    Dear General Barr:
     
    This letter is written as an urgent entreaty to you as America’s chief law enforcement officer with the authority to declare the Chinese Communist Party (CCP) as a “transnational criminal organization (TCO).”  The evidence of the CCP’s global criminality is overwhelming and proliferating throughout the United States. The CCP’s lethality and criminal sophistication demonstrates that this lawless CCP poses a clear and present danger to the health, security, and prosperity of America.
     
    The CCP transnational criminal organization designation is clearly justified by the epidemic of American citizens victimized and killed by the Chinese manufactured and transmitted lethal synthetic drug, Fentanyl. According to the CDC, deaths involving other synthetic narcotics, including fentanyl and fentanyl analogs continued to rise with more than 31,335 overdose deaths reported in 2018.
     
    This is not the only criminal enterprise epidemic generated by the CCP and killing Americans.
     
    The United States continues to suffer the debilitating health and economic effects of the Chinese corona virus epidemic as it ravages our families and society. The damning evidence points to the CCP which knowingly and maliciously failed to warn the world about the grave health danger generated by China Wuhan lab Covid-19 virus and covered up its transmission and lethality, causing over 140,000 deaths in the United States.
     
    Additionally, for decades, the CCP perpetrated and proliferated IP embezzlement and economic espionage on Americans and U.S. businesses, resulting in theft and loss of vast wealth and prosperity. The extent and breadth of the criminal reach of the CCP knows no bounds.
     
    The time is now to designate the Chinese Communist Party as a “transnational criminal organization.”
     
    President Trump’s Executive Order 13773 entitled, “Enforcing Federal Law With Respect to Transnational Criminal Organizations and Preventing International Trafficking,” authorized by the executive branch “to strengthen federal law enforcement  to thwart transnational criminal organizations that present a threat to public safety and national security.”
     
    Accordingly, on October 15, 2018, Attorney General Jeff Sessions designated 5 criminal groups as transnational organized crime threats. General Sessions also charged the FBI, DEA, OCDETF, and the Department’s Criminal Division to identify top transnational criminal groups that threaten the safety and prosperity of the United States and its allies and to vigorously investigate and prosecute these transnational crime organizations with all the available federal resources. 
     
    It is exceedingly evident that the list of transnational criminal organizations should include the Chinese Communist Party (CCP).  The pattern of  the CCP criminality in the U.S. and around the world demonstrates a clear and present threat “to public safety and national security.”
     
    On June 24, 2020 in a speech in Arizona, National Security Advisor Robert C. O’Brien warned that “the challenge the Chinese Communist Party poses to the United States and our allies is of critical importance to us right now. Let us be clear, the Chinese Communist Party is a Marxist-Leninist organization. The Party General Secretary Xi Jinping sees himself as Josef Stalin’s successor. Yes, Stalin – the man whose brutal dictatorship and disastrous policies killed roughly 20 million Russians and others through famine, forced collectivization, executions, and labor camps. As interpreted and practiced by Lenin, Stalin, and Mao, communism is a totalitarian ideology.”
     
    Mr. O’Brien boldly described the threat posed by the CCP:
     
    “The Chinese Communist Party seeks total control over the people’s lives. This means economic control, it means political control, it means physical control, and, perhaps most importantly, it means thought control.”
     
    Mr. O’Brien focused on the array of economic crimes engaged in by the CCP against American citizens and corporations. O’Brien sounded the alarm to Americans, “when the Chinese Communist Party cannot buy your data, it steals it.” The National Security Advisor cataloged a stunning compilation of economic and privacy criminal theft by the CCP:
     
    -In 2014, the CCP hacked Anthem insurance, collecting sensitive information on 80 million Americans.
     
    -In 2015, the CCP hacked the Office of Personnel Management, which holds security clearance information, acquiring sensitive data on 20 million Americans who work for the federal government.
     
    -In 2016, a Chinese company even bought the dating app Grindr to harvest its data, including the HIV status of users, before the U.S. government forced a divestiture on national security grounds.
     
    -In 2017, it hacked Equifax, obtaining the names, birthdates, social security numbers, and credit scores of 145 million Americans.
     
    -In 2019, the CCP hacked Marriott, gathering information on 383 million guests, including their passport numbers.   These are just a few of the instances we know about.”
     
     
    On July 7, 2020, FBI Director Christopher Wray raised the alarm about the threat posed by the Chinese Communist Party to the economic and national security of the United States. Director Wray stated that: “the greatest long-term threat to our nation’s information and intellectual property, and to our economic vitality, is the counterintelligence and economic espionage threat from China.”
     
    According to Wray, the level of CCP criminality is so widespread and voluminous that, “the FBI is opening a new China-related counterintelligence case about every 10 hours and of the nearly 5,000 active FBI counterintelligence cases currently underway across the country, almost half are related to China.”
     
    Director Wray unequivocally identified the source of this economic espionage, malignant foreign influence, and menacing threat to the rule of law to America.
     
    “When I speak of the threat from China, I mean the government of China and the Chinese Communist Party.”
     
    The FBI Director detailed specific cases of CCP criminal intrusions, assaults, intimidation, IP theft and a vast array of malignant and illegal actions against the people, businesses, and government of the U.S. Mr. Wray warned about the lingering influence that “China, as led by the Chinese Communist Party is going to continue to try to misappropriate our ideas, influence our policymakers, manipulate our public opinion and steal our data.”
     
    Without specifically designating the Chinese Communist Party as a TCO, the FBI Director demonstrated a compelling and forthright argument to designate the Chinese Communist Party as such.
     
    Similarly, on July 8, 2020, at a press conference Secretary of State Michael Pompeo called out the CCP for the enormous dereliction of duty to tell the world the truth about the Covid-19 virus which has resulted in 130,000 U.S. deaths and 500,000 deaths globally.
     
    “I want to start today with the Chinese Communist Party.” The CCP has an enormous credibility problem.  They failed to tell the world the truth about this virus, and now hundreds of thousands of peoples all across the world are dead.  We need the truth; we still need the truth.  This is about science, not politics, and the Chinese Communist Party needs to come clean with the world about this virus.”
     
    Secretary Pompeo described the ongoing deception by the CCP regarding the virus and the forced internment camps:
     
    “Beijing claimed for months that it reported the outbreak of the virus to the WHO.  Now we know that’s not true, too.  We know that the WHO’s Country Office in China reported the outbreak only after it picked up a media statement from the Wuhan Municipal Health Commission.
    Again, Beijing describes Xinjiang’s internment camps as vocational training camps.  New reports of forced abortions and sterilizations add to a body of evidence that contradicts that.”
     
    On July 9, 2020, as a result of those violations of human rights, Secretary Pompeo announced that the Trump administration would bar entry into the U.S. of Chen Quanguo, the Communist Party’s secretary of the Xinjiang Uighur Autonomous Region in northwest China and a member of the Politburo; Zhu Hailun, party secretary of the Xinjiang political and legal committee; and Wang Mingshan, party secretary of the Xinjiang public security bureau.
     
    Those travel restrictions were in response to the “unjust detention or abuse” of Uighurs, ethnic Kazakhs and members of other minority groups in Xinjiang, in the western part of China, Pompeo said.
     
    In March of 2020, the comprehensive and independent report and findings of the China Tribunal declared that the CCP’s campaign of forced organ harvesting against innocent victims is a “crime against humanity,” constituting one of the world’s “worst atrocities committed” in modern times.
     
    Finally, with the recent passage of a dangerous Chinese law which mandated infiltration of the CCP in foreign owned companies. With respect to private companies, the CCP Constitution states that party organizations (CCP) are more focused on making sure the company follows the law and overseeing organizations such as trade unions and the Communist Youth League. Essentially, this CCP law further expands the presence and role of the CCP in private foreign owned companies.
     
    The global reach and level of lethal organized criminal activity by the CCP is astonishing and demands its immediate designation and prosecution as a transnational criminal organization. Nothing less leaves Americans vulnerable to a widespread campaign of lawlessness, intimidation, and piracy by the CCP which imperils our way of life.
     
    The leadership of the Trump Administration demonstrates a heightened awareness and focused advocacy to address the insidious illegal racketeering by the Chinese Communist Party. More must be done.
     
    As the chief law enforcement officer in the nation,  we request that you designate the Chinese Communist Party (CCP) as a transnational criminal organization (TCO) and begin to swiftly implement the legal, economic and diplomatic penalties resulting from this designation. Your leadership as U.S. Attorney General ensures that Federal law enforcement agencies provide a high priority and devote sufficient resources to efforts to identify, interdict, disrupt, and dismantle this insidious transnational criminal organizations which is wreaking havoc in the United States and around the world.
     
    We believe that this great country and its bulwark of brave men and women in law enforcement will ensure the continued peace and prosperity for all Americans. In the words of President Ronald Reagan:
            
    “It was leadership here at home that gave us strong American influence abroad, and the collapse of imperial Communism.  Great nations have responsibilities to lead, and we should always be cautious of those who would lower our profile, because they might just wind up lowering our flag.”

    Thank you for your serious consideration of this request to protect America from dangerous foreign entities.
