LASC Library Device Checkout Application

Thank you for your interest in requesting a loaner laptop from Los Angeles Southwest College (LASC). The following agreement is made by and between Los Angeles Southwest College Library (herein referred to as LASC Library) and you, the student, herein referred to as the STUDENT.

Please note that loaner laptops are available on a first-come, first-serve basis, while supplies last.

WHEREAS: In the interest in furthering the educational objectives of STUDENT, Los Angeles Southwest College Library will make available for use by the STUDENT, one (1) Google Chromebook OR Surface GO (DEVICE) for use during a mutually agreed upon loan period of one semester for the STUDENT actively enrolled at Los Angeles Southwest College.

THEREFORE: The STUDENT agrees to the following terms and conditions of use.

I, STUDENT, acknowledge that the condition of the DEVICE equipment are in good/satisfactory shape and without any prior defects or conditions that would require STUDENT to identify below as a "pre-loaned condition" on the DEVICE. If there are any concerns, I will immediately report them to the LASC Library. *

Device must be returned to Los Angeles Southwest College during the predetermined return period. I understand that failure to do so will cause a hold to be placed on my record and require me to pay fines to LASC for each late day. *

Section #4 - Care of Equipment

This describes STUDENT responsibilities for the DEVICE checked out. Please read carefully and provide your initials
STUDENT understands and agrees they will exercise all due (and reasonable) care in the handling and use of said DEVICE and accessories, and will voluntarily return, at the end of the mutually agreed upon loan period, the DEVICE and accessories (collectively, “equipment”) in the same condition they were in when first received, normal wear and tear excepted. STUDENT agrees to confirm to their own satisfaction the condition of the equipment when first received. LASC Library, in its sole discretion, will determine if the returned equipment reflects normal wear and tear. The parties agree that the following types of damage or loss, which are not intended to be limiting, are expressly beyond normal wear and tear: A. The STUDENT’s negligent use or misuse causes damage to the DEVICE and accessories. B. The damage incurred to the DEVICE and accessories is intentional. C. The damage, depreciation, or wear and tear reflects use outside the terms of this AGREEMENT. D. Total loss of equipment, by reason of theft, misplacement, irreparable damage or damage not economical to repair. *

Section #5 - Rules of DEVICE and accessories operation

This describes what you can use the DEVICE for. Please read carefully and provide your initials.
The STUDENT will abide by the following DEVICE and accessories use policies: A. The DEVICE and accessories are to be used for acceptable educational purposes only. B. STUDENT may only borrow and use the DEVICE and accessories if actively enrolled in an LASC face-to-face,online or hybrid course(s). C. DEVICE and accessories use by anyone other than the STUDENT is strictly prohibited. D. STUDENT will not download any software onto the DEVICE and accessories. E. Fixing, or attempting to fix, damage to any LASC Library DEVICE and accessories (parts or components) anywhere on- or off- campus is prohibited. If a DEVICE system fails, STUDENT must return the DEVICE and accessories to LASC Library within two business days. If another DEVICE is available, student maybe given a replacement. *

Section #6 - Lost, Stolen or Damaged DEVICE and Accessories

This describes your responsibilities for returning the DEVICE. Please read carefully and provide your initials.
In the event of DEVICE and accessories loss, theft or damage as specified in Paragraph 2 (collectively, “loss”), the STUDENT is liable to and shall pay LASC Library for the amount of the loss as determined by LASC Library in its sole discretion. STUDENT shall remit payment by cashier’s check within ten (10) business days. In cases where the DEVICE and accessories are lost or stolen, the STUDENT must file a police report and contact the LASC Office at 323-241-5311 within 2 business days. To file a police report, the student must immediately notify the local police (LASC Sheriff’s Department if the theft occurred on campus). Describe below any conditions on the DEVICE or its accessories that require identification here such as dents or markings. Failure to sign off or identify as to the condition of the DEVICE or its accessories may result in the STUDENT being held responsible for damage identified on the DEVICE or its accessories after return. *

Section #7 - Maximum Liability

This section reviews fines and/or fees that may be assessed.
Unless otherwise specified by this AGREEMENT, the maximum loss incurred by the STUDENT for a lost, stolen, or damaged DEVICE and accessories is $600 * Additional or overdue fines may be assessed for late or overdue DEVICE and accessories. *

Section #8 - Indemnity

This section confirms that you assume liability for the loaner DEVICE
The STUDENT agrees to reimburse and hold LASC and LASC Library harmless from (and against) any and all liabilities, costs, collection costs, and damages (including attorney fees) which may arise from the use/misuse of, or failure to return, the DEVICE and accessories. *

Section #9 - Waiver of Liability

This section confirms that you are responsible for the loss of this equipment and accessories
The STUDENT shall waive any liability, or any loss suffered through the LASC and LASC Library, including but not limited to, special, consequential incidental or indirect damages of any nature as a result of loss of data in the DEVICE or through STUDENT’s use of the DEVICE. *

Section #10 - Termination of Agreement

This section covers reasons why this contract can be terminated by LASC Library
Termination of this AGREEMENT shall occur automatically under any one of the following circumstances: A. The STUDENT drops/withdraws from active enrollment at LASC. B. The STUDENT is no longer eligible for LASC Library services. C. Breach of the terms and conditions of the AGREEMENT, or other LASC Library policies. D. Upon notice of termination to the STUDENT from LASC Library which may be with or without cause. E. Use of the DEVICE in a manner that violates B-27 and B-28 or other federal/state laws, District or LASC rules, regulations or guidelines related to appropriate DEVICE usage. Such inappropriate computing usage may subject a student to disciplinary measures independent from this AGREEMENT. F. Repeated instances of loss, theft or damage of DEVICE issued to STUDENT under this loan program. *Upon such termination, the STUDENT shall return the DEVICE and accessories to the LASC library within two business days. *

Section #11 - Notice of LASC Library Rights

This section reviews the LASC library rights of ownership
The STUDENT has no ownership, interest in, and/or rights to the DEVICE and accessories. LASC Library is the lawful owner of the DEVICE and accessories and such, will enforce its rights through all means civil and criminal. A STUDENT who is in material breach of the AGREEMENT and/or who denies any of LASC Library ownership rights to the DEVICE and accessories will be referred for possible student discipline and up to prosecution for felony theft. *

Section #12 - Delivery and Acceptance

This section covers the conditions for accepting the equipment and checkout process
By providing a signature, the STUDENT hereby agrees to the conditions of this AGREEMENT; and acknowledges intent to borrow a DEVICE and accessories. Upon completing this AGREEMENT the STUDENT will acknowledge receipt of the DEVICE and accessories listed above, in good condition and working order, and will verify the authenticity of the DEVICE and accessories serial number. The STUDENT agrees to return the DEVICE and accessories at the end of the mutually agreed upon loan period of one academic year, including the fall 2020, winter 2021, and spring 2021 semesters. Failure by the STUDENT to return the DEVICE and accessories on the designated end date of loan will result in Overdue Fines and an “equipment” hold being placed on the STUDENT’s records, thereby preventing future enrollment registration. In the event that the STUDENT is no longer a participant in LASC or an online or hybrid course, the STUDENT will be expected to return the DEVICE and accessories to the LASC Library within two business days. *
