TERMS OF SERVICE

1. ENTIRE AGREEMENT*

This agreement contains the entire understanding between Photographed with Love (Mariam Mohd Johari) and the Clients listed in this agreement (refer Client Details section). It supersedes all prior and/or any other verbal or other agreements between theparties. Additions or alterations to this agreement will only be recognised if in writing and signed by both parties.

2. SERVICE GUARANTEE*

Photographed with Love guarantees its services up to but not to exceed the agreed 1 hour photoshoot session. Services include the digital photographing of the above portrait session by Photographer (Mariam Mohd Johari) at the above speciﬁed time and place with the use of Mariam as the principal photographer.

3. PHOTOGRAPHY STYLING*

The Client understands that the quantity of photographs taken at the event can vary greatly and that photography by nature is an art, subject to the creativity of the photographer and her personal artistic style. The Client understands that he/she has chosen the photographer because of her photographic style, and will grant the photographer the right to exercise her creativity in the interest of creating the best images possible.

4. PAYMENT*

Full payment of $450 is required to secure date and time of the photo session. Payment details are included in the invoice. Payment must be made within 7 days of booking confirmation.

5. DELIVERY*

Photos will be available for viewing and download within 7 days after the photoshoot session that will be made available via an online gallery.

6. PHOTO POLICY*

Client agrees that unedited photos will not be shared for any reason. Only your retouched/edited photos will be released. If Client would like to purchase additional photos, the Client may do so. All outtakes and unedited photos are the property of Photographed with Love and are not to be shared, distributed or posted under any circumstances.

7. MODEL RELEASE

I hereby give to Mariam Mohd Johari of Photographed With Love the absolute and irrevocable right and permission with respect to the photographs that she has taken of myself in which he/she may be included in Photographed with Love publications in any medium for marketing and promotional uses.

8. COPYRIGHT*

All photography copyright © by Photographed with Love is protected by Australian Copyright Law (all rights reserved). Photographed with Love reserves the right to use any photographs taken during the event for advertising and commercial use. The event may be posted on the Photographed with Love website and social media with samples from the session to be used for promotional and marketing materials. Should the Client not wish to have their event uploaded to the internet for viewing or a sample placed on the Photographed with Love website and social media or used in marketing materials, a request must be made prior to the event in writing.

9. CLIENT USAGE RIGHTS*

The Client is allowed to display resulting images for personal use. Said images may not be altered or reproduced in any manner without prior written permission of Photographed With Love. Client will receive high resolution photos with printing rights. When publishing the photos socially, Photographed With Love must be noted as the photographer. The Client must obtain written permission from Photographed With Love prior to the Client, their associates, friends or relatives selling the photographs.

10. LIMIT OF LIABILITY*

In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative photographer. Photographed with Love will make every effort to secure replacement photographer able and/or willing to provide similar package as chosen in this contract. If such situation should occur and suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, or otherwise lost or damaged without fault on the part of the Photographer. The Photographer makes every effort to keep any of the above from happening. No specific photograph is guaranteed.
