USDA has granted TDA the discretion to waive Summer Food Service Program/Seamless Summer Operation (SFSP/SSO) and Child and Adult Food Care Program (CACFP)At-Risk area eligibility requirements for the Fall Educational Term under the following circumstances:
- Contracting entities (CE) that wish to serve in-need populations from one or more open SFSP/SSO and/or CACFP At-Risk non-congregate sites that do not meet area eligibility requirements may submit this form and will be considered for approval based on the submitted justification.
- Contracting entities who are providing closed enrolled congregate SFSP/SSO service to students onsite at schools in non-eligible areas will automatically be granted an area eligibility waiver once they opt-in via this form.
This flexibility is available through June 30,2021. Note that this expiration date is subject to change by USDA and may be extended or shortened depending on the status of the public health emergency and the availability of funding.
By completing this form, you are:
- Requesting the flexibility to serve non-congregate meals via the Summer Food Service Program/Seamless Summer Option and/or the CACFP At-Risk Afterschool Care Program in areas that do not meet the area eligibility requirements (the site is less than 50% F&R populations based on pre-COVID-19 data is not eligible via census data)
OR
- Attesting that you plan to operate a closed enrolled SFSP/SSO site in a congregate setting at a non-area eligible site.
NOTE: You are not approved to operate until your site application has been submitted and approved in TX-UNPS.
Contracting entities are required to maintain documentation that supports statements made in this submission. By submitting this application, the contracting entity is confirming that this form is true and correct.
