  • Damage Waiver

    Best Way Disposal, Inc. (“Best Way”) is not responsible for any damage to lawns, driveways, pavement, private roads, sidewalks, curbs, underground plumbing, wells, septic systems, sprinkler systems, or utilities.  It is your responsibility to make Best Way aware of any surface conditions or underground utilities which might be affected by delivery of a container or Portable Restroom.  You assume responsibility for damage that may occur due to the size and weight of the vehicle and the size and weight of the container.  Best Way shall only be liable for damages to the extent that such damages were caused by Best Way’s gross negligence or willful misconduct.

    Customer Company understands and agrees that this Waiver applies to any and all locations at which Customer Company requests service.

    Signatory Representation of Authority. The person signing this Waiver represents and warrants that he or she is duly authorized and has legal capacity to execute and deliver this Waiver. Signer represents and warrants that the execution and delivery of this Waiver has been duly authorized and that the Waiver is valid and enforceable in accordance with its terms.

  • Roll Off Terms and Conditions

    • Container pricing includes a 10 day rental, if you need to keep the container longer please call the day before removal date to make a per day extension payment at the rate then in effect.
    • Container pricing is based on a ton limit, if the container goes over the ton limit customer will be charged a per ton amount for each ton over the limit.

  • What Can't Go in the Container

    • Asbestos – (Must be pre-approved for disposal prior to delivery of container)
    • Liquids of any kind
    • Paint cans that have any wet paint
    • Hazardous materials
    • Tires
    • Yard Waste – (cannot mix yard waste and trash we can provide a container for yard waste only- Yard waste is grass, leaves and limbs smaller than 4’ long and 2’ diameter.)
    • Freon Containing items - Refrigerator, Freezer, Dehumidifier and Air Conditioner
    • Beverage Containers - A gallon in size or smaller and carbonated are required to be recycled in Michigan.
    • Cylinders - Propane, Oxygen, Helium, Water.  Cannot be sealed must be able to visually inspect the inside of container.
    • Dirt, rock, concrete or sand – (we can provide containers for clean concrete or asphalt - Concrete containing lead paint, oils, and other contaminates need to be approved for disposal prior to delivery of a roll-off container to the site.  Dirt or sand must be pre-approved for disposal prior to delivery of container)

  • Portable Restroom Terms and Conditions

    • Customer must be on site to inspect the restroom and sign-off as to the condition upon delivery and removal. If the customer cannot be on site for delivery or removal, customer accepts the unit as is.
    • Customer must place an object that marks the placement of the unit. Unit will not be placed more than 50’ from a driveway.
    • Customer shall be responsible for all loss or damage to the equipment other than normal wear and tear.
    • Customer agrees to indemnify, defend and hold harmless Best Way Disposal against all claims, damages, suits, penalties, fines, and liability for injury or death to persons or loss or damage to property arising out of customers use or possession of the equipment.
    • On delivery, service and removal day customer shall provide unobstructed access to equipment. If the equipment is inaccessible the customer will be notified and charged for any additional attempts to provide such service or charged based on how many minutes Best Way waits for the unit to be unobstructed.
    • Customers who move units must notify Best Way Disposal 24 hours in advance to service day of the new location. If Best Way Disposal cannot locate the portable restrooms to be cleaned an additional fee will be charged to go back.
    • If the restroom unit is not in rentable condition at time of pick-up due to damage caused by carelessness, neglect, abuse or vandalism while in the possession of the customer, the customer will be responsible for lost revenues, parts to fix unit, man-hour time, until the portable restroom can be repaired or replaced and placed into service. If the units is deemed unfixable customer will be responsible for replacement cost.
