  • IN CONSIDERATION OF THE BOARD OF DIRECTORS OF TOWN ARMS APARTMENTS, INC., NO. 1, A CONDOMINIUM, GIVING UNTO THE UNDERSIGNED PERMISSION TO PURCHASE OR RENT, AND OCCUPY APARTMENT NO.   *  , THE UNDERSIGNED HEREBY, AND IN CONSIDERATION THEREOF, AGREE(S) TO THE FOLLOWING:

  • OBLIGATIONS OF MEMBERS (AND/OR TENANTS):

    In addition to other obligations and duties heretofore set out in this Declaration, every condominium parcel owner or rental shall:

    1. a) Not use or permit the use of this unit for any purpose other than as a single family residence and maintain his unit in a clean and sanitary manner.

    2. b) Not permit or suffer anything to be done or kept in his unit which will increase rates on his unit or the common elements, or which will obstruct the rights or interfere with the rights of other members or annoy them by unreasonable noises or otherwise; nor shall a member commit or permit any nuisance, immoral or illegal act in his unit or the common elements.

    3. c) Conform to and abide by the By-Laws and uniform rules and regulations in regard to the use of the unit and the common elements, which may be adopted in writing from time to time by the Board of Directors of the Association and to see that all persons using the owner’s property, by, through, or under him, do likewise.

    4. d) Allow the Board of Directors or the agents and employees of the Association to enter any unit for the purpose of inspection, repair, or in case of emergency threatening units or the common elements.

    5. e) Show no sign, advertisement, or notice of any type on the common elements or his unit and erect no exterior antennas and aerials. There shall be no “for sale” signs in any form or size placed inside or outside the windows of the unit or attached to the curtains, venetian blinds, or any other part of the condominium unit.

    6. f) Make or cause no structural alteration to and in the building, specifically including, but not limited to, screening, or enclosure of private balconies and/or affixing outside shutters to windows, except storm shutters, the design and make must be approved by the Association, or removal of any additions or improvements or fixtures from the building, or do any act that will impair the structural soundness of the building.

    7. g) Make no repairs to any plumbing or electrical wiring within a unit except by licensed plumbers or electricians authorized to do such work by the Board of Directors.
      1. Plumbing and electrical repairs within a unit shall be paid for and be the financial obligation of the owners of the unit, whereas the Association shall pay for and be responsible for repairs and electrical wiring within the common elements.

    8. h) Know that parking shall be limited to passenger automobiles, station wagons, and pick up vans that don’t exceed 3/4 ton.
      1. These vehicles must be parked within the space allotted with the number corresponding to that unit.

    9. i) Not be permitted to mechanically make any adjustments whatsoever, without first obtaining the permission of the Maintenance Contractor, with reference to any of the equipment found in the meter room, boiler room, or washer and dryer room.

    10. j) Realize that the laundry room is shared by all occupants and arrange to remove clothes from the washers and dryers as soon as said machine stops, thus allowing use by others who may be waiting.
      1. If clothing is left for longer than 10 minutes after said machine stops, occupants have the right to remove laundry from machine and set in a orderly fashion on the white laundry room table.

    11. k) Know that apartments are to be occupied by:
      1. One bedroom apartments are to be occupied by no more than two (2) people
      2. Any person moving in, must be approved by the Board of Directors.
      3. Two bedroom apartments are to be occupied by no more than four (4) people.
      4. Any person staying longer than thirty (30) days per calendar year, must also be approved by the Board of Directors.
      5. Prospective occupants must submit an application for approval.
        1. The application fee for rentals and new owners is $99.99 nonrefundable.
      6. Only annual leases are permitted.
        1. A copy of the 12-month lease must be presented with the rental application.

    12. l) DISCLOSURE THAT SECURITY IS NOT PROVIDED:
      1. Owner and/or Management does not promise, warrant, or guarantee the safety or security of resident or his/her personal property against the criminal or negligent actions of other residents or third parties. Crime can and does occur at apartment communities. Each resident has the responsibility to protect himself/herself and to maintain appropriate insurance to protect his/her belongings including items within or on the premises and vehicles from criminal acts, negligent acts, fire, windstorm, hurricanes, plumbing leaks, smoke or any acts of God.  Residents should contact an insurance agent to arrange appropriate insurance for their vehicle, personal property insurance and liability insurance.

      2. No security system, controlled access gate, fence, gate, door, window, courtesy patrol or electronic security device if provided can guarantee complete protection against crime.  Even elaborate security systems are subject to mechanical malfunction, tampering, human error or personnel absenteeism, and can be defeated or avoided by clever criminals. Controlled access gates frequently are non operational as they are often damaged by vehicles, therefore, residents should always proceed on the assumption that they do not exist. Windows can be broken, locks can be defeated, and fences can be climbed or damaged to allow access. The best safety measures are those precautions that can be performed as a matter of common sense and habit.

      3. If security systems, security devices, controlled access gate(s) or walk-through services are employed at this community, no representation is being made that they will be effective to prevent injury, theft or vandalism. Such personnel, if provided, cannot physically be every place at every moment.  Usually, such personnel are unarmed independent contractors and have no greater authority under the law to restrain or arrest criminals than the ordinary citizen.  Therefore, Management does not warrant that any services, devices or persons if employed at this community will discourage or prevent breaches of security, intrusions, thefts or incidents of violent crime.  Further, Management reserves the right to reduce, modify or eliminate any system, devices or services (other than those statutorily required) at any time. Resident agrees that such action shall not be a breach of any obligation or warranty on the part of Management. Management may at time place real or dummy video or surveillance cameras throughout the apartment community but Management makes no representations that these cameras are working, recording or even operational.

      4. Resident agrees to notify Management promptly and in writing of any problem, defect, malfunction or failure of door locks, window latches, lights, controlled access gates, and any other access related device.
