaptel regulated charges at qualifying locations excluding: non-Promotion services, non-regulated charges, taxes & charges by local, state, and federal government (including, but not limited to services for 911 service and dual party relay services); late payment charges, and charges for services provided by other companies.
After the initial term, this agreement shall automatically renew for one (1) year terms (each an “extended term”) unless a party gives the other party written termination notice at least thirty (30) days prior to the expiration of the initial term or then current extended term. “Term” shall mean the Initial Term and Extended Term(s), if any. Kaptel reserves the right to increase rates for all Services to then current retail rates during any Extended Term by providing Customer with at least sixty (60) days written notice of such rate increase. This limitation on rate increases shall not apply to taxes & charges by local, state, and federal government, and services provided by other companies. Customer’s payment for Service after notice of a rate increase will be deemed to be Customer’s acceptance of the new rate. In the event of default, and should it become necessary to employ the services of an attorney, customer agrees to pay reasonable attorney fees together with the legal rate of interest from the date of default. Applicable taxes and fees will be based on the tariff prices of all services.
We require you to provide the physical address where you will be using our service for 911 purposes. Please note that our 911 Dialing service will not function in the event of a broadband or power outage or if your broadband, internet service is terminated. For Managed Voice Services, customer will not move this device to another location. Only a certified Kaptel employee can move any devices. Kaptel shall not be responsible or liable for any failure to receive service or for failure of any 911 call if the customer removes or disconnects or fails to charge the battery backup for Managed Voice Services devices at any time. This “Agreement” includes the terms and conditions (i) on this page, including without limitation all policies and terms incorporated into this page (ii) and our Internet Terms & Policies Internet Acceptable Use Policy & Copyright Policies/Copyright Infringement Policy set forth at www.kaptel.net.
I certify that the pricing plan which I have chosen has been explained to me and that I understand the components of the pricing plan, including but not limited to the installation charge, monthly recurring charges, and equipment charges.
