SCHEDULING & CANCELLATION POLICY

A non-refundable deposit of 50% of the session fee is required for all scheduling and bookings.  This non-refundable deposit is applied towards your session fee upon completion of the session and payment in full (unless otherwise agreed).  This contract must be signed in order to complete the scheduling and booking.  If this contract is not completed your session is not booked.

In making payment of your deposit you acknowledge that in the case of cancellation the deposit is not refundable.

All sessions must be paid in full at the time of the session.  

Please arrive on time to your session.  If you arrive over 15 minutes late to your session this will cause rescheduling and or will cut your session short and you will forfeit any deposit.

If you need to cancel or reschedule before your session, please make sure it is at least 24 hours in advance.  Less than 24 hours in advance will result in a re-booking fee (this additional fee does not apply towards any purchase).  You will not be able to reschedule twice.  For a 2nd cancellation future photography services will not be provided to you.

Emergencies can happen, if you choose to no show or cancel at the time of your scheduled session (no show/flake) there is no refund and no reschedule will be offered. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.

LOCATION COSTS & FEES

If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange payment on any location.  

The photographer has no duty to obtain permission of the reception center, churches, buildings, properties or other locations to operate therein.  The client understands and agrees that any failure to obtain these permissions resulting in fees to photographer or which prevent the photographer from photographing the event, is not the fault, liability, or responsibility of the photographer.  These permissions and fees will be obtained and paid for by the client.

For travel outside of 50 miles (roundtrip) from the photographers home in Las Vegas, NV,  there is an additional travel fee to cover gas and the photographer's time driving to and from the location.  Any location outside of these limits will be subject to mileage charge of $1.00/Mile as part of this agreement and $30 per hour to be round up to the nearest half hour for the time, unless otherwise agreed upon.  The client also agrees to reimburse the photographer for any travel expenses greater than 50 miles that requires meals and lodging if necessary.

PACKAGES, IMAGES & PROOFS

The collection price includes the time for your session; the quantity of locations; the photographer's time and talent for the session; the photographers time to edit the listed amount of edited prints and or edited digital images; the signed print release (if digitals are included); any products included with your collection; and the photographers time and talent to make those products.

Orders will not be processed until payment is received in full.  No COD, no exceptions.  

Pricing, discounts, and arrangements are only good for 30 days.  Once an order has been placed you, the client, will have 15 days to pay at least 50% of the order and one month from the date of the order to pay in full.  Late fees will accrue at $50.00 each month until full payment has been made.  

After 90 days from the photo session there will be a monthly fee to hold all photos active.  It is up to you, the client, to keep the photographer informed if this is needed.  The photographer is not responsible for any photos after 90 days.

Any graphic design is not included in the image editing.  Graphic design of any kind will be subject to an extra charge.

Additional edits of digital images will be available at the scheduled editing level fee per image.

Prints, cases, drives, albums, books, etc. Are all available at the product guide prices unless included in your collection.

No unedited/RAW images will be given, no exceptions. 

48-72 hours after your session, a watermarked proof gallery, with all unedited soft edited images from your session, will be provided to you to choose your favorite images from. These photos are not completely retouched.  This gallery is to be used as photo proof only, it is illegal to screenshot/save/share these unfinished images.

Once you have chosen your favorite images you must notify your photographer (you can easily do this by sharing your favorite images with the photographer, through the website).  Once you have notified the photographer and received confirmation, you can expect your edited digital images to be ready in 2-3 weeks unless told differently.

Upon the completion of your order, depending upon your collection purchase, high resolution images of all finished, retouched and edited watermarked images will be available for download from the website. If you choose to publish or share on social media I do request a credit or “tag” along with the posting.

Once your edited digital images are ready it is your responsibility to download and save them to your computer. Deborah Escuadro of d.e. photography by Deborah Escuadro & RedGridiron Designs  is not responsible to maintain copies of any digital file, image, or photograph. If you lose your edited digital files there is a $50 recover fee to locate and resend the lost images.  There is no guarantee to have the images saved after 1 year.  Any images requested to or out of archive after one year will accrue an additional fee.

If you ordered prints; a usb case and/or usb drive; book, album or otherwise, you will be contacted for delivery.

PAYMENT

The initial deposit is due on the day of the booking.  

Before any photography work commences, the remaining balance must be paid on the day of the photography session

COPYRIGHTS USAGES & RIGHTS TO IMAGES

Per US Copyright Law USC title 17 & International Copyright Laws, copyrights remain with the creator Deborah Escuadro of d.e. photography by Deborah Escuadro & RedGridiron Designs.

Unless copyrights are purchased and a copyright release agreement given, the images that are being provided to you are licensed to you for any personal purpose, including:  printing, copying, emailing, social media sharing, and web publishing.

Deborah Escuadro of d.e. photography by Deborah Escuadro & RedGridiron Designs retains all copyrights to all images created during the client’s session. 

A print release will be included with digital files to print portraits for personal use.  The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission.  Your license does not include use that results in financial gain, including but not limited to:  advertising, stock photography, print sale profits, or resale of any nature.

It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Deborah Escuadro of d.e. photography by Deborah Escuadro & RedGridiron Designs during the client’s photo session. This applies to any "sneak peek" images; images posted in any online gallery or proofing gallery; images posted in my blog; images posted on any of my social media accounts; or any hard copy images.  If anyone steals images via any method listed above, or any other method, they will be invoiced for the cost of each digital image they have stolen, at the photographer’s current price per digital file and or subject to prosecution.

Your purchase of any digital files releases Deborah Escuadro of d.e. photography by Deborah Escuadro & RedGridiron Designs from any liability due to loss or damage of the images, and also releases any obligation to maintain copies of any digital file, image, or photograph. Deborah Escuadro of d.e. photography by Deborah Escuadro & RedGridiron Designs retains all copyrights to the images and derivative works thereof.

No commercial 3rd party use is allowed, unless a copyright is purchased or negotiated.

Note from photographer:  I work very hard to create images that reflect you and your family, while keeping in line with my artistic vision and creativity.  I know you will want to share these images and I include a sneak-peak for that very reason.  However, I ask that you simply link back to my blog/website/social media page instead of right-clicking, saving and sharing the image via your own page.  Likewise any digital images shared on social media should retain the watermark or photo credit to Deborah Escuadro; d.e. photography by Deborah Escuadro.  I hope that you will respect not only my hard work, but my time; money; equipment and dedication to my own  training and craft to capture these images for you.  Please do not steal them!

LIABILITY

Deborah Escuadro of d.e. photography by Deborah Escuadro & RedGridiron Designs, will make every effort to produce the finest quality images possible, however, client agrees to hold harmless from all liability connected with the photography session. 

In the case of a computer failure or other cause, including negligence, or unauthorized access or publication of the client’s photos or online galleries, server failure or any situation that results in the loss or compromise of all or a portion of the photos, damages are limited to the original cost of services.

The client shall assist and cooperate with the photographer in:  obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be photographed; taking time to pose for photographs at the photographer’s direction; providing a person to guide the photographer to desired persons and/or scenes; pre-shoot consultations, etc. The photographer shall not be responsible for photographs not taken as a result of the client’s failure to provide reasonable assistance or cooperation. 

Deborah Escuadro of d.e. photography by Deborah Escuadro & RedGridiron Designs, reserves the right to refuse service to anyone.

MODEL RELEASE

I understand that the photographer owns any images from any photoshoot, unless otherwise noted through contract and copyright purchase. 

I hereby give permission for the photographer, Deborah Escuadro of d.e. photography by Deborah Escuadro & RedGridiron Designs, to have the absolute and irrevocable right and unrestricted permission concerning any photographs or video that she has taken or may take of me and or my minor child/children in which I may be included with others, to use, reuse, publish, and republish the photographs in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration; and to use my name in connection with any use if she so chooses.

I release and discharge the photographer, Deborah Escuadro of d.e. photography by Deborah Escuadro & RedGridiron Designs, from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of photographer, as well as the person(s) for whom she took the photographs.  This release shall be binding upon me and my heirs, legal representatives, and assigns.

SOCIAL MEDIA USE

I understand that the photographer owns any and all images from any and all  photoshoots, unless otherwise noted through contract and copyright purchase.

When using any of these photos on social media I will refer or link back to Deborah Escuadro's social media pages, blogs or website.  Likewise, any digital images shared on social media will retain the watermark or tagged with photo credit using any of the following tags to credit my photographer.
