  • This document outlines the initial and continuing obligations of Hove Village Day Nursery and yourselves, and serves as your contract with the Nursery.

     

    1.       Registration

    1.1. Applications for a place at Hove Village Day Nursery must be made by completing the official registration form.

    1.1.1. A non-refundable administration charge of £50 is payable when you submit your completed registration form.

    1.2. Hove Village Day Nursery will inform you as soon as possible, upon receipt of a completed registration form, whether your application for a Nursery place has been successful. 

    1.3. Once notified, we request written confirmation of acceptance of the Nursery place within a week.  If we do not have this confirmation in the time stated, the place may be withdrawn.

    1.3.1. Your deposit will be used against fees or charges in your final month, provided you have given 2 months' notice of your intention to leave in writing.

    1.3.2. If you later decide that you do not wish to take up your child’s place in the Nursery, we regret that we are unable to return any deposit paid.

     

    2.       Provision of Childcare

    2.1. Hove Village Day Nursery will provide childcare facilities for your child at the agreed times (on your registration form), except when the Nursery is closed i.e. Christmas, Bank Holidays, and 2 Inset days per academic year. 

    2.1.1. In the unlikely event that the Nursery is forced to close due to adverse weather conditions or illness amongst staff or children, we will give you as much notice as possible via text message/telephone call. There are no refunds for such closures, however, we will only imagine closing in the most extreme circumstances.

    2.2. You will be required to register for a minimum of two sessions a week – this could be 2 full days or 2 school days.

    2.2.1. Full sessions must fit into the session times detailed in the prospectus.  We will endeavour to accommodate every child’s individual requirements. 

    2.2.1.2. Fees for school day sessions will include breakfast, morning snack, lunch and afternoon snack.

    2.2.1.3. Fees for full day sessions will include breakfast, morning snack, lunch, afternoon snack and tea.        

    2.3. All our fees are inclusive of nappies, creams and sun cream.  However, if a parent has a preference for a particular product, it will be the parent’s responsibility to provide it for their child’s use at the Nursery.  In the event of this scenario, no discount on fees will be made.

    2.5. If you wish to reduce your child’s sessions, we require notice of at least 1 calendar month. If we do not receive this notice, the usual full fee will be payable for that month.

     

    3.       Termination of Contract with Hove Village Day Nursery

    3.1. You may terminate this agreement at any time – a minimum of 2 months’ notice (in writing) is required. 

    3.2. Hove Village Day Nursery may immediately terminate this agreement in the event of:

    3.2.1. Failure to pay the Nursery fees

    3.2.2. Any breach, by you, of the conditions of contract under this agreement

    3.2.3. Unacceptable behaviour, by you, towards our members of staff or any action which endangers the safety and well-being of any of the children who attend the Nursery.

    3.2.4. Any decision by the Management of Hove Village Day Nursery to permanently close the Nursery.  As much notice will be given as possible to minimise the disruption this may cause

    3.3. You may immediately terminate this agreement if Hove Village Day Nursery breach any of the obligations set out in the Terms and Conditions and fail to rectify the breach within a reasonable period of time after you have bought it to our attention.

     

    4.       Your Obligations to Hove Village Day Nursery

    4.1. You are required to provide a passport/ID/birth certificate for us to photocopy as proof of your child’s identity when you receive notification from us that they are to receive their 2, 3 or 4-year-old funding

    4.2. You must inform us immediately if your child has an infectious disease and you must not allow your child to attend the Nursery if they have a contagious disease that could be passed on to another child within the Nursery.  We reserve the right to refuse admission to a child that may have an infectious/contagious disease until such a time they are declared fit by a medical professional.

    4.3. We reserve the right to contact you in the event of your child becoming ill during Nursery hours and ask that you collect your child as soon as possible.

    4.4. You are required to provide us with your child’s full medical details.  This will include all known allergies, conditions and additional needs that may affect your child whilst they are at Hove Village Day Nursery.  

    4.5. You must ensure all your child’s personal items and property are clearly marked, i.e. clothes, dummies, and comforters.

    4.6. Hove Village does not accept any responsibility for loss or damage of personal property i.e. toys.  As such, we request that your child does not bring toys from home, unless required for a specific topic.  In this event, any toys should be clearly labelled.

    4.7. Hove Village does not accept any responsibility for the loss or damage of your child’s clothes whilst they are at the Nursery.

    4.8. You are required to provide the following for your child (to be kept at the Nursery):

    4.8.1. A complete set of spare clothing

    4.8.2. A pair of wellingtons and outdoor weather gear

    4.8.3. A pair of indoor shoes - i.e. slippers, plimsolls

    4.9. You must inform us immediately if you are going to be late to collect your child from Nursery or if someone else is going to collect your child from Nursery. If the person collecting your child is unknown to us we will require proof of their identity.  If we are not satisfied that the person collecting your child is suitable we will not release your child into their care. A fee of £10 for each 15 minutes, or part thereof will be charged if you collect your child late from the Nursery.

    4.10. You must notify us of any changes to their registrations form, i.e. change of address, medical conditions, subject to any court order.

    4.11. You must complete a medical consent form if you require our staff to administer medicines to your child.  These medicines must be clearly marked with the child’s name.  If a medicine has been prescribed by a Doctor this must show the child’s name, time(s) of required treatment and dosage. 

    4.12. You must inform us if you child is going to be away from the Nursery for any length of time, i.e. holidays and hospital admissions. Fees during all absences are still payable.

    4.13. You must provide 30 days' written notice if you intend to decrease your child’s hours spent at the Nursery or 2 months' written notice to withdraw your child from the Nursery.  If insufficient notice is given, you will be liable for the full fees for your child for one month from the date of any requested changes.

    4.14 You must provide 2 months' written notice if you wish to amend your child's start date or booking pattern.  Please note that days are subject to availability.

     

    5.       Employing Hove Village Nursery Staff

    5.1. We have put in a considerable amount of work in recruiting and training our staff, so that children at the Nursery have the best care available. Should you hire the services of any of our staff at the Nursery during our opening hours, a fee equivalent to 25% of the staff member’s gross annual salary, plus VAT (if applicable) will become immediately payable. For 3 months following a staff member’s leaving the employment at the Nursery, staff members are not permitted to work for any parent, guardian or carer, unless the Nursery agrees to this in writing. The recruitment fee will become payable should this be the case. Should you require babysitting, or other services, we do not endorse use of our Nursery staff. Should any arrangement in this regard by made, you agree that this will be at your own risk and that you indemnify the Nursery, our staff, Directors, our agents, and affiliates of any liability.

     

    6.       Payment

    6.1. All payments made under these Terms and Conditions must be made by Direct Debit.  Under exceptional circumstances Hove Village Day Nursery may agree to receive fees by cash, cheque, debit or credit card. A fee of £40 will automatically be charged for each invoice not paid using Direct Debit as the payment method.

    6.2. If you require additional sessions or have incurred late collection fees we will invoice you one month in arrears and amend your Direct Debit accordingly. 

    6.3. If payment is not made in full by the due date you will incur an interest charge of 3.5% above the base rate of our bank on any fees outstanding until the invoice is cleared.  An administration fee of £35 will also be charged.

    6.4. Hove Village Day Nursery will not issue refunds for any sessions missed due to family holidays or sickness.

    6.5. When your child becomes eligible for government Nursery funding (normally the term following their birthday), the fee reduction will be applied to the next invoice.

    6.6. If you qualify for any discounts, these will be withdrawn from any invoices that have been paid late and the full (non-discounted) fee will immediately become payable.
