A. Model Release
I hereby give Artistry by Amy and Amy Anderson the right and permission with respect to the photographs that she has taken of myself and/or my minor child:
a) To copyright the images in the photographer’s name or any other name that she may select;
b) To use, re-use, publish and re-publish photographs on social media (facebook, instagram), on the photographer's website, or in magazines, for any purpose whatsoever, including illustration, promotion, advertising and other marketing purposes;
I hereby release and discharge Artistry by Amy and Amy Anderson from any claims in connection with the use of the photographs, including any and all claims for invasion of privacy.
B. Liability
Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims for personal injury against their person or their business.
C. Copyright & Penalty
Artistry by Amy retains all copyrights to all images created during client’s session. Although Artistry by Amy provides clients with their own photos to share, download, and print as they would like, credit must be given to Artistry by Amy when doing so. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission.
RAW files and/or unedited images belong to the photographer only and will not be released to the client. Please do not apply filters or your own edits to the photos as this compromises the integrity and style of the images and the photographer's work.
Artistry by Amy and Amy Anderson have the rights to share photos from the client's session on artistrybyamy.org, facebook, instagram, and other marketing platforms. Client agrees to tag or mention artistry by amy when sharing posts or photos created by Amy Anderson or Artistry by Amy.
D. Payment
Session fee varies depending on your chosen package. Every session requires a $75 deposit and a signed contract to book your session date. The deposit is non refundable. If you need to reschedule, please do so at least 48 hours in advance. If you cancel or reschedule with less than 48 hours notice, another $75 deposit will be required to book a new session date. The remaining session fee is due at the time of the session before the session can begin. For mini sessions or promotional rates, the entire session fee is due at the time of booking in order to secure the time slot. I will make every effort to reschedule for sickness or weather, but the session fee is non refundable. I accept check, cash, venmo, or apple pay. There is a loyalty discount for reutrning clients.
E. Receiving Photographs
Artistry by Amy/Amy Anderson will deliver the digitial files, edited in high resolution, via online gallery within 2 weeks. The gallery will expire in 14 days (2 weeks) from the delivery date. It is the client's responsibility alone to download the photos and to back them up so that they do not lose access to their photos in the case of a computer or phone crash. Artistry by Amy will not re-deliver photos after the gallery has expired. If the client needs an extension on the time allotted to download photos, they must request an extension before the gallery has expired. Once the gallery has expired, the client will no longer have access to the photos if they do not download and back them up.
I work very hard to create images that reflect you and your family, while keeping in line with my artistic vision and creativity. I ask that you review my portfolio on my website (artistrybyamy.org) so that you are familiar with my photography style and editing style and know what to expect for final images. Wardrobe choice will also greatly impact the look of your final images. I ask that you review my style advice and client guide and reach out to me with any styling questions you may have prior to your session. I want to help assure that you look your best and are happy with your images. I will deliver high quality images in your gallery consistent to my photography and editing style. My edits are final and are not to be altered by the client in any way. My session fee is final and non refundable as are any professional prints ordered from the gallery.
*Sharing photos on social media: I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you. Please keep this in mind when sharing images online by giving credit to Artistry by Amy. If you are pleased with your photos, please recommend Artistry by Amy and use Artistry by Amy for future photography needs. I would greatly appreciate it if you would take the time to leave me a review on google.
*Prints: Artistry by Amy hereby releases the photos in the online gallery to the client to print from whichever consumer printing lab you choose. If you choose to order professional prints, you can do so directly from your online gallery. All print sales are final.
*** Covid -19: If you are sick or have been in contact with anyone who is ill including symptoms of a cough, shortness of breath, fever, body aches, sore throat, or other respiratory symptoms, please reschedule your session. Artistry by Amy is not responsible or liable for any illness client may be exposed to out on location for the session.
