Owner Release Contract
Toby’ Rescue is committed to the welfare of the animals and the families.

This contract allows for legal transfer of ownership to Toby’s Rescue in order for the dog to become eligible for an adoption.

AGREEMENT
Toby’s Rescue LLC (Toby’s Rescue) and The Owner/Rehoming Family agree to the following regarding the dog described above:

1) The Owner enters into this contract of their own free will and understandthat this is a binding contract enforceable by civil law.*

2) Toby’s Rescue and the Owner agree that it is in the best interests of the dog (described above) that a new loving home is found.*

3) The Owner voluntarily surrenders ownership of the above-described dog to Toby’s Rescue.*

4) The Owner represents and warrants that they are the legal owner of the dog and have the authority to surrender ownership.*

5) Microchip surrender: The Owner gives permission for the microchipcompany to clear their information and transfer the microchip to Toby’s Rescue.*

6) The Owner agrees to provide Toby’s Rescue with a copy of all the dog’s documentation, including but not limited to: medical records, vaccination records, microchipping records, birth records and ownership records with this agreement.*

7) The Owner may be required to pay a surrender fee or make a donation to Toby’s Rescue to help cover the costs associated with the care and rehoming of the dog.*

8)Toby's Rescue understands that the Owner makes no guarantees or warranties regarding the health or temperament of this dog. The Owner shall not be held liable for the behavior of this dog or any damages may cause after surrender.*

9) Toby’s Rescue uses an Adoption Application and an Adoption Contract that ensure that Adopting Family is a good match for the Rehomed Dog and that Adopting Family will care for this dog in a safe and humane manner andas a family pet and companion. The dog will have appropriate food, water, shelter, and medical care for the duration of his/her life.*

10) Toby’s Rescue has the sole discretion to determine the future adoption or placement of the dog*

11) An adoption fee will be collected from the Adopting Family at the time of the adoption. That fee will be for the use of Toby’s Rescue to help cover the costs associated with the care and rehoming of the dog. The Rehoming Family will incur no cost from adoption, unless otherwise agreed.*

12) Toby’s Rescue will keep in touch with Adopting Family and the Rehoming Family regarding Rehomed Dog’s progress in a new home.*
