Thank you so much for your participation in the 2021 portrait series: 30 & Sexy. I am truly grateful for your willingness to share your personal trials and victories with me; allowing me to capture you in your full essence. Below are required agreements to review and consent to prior to your photo session. Please Note: This form serves as a legally binding contract between Toria Germain Photography and you.

Each session for this project includes:
- A pre-session phone consultation;
- Styling consultation;

- Makeup and OPTIONAL Hair Styling;
- 3-4 hour photo shoot.
- Post-Shoot Interview (filmed) - during Reveal

I understand I am required to have a pre-session consultation two (2) weeks prior to my scheduled photo shoot. *

I understand that I will receive $300 credits that can be used towards any photo collection. *

I Understand
I understand that I am responsible for my own wardrobe and communicating what items I would potentially like to utilize from the Client wardrobe prior to my photo session with Toria Germain. I further understand that all of the clothes I bring should be pressed and clean for the photo session. Details on styling are located in your welcome guide. If you have trouble with your wardrobe please contact me and I will be happy to assist you further. *

I understand that, if I select to have my hair serviced, I must arrive with clean hair. *

I understand that my nails should be clipped and clean or filled and freshly painted. We suggest neutral colors for best results. *

I understand that additional guests are not permitted to attend the shoot, unless they are also being photographed. *

I understand that I will need four (4) hours of availability on a Saturday or Sunday for my photo shoot. (Time will include: Interview, Makeup/Hair, Session). *

I also understand that there are no monetary reimbursement or transfers will be provided. *

RESCHEDULING: If an illness or emergency situation prevents a photo session from taking place, clients may reschedule their session within 72 hours prior of their shoot without penalty. Should the client fail to give 72 hours notice or decide to completely cancel the shoot, the session is forfeited and will not be rescheduled.

Toria Germain Photography reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.

ARCHIVE OF SESSION IMAGES: After 24 hours, all images will be purged from hard-drives utilized by Toria Germain Photography; except as needed for promotional purposes, to be determined by photographer at company’s sole discretion. Toria Germain Photography is not responsible for loss or damage to the digital files due to circumstances beyond the photographer's control.

COPYRIGHT AND PENALTY: Toria Germain Photography retains all copyrights to all images created during client’s session. A print release is included with digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of client portraits (i.e. entering in contests), selling or altering of client images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Toria Germain Photography during a client's photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If a client misappropriated images via any method listed above, or any other method, the client will be invoiced for the cost of EACH digital image, at the current price per digital file by Toria Germain Photography. Digital images and prints purchased from Toria Germain Photography can only be used for personal use and not for commercial, political, or any for-profit uses. A separate commercial release can be purchased if the images need to be used for anything other than personal use. Sharing on personal social media pages, web pages, or blogs is allowable but credit and link back to www.toriagermainphotography.com is required.

DAMAGE: Toria Germain Photography is not responsible for the damage of portraits, printed products, or media after delivery to the client, including damage caused during transit by the United States Postal Services, FedEx, and/or United Postal Services via mail. Client assumes all responsibility for the safety of all photo products upon receipt.

LIABILITY: Toria Germain Photography is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for themselves and their child(ren), releasing Toria Germain Photography from any claims against the owner or this business.
