CONDITIONS OF AGREEMENT:

1. The defendant has been charged with the above-named charge(s), and the city has agreed that a plea in abeyance agreement would serve the ends of justice.

2. Pursuant to UCA 77-2A-1 et seq., and subject to the approval of the court, the parties jointly move the court to hold defendant's plea in abeyance for a period of 60 days on the following terms and conditions:
- Defendant pleads guilty to the above charge(s) and the plea is held in abeyance.
- Defendant pays the perscribed plea in abeyance fee to the court at the time this agreement is entered into.
- Defendant shall register for online traffic school within 30 days from the date of the citation and pay the non-refundable traffic school fee. NO EXTENSIONS will be granted.
- Defendant shall complete traffic school within 45 days from the date of the citation.
- Upon proof of compliance with this agreement, charge(s) will be dismissed.
- If you fail to comply, an order to show cause may issue, ordering you to appear in court and show good cause why you failed to comply with the terms of the plea in abeyance agreement. Your plea in abeyance will be stricken, a conviction entered, and the original fine imposed, pursuant to the Uniform Fine Schedule. A record of your conviction will be sent to the Driver License Division. Failure to pay the fine may result in a warrant for your arrest.
By entering into this Agreement, I hereby acknowledge that I am waiving my right to a speedy trial; my right to confront witnesses, my right to have the assistance of an attorney during all phases of the proceedings; my right against self-incrimination; and my right to have the city prove each element of the offense beyond a reasonable doubt.
